(चैनेज) म ें परिवर्तगत की जाने समकक्ष लंबाई वाली संिचना प *की (दक.मी. म)ें लंबाई (दक.मी. म)ें 1 िािा-41 पि 11.600 बड़े पलु (चैनेज 1.185) 0.072 0.72 दक.मी./चैनेज पि (पूवी आिओबी (चैनेज 2.067) 0.403 4.03 मेिनीपुि धजले म ें फ्लाई ओवि (चैनेज 2.687) 0.402 4.02 सोनापेटया र्ांव के धनकट ) आिओबी (चैनेज 13.104) 0.116 1.16 आिओबी (चैनेज 29.877) 0.603 6.03 योर् 1.596 15.96 3. धजस व्यधि का अपना यांधत्रक वाहन, र्ैि-वाधणधज्यक प्रयोजनों के धलए पंजीकृत हुआ हो औि वह टोल प्लाजा से बीस दकलोमीटि तक की ििू ी म ें ही िहता हो, उसके धलए विग 2017-18 के धलए माधसक पास की िि 245.00/- रूपए (िो सौ पैतालीस रूपए मात्र) होर्ी औि िाष्ट्रीय िाजमार्ग शुल्क (ििों का अविािण औि संग्रहण) धनयम, 2008 के उपबंिों के अनुसाि उसमें प्रत्येक विग संशोिन दकया जायेर्ा । 4. िाजमार् ग खण्ड पि बहुयात्रा प हते ु पास धनम्नधलधखत ििों पि जािी दकया जाएर्ा, अथागत ः संिेय िाधश अनुज्ञात एकतिफा यात्रा प की धवधिमान्यता की अवधि अधिकतम संख्या एकतिफा यात्रा के धलए शल्ु क का डेढ़ िो संिाय के समय स े चैबीस घंटे र्ुना पचास औि उससे अधिक एकल पचास या अधिक संिाय की तािीख से एक मास यात्रा प के धलए संिेय शुल्क की िाधश का िो-धतहाई 5. धजस धजले में शुल्क प्लाजा पड़ता ह ै उस धजले में पजं ीकृत वाधणधज्यक वाहन (िाष्ट्रीय पिधमट के अिीन चल िह े वाहनों को छोड़कि) के धलए शुल्क उस श्रेणी के धलए वाहन के धलए धनिागरित शुल्क का 50% होर्ा बशते दक ऐसे वाधणधज्यक वाहनों के उपयोर् के धलए कोई सर्वसग िोड अथवा वैकधल्पक सड़क उपलब्ि न हो ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 6. जो यांधत्रक वाहन अपनी श्रेणी के धलए धनिागरित अनज्ञु ेय भाि की अपेक्षा अधिक भाि स े लिा हुआ होर्ा उसके चालक अथवा माधलक अथवा प्रभािी व्यधि को ऐसे अधिक भाि स े लि े हुए वाहन को िाष्ट्रीय िाजमार् ग में प्रवेश किाने के धलए शुल्क संग्रहण एजेंसी को ऐसी श्रेणी के यांधत्रक वाहनों के धलए लार् ू शुल्क के िस र्ुना के बिाबि शुल्क का भुर्तान किना होर्ा औि उस े िाजमार् ग खण्ड का उपयोर् किने की तब तक अनुमधत नहीं होर्ी जब तक दक ऐसे यांधत्रक वाहन से अधिक भाि को हटा नहीं दिया जाता। 7. यांधत्रक वाहनों की श्रेणी, उनके धलए अनुज्ञेय भाि, छूट-प्राप्त वाहनों की श्रेणी, सर्वगस िोड, वैकधल्पक सड़क आदि सधहत सभी परिभािाए ं धनयमों में धवधनर्िष्टग परिभािा प के अनसु ाि होंर्ी । 8. उि धनयमों के धनयम 12 के अनुसाि, उपयोर्कताग प की जानकािी के धलए शुल्क की ििों को प्रिर्शगत दकया जाएर्ा । 9. ऊपि सारिणी-1 में यथा – उधल्लधखत आिाि विग 2007-08 के धलए प्रधत दकलोमीटि शुल्क की आिाि िि के आिाि पि, यांधत्रक वाहनों के धलए जान े वाल े वास्तधवक शुल्क औि कटौधतयों की र्णना प्राधिकिण द्वािा की जाएर्ी। प्राधिकिण द्वािा उसे रियायतग्राही के माध्यम स े अंग्रेज़ी औि स्थानीय भािा के कम-स-े कम एक-एक समाचाि पत्र म ें प्रकाधशत किवाया जाएर्ा औि इसके तत्पिात उि धनयमों के धनयम 5 औि रियायत किाि के प्राविानों के अनसु ाि उसम ें वार्िगक तौि पि संशोिन दकया जाएर्ा औि ओएमटी रियायतग्राही के माध्यम से प्रकाधशत किवाया जाएर्ा, पिंतु शतग यह ह ै दक शुल्क में धपछली बाि दकए र्ए संशोिन दक तािीख से 6 (छ) महीने दक अवधि के भीति कोई संशोिन नही दकया जाएर्ा। 10. 01.07.2017 के अनसु ाि, वाधणधज्यक प्रचालन दक तािीख स े परियोजना की वसूल की जान े वाली पूंजीर्त लार्त का वतगमान मूल् य 449.12* (चाि सौ उनंचास किोड़ बािह लाख रुपये मात्र) ह।ै वाधणधज्यक प्रचालन (सीओडी) की तािीख स,े टोल का संग्रहण रियायतग्राही द्वािा िाष्ट्रीय िाजमार् ग शुल्क (ििों का अविािण औि संग्रहण) धनयम, 2008 तथा बोली की धनयत तािीख तक उसमें दकए र्ए संशोिनों के अिीन िी र्ई व्यवस्था के अनुसाि, लार् ू ििों पि दकया जाएर्ा। पूंजीर्त लार्त की वसूली रियायत शुल्क के माध्यम से वाधणधज्यक प्रचालन की तािीख को एन वी पी को प्राप्त किन े हते ु 12% प्रधतविग की िि से छूट िते े हुए की जाएर्ी। परियोजना की वाधणधज्यक प्रचालन की अनंधतम तािीख 01.07.2017 ह।ै धजस दिन पूंजीर्त लार्त की वसूली हो जाएर्ी उस दिन से धलए जान े वाल े प्रयोिा शुल्क की ििों को घटाकि 40% कि दिया जाएर्ा। रियायत शुल्क को भी िये िाधश से घटाकि 40% कि दिया जाएर्ा तथा खंड 21.1.1 के अनुसाि 10% की वार्िगक वधृ ि भी लार् ू होर्ी। *रटप्पणी: धजसम,ें िा िा – 41 के अंत में चनै ेज 52.080 से 53.472 तक िानीचक पि आिओबी-सह- फ़्लाइओवि (धनमागणािीन) पि धवचाि कित े समय आिओबी-सह-फ़्लाइओवि की लार्त को जोड़त े हुए संशोधित शुल्क अधिसूचना जािी किने के समय भािािाप्रा द्वािा दकए जा िह े आिओबी-सह-फ़्लाइओवि के धनमागण काय ग पूिा हो जाने पि, अलर् से संशोिन दकया जाएर्ा । [फा. स.ं भािािाप्रा/13013/सीओ/17-18/जीसी- कोलाघाट-हधल्िया (ओएमटी)] िधक्षता िास, संयुक् त सधचवII (ii) 5 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 26th July, 2017 S.O. 2341(E).—Whereas, vide notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing), number S.O. 581(E), dated the 21st June, 2001, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the 52.7 Km. stretch of National Highway No. 41 connecting Haldia Port on one end and Kolaghat on NH-6 on other end in the state of West Bengal to the National Highways Authority of India (hereinafter referred to as the Authority) ; And Whereas, in exercise of the powers conferred by section 7 of the National Highways Act 1956(48 of 1956) read with the Rule (3) of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government by notification of the government of India vide S.O. No. 115 (E) dated 09th January, 2013 and amended vide Sl. No. 84 of S.O. No. 896 (E) dated 26.03.2014 notification has authorized Authority for levying and collecting fee on mechanical vehicles for net road length of 52.70 Km. of National Highway number 41 in the State of West Bengal. And Whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said agreement) on 09.05.2017 with M/s Eagledeep Kolaghat Haldia OMT Project Private Ltd having its registered office at B.K. No. 758, No. -16, Plot No. 59, Near Chopra Court, Ulhasnagar, 3 Thane-421003, District Thane (Maharashtra) (hereinafter referred to as the “Concessionaire”), for bids submitted on 31.01.2017 for the Operation and Maintenance of Kolaghat Haldia section (from km 0.000 to km 52.080) of NH-41 in the state of West Bengal (hereinafter referred to as the “said section”) on Operation, Maintenance & Transfer (OMT) basis; Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and its amendment till bid submission date (hereinafter referred to as the “Rules”), (hereinafter referred to as the “Rules”) and in supersession of the notifications number S.O. 115(E) dated 09th January, 2013 as amended vide Sl. No. 84 of fee notification S.O. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 245.00 (Rupees Two Hundred and Forty-five only) for the year 2017-18, which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one Two Twenty four hours from the time way journey of payment Two-third of amount of the fee payable Fifty or more One month from date of payment for fifty or more single journeysII (ii) 7 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules. 9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised and got published annually through the OMT Concessionaire in accordance with the Rule 5 of the said Rules and provisions of the Concession Agreement, and will be published; provided, however, that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee. 10. The Present Value of Capital Cost of the project to be recovered from the date of COD is Rs. 449.12* Crore (Rupees four hundred forty-nine crore and twelve lakh only) as on 01.07.2017. From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and further amendments till bid due date. The Capital Cost shall be recovered through Concession Fee by discounting @ 12% per annum to arrive at NPV as on the date of commercial operation (COD). The tentative COD for the project is 01.07.2017. After the day on which the Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of the rate being charged.
