STATUTORY INSTRUMENTS 2026 No. 1028 SOCIAL CARE, ENGLAND The Care and Support (Charging and Assessment of Resources) (Amendment) (No. 2) Regulations 2026 Made - - - - 15th September 2026 Laid before Parliament 16th September 2026 Coming into force - - 30th October 2026 The Secretary of State makes these Regulations in exercise of the powers conferred by sections 17(7), 17(11), 17(12) and 125(7) of the Care Act 2014(1).
Citation, commencement and extent
1.โ(1) These Regulations may be cited as the Care and Support (Charging and Assessment of Resources) (Amendment) (No. 2) Regulations 2026.
(2) These Regulations come into force on 30th October 2026.
(3) These Regulations extend to England and Wales.
Amendment of the Care and Support (Charging and Assessment of Resources) Regulations 2014
2.โ(1) The Care and Support (Charging and Assessment of Resources) Regulations 2014(2) are amended as follows.
(2) In Schedule 1 (Sums to be disregarded in the calculation of income), after paragraph 44 insertโ โ44A.
Any payment made under the Mother and Baby Institutions Payment Scheme established by the Irish Government under section 5 of the Mother and Baby Institutions Payment Scheme Act 2023

(3) In Schedule 2 (Capital to be disregarded), after paragraph 43(4) insertโ

EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Care and Support (Charging and Assessment of Resources) Regulations 2014 (โthe 2014 Regulationsโ).
Schedules 1 and 2 to the 2014 Regulations list categories of income and capital respectively that must be disregarded by local authorities when calculating someoneโs income and capital for charging purposes. Regulation 2 inserts a new paragraph 44A into Schedule 1 and a new paragraph 44 into Schedule 2.
Regulations 2(2) and 2(3) provide that any payment made under the Mother and Baby Institutions Payment Scheme established by the Irish Government under section 5 of the Mother and Baby Institutions Payment Scheme Act 2023 (Ireland) shall be disregarded by local authorities when calculating someoneโs income and capital respectively for charging purposes.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
