STATUTORY INSTRUMENTS 2026 No. 165 (C. 14) IMMIGRATION AND ASYLUM The Nationality and Borders Act 2022 (Commencement No. 9) Regulations 2026 Made - - - - 25th February 2026 The Secretary of State makes these Regulations in exercise of the power conferred by section 87(1) of the Nationality and Borders Act 2022(1). Citation and extent 1.—(1) These Regulations may be cited as the Nationality and Borders Act 2022 (Commencement No. 9) Regulations 2026. (2) These Regulations extend to England and Wales, Scotland and Northern Ireland. Provision coming into force on 20th March 2026 2. Section 76 of the Nationality and Borders Act 2022 (liability of carriers) comes into force on 20th March 2026. EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations bring into force on the 20th March 2026 section 76 of the Nationality and Borders Act 2022 (c. 36). Section 76 relates to the liability of carriers, and amends section 40 of the Immigration and Asylum Act 1999 (c. 33) (charges in respect of passenger without proper documents) so that it applies to persons who arrive without the required electronic travel authorisation.
