STATUTORY INSTRUMENTS 2026 No. 493 FOOD, ENGLAND The Charges for Residues Surveillance (Amendment) (England) Regulations 2026 Made - - - - 5th May 2026 Laid before Parliament 6th May 2026 Coming into force - - 1st June 2026 The Secretary of State makes these Regulations in exercise of the powers conferred by sections 45 and 48(1)(b) and (c) of the Food Safety Act 1990(1) and now vested in the Secretary of State(2). In accordance with section 48(4A)(3) of that Act the Secretary of State has had regard to advice given by the Food Standards Agency on the proposal to make these Regulations. There has been consultation as required by Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(4). Citation, commencement, extent and application 1.—(1) These Regulations may be cited as the Charges for Residues Surveillance (Amendment) (England) Regulations 2026 and come into force on 1st June 2026. (2) These Regulations extend to England and Wales but apply in relation to England only. Amendments to the Charges for Residues Surveillance Regulations 2006 2.—(1) The Charges for Residues Surveillance Regulations 2006(5) are amended as follows. (2) In regulation 3 (liability for and recovery of charges for residues surveillance)— (a) in paragraph (1)(a)— (1) 1990 c. 16; sections 45(1) and 48 were amended by paragraphs 20 and 21 of Schedule 5 to the Food Standards Act 1999 (c. 28). (2) The powers, so far as they are exercisable in relation to England, were transferred by article 2(6) of the Transfer of Functions (Agriculture and Food) Order 1999 (S.I. 1999/3141) to the Minister of Agriculture, Fisheries and Food and the Secretary of State acting jointly, and by article 2(3) of the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794) to the Secretary of State. (3) Section 48(4A) was inserted by paragraph 21 of Schedule 5 to the Food Standards Act 1999. (4) EUR 2002/178, to which there are amendments not relevant to these Regulations. EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Charges for Residues Surveillance Regulations 2006 (S.I. 2006/2285). These amendments vary the fees required to be paid in respect of the Secretary of State’s surveillance of animals and animal products for residues of veterinary medicinal products and other substances.
