The Border Security, Asylum and Immigration Act
2025 (Commencement No. 4) Regulations 2026

The Secretary of State makes these Regulations in exercise of the powers conferred by section 65(1)
of the Border Security, Asylum and Immigration Act 2025(1).
Citation
1. These Regulations may be cited as the Border Security, Asylum and Immigration Act 2025
(Commencement No. 4) Regulations 2026.
Provision coming into force on 1st October 2026
2. Section 48 (extension of prohibition on employment to other working arrangements) of the
Border Security, Asylum and Immigration Act 2025 comes into force on 1st October 2026.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations bring into force section 48 (extension of prohibition on employment to other
working arrangements) of the Border Security, Asylum and Immigration Act 2025 (c. 31) (“the
Act”). They are the fourth commencement regulations made under the Act.
Section 48 amends the Immigration, Asylum and Nationality Act 2006 (c. 13) (“the 2006 Act”).
It extends the application of the illegal working provisions in sections 15 to 24 of the 2006 Act to
cover arrangements beyond contracts of employment and expands liability for civil penalties under
section 15 of the 2006 Act.
