The Lord Chancellor makes these Regulations in exercise of the powers conferred by sections 173(4)
and 197(1)(b) of the Transport Act 2000(1).
Citation and commencement
1.—(1) These Regulations may be cited as the Road User Charging Schemes (Penalty Charges,
Adjudication and Enforcement) (England) (Amendment) Regulations 2026.
(2) These Regulations come into force on 7th September 2026.
Amendment of the Road User Charging Schemes (Penalty Charges, Adjudication and
Enforcement) (England) Regulations 2013
2.—(1) The Road User Charging Schemes (Penalty Charges, Adjudication and Enforcement)
(England) Regulations 2013(2) are amended in accordance with paragraph (2).
(2) In regulation 3 (service of documents)—
(a) in paragraph (1), in both places it occurs, omit “first class”;
(b) after paragraph (4)(a), insert—
“(aa) service of a notice or other document sent by post other than first class post
to an address in the United Kingdom is to be taken to have been effected on the
fourth working day after the day on which it was posted;”;
(c) in paragraph (4)(b)—
(i)omit “first class”;

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Road User Charging Schemes (Penalty Charges, Adjudication and
Enforcement) (England) Regulations 2013 (S.I. 2013/1783) by amending the provisions relating to
the service of notices and other documents by a charging authority. The effect of the amendment
is to permit the use of a wider range of postal services and specify the deemed date of delivery for
documents served within and outside the United Kingdom.
A full impact assessment has not been produced for this instrument as no, or no significant impact
on the private, voluntary or public sector is foreseen.
