Official Journal EN of the European Union L series 2023/2400 9.11.2023 DECISION OF THE EEA JOINT COMMITTEE No 118/2023 of 28 April 2023 amending Annex XIII (Transport) to the EEA Agreement [2023/2400] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof, Whereas: (1) Commission Implementing Regulation (EU) 2021/1296 of 4 August 2021amending and correcting Regulation (EU) No 965/2012 as regards the requirements for fuel/energy planning and management, and as regards requirements on support programmes and psychological assessment of flight crew, as well as testing of psychoactive substances(1)is to be incorporated into the EEA Agreement. (2) Annex XIII to the EEA Agreement should therefore be amended accordingly, HAS ADOPTED THIS DECISION: Article 1 The following indent is added in point 66nf (Commission Regulation (EU) No 965/2012) of Annex XIII to the EEA Agreement: ‘— 32021 R 1296: Commission Implementing Regulation (EU) 2021/1296 of 4 August 2021 (OJ L 282, 5.8.2021, p. 5).’ Article 2 The text of Implementing Regulation (EU) 2021/1296 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 29 April 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made*, or on the day of the entry into force of Decision of the EEA Joint Committee No 114/2023 of 28 April 2023(2), whichever is the later. Article 4 This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union. Done at Brussels, 28 April 2023.
