What it means

  • The gazette notification pertains to the enactment of the ‘Delhi BNSS (Identification of Case Property) Rules, 2025’ by the Lieutenant Governor of the National Capital Territory (NCT) of Delhi. These rules are framed in accordance with the powers conferred by sub-section (2) of section 497 of The Bharatiya Nagarik Suraksha Sanhita, 2023, read with a notification from the Ministry of Home Affairs. The rules outline procedures for the identification and handling of case property presented before a competent court during investigation, inquiry, or trial.

  • The rules specify that when property is produced before a competent court, the person presenting it must also provide the seizure memo or any document describing the property.
  • The competent court is required to prepare a statement of the property's description within fourteen days of its production, using a specified form (Schedule 1).
  • If test identification proceedings are necessary, they must be completed before the statement of identification is prepared.
  • The competent court must take photocopies, photographs from all angles, and, if necessary, videography of the property.
  • For properties requiring sampling (e.g., liquor), samples and photographs of the entire seized property must be taken, along with videography if needed.
