PART—II
Conditions .—
1. Their appointment shall be subject to Bombay High Court Appellate Side Service Rules,
2000 and such other Rules/Circulars as may be issued from time to time by the High Court.
2. On their appointment, they would be covered under New “Defined Contribution Pension
Scheme” (Renamed as “National Pension Scheme”). The existing pension scheme under
Maharashtra Civil Services (Pension) Rules, 1982 and Maharashtra Civil Services
(Commutation of Pension) Rules, 1984 and General Provident Fund Scheme would not be
applicable to them.
3. Their appointment as Personal Assistant to the Hon’ble Judge shall be on probation for
a period of two years or until an order declaring them to have satisfactorily completed the
period of probation, is made by the Appointing Authority, whichever is later. During the
probation period, their services are liable to be terminated without notice and without
assigning any reason.
4. Their seniority will be according to their position in the select list for the post of Personal
Assistant to the Hon’ble Judge.
5. Their appointment is made subject to the result of litigation/ representation, whether
pending, if any, or that may be filed, in which appointment to the post of Personal Assistant
to the Hon’ble Judge are/would be challenged.
6. Their appointment to the post of Personal Assistant shall be subject to the outcome of the
verification of character and antecedents.
7. Their appointment is subject to being declared medically fit by an appropriate medical
authority.
8. They will have to deposit one month’s Basic Pay in lieu of one month’s notice, in case, they
tender resignation without giving prior notice.
9. They will have to submit declaration duly signed by them and their concerned relatives
stating that they have not taken any dowry as per provisions of Rule 23-A of the Bombay
High Court (Conduct) Rules, 1989, or if unmarried, the same will be required to be
submitted after marriage.
10. In case they fail to join duties within 30 days from the date of the receipt of this High
Court Notification or to inform the undersigned their inability to do so, their name will
be struck off from the Select List.
11. In case the information submitted by them regarding their eligibility for the abovesaid
post i.e. educational qualification, age, caste, domicile etc. is found to be incorrect or false,
their services would be liable to be terminated at any time, without assigning any reason.
12. They have to submit the enclosed “Attestation form” alongwith “Identity Certificate”
(enclosed herewith) duly filled in and signed, at the time of joining the post.
