NOTIFICATION
Maharashtra highways act.
No. PPP-2024/C.R.86/Road-8.— Whereas, the Government of Maharashtra has, vide Government
Notification, Public Works Department No. PPP-2023/C.R.411/Road-8, dated the 9th February 2024,
in exercise of the powers conferred by section 3 of the Maharashtra Highways Act (LV of 1955)
(hereinafter referred to as "the said Act") has declared the lands described in the Schedule appended
thereto to be a Highway and classified it as a State Highway (Special) Number 09 to be known as
the Nagpur-Chandrapur Access Control Super Communication Expressway [Seldoh Interchange to
Navegaon More on Durg Hydrabad Highway] in the State of Maharashtra;
And whereas, in exercise of the powers conferred by sub-section (2) of section 15 read with
section 17 of the said Act, the Government of Maharashtra, vide Government Notifications Numbers
specified in column (4) in the schedule appended herewith, declared its intention to acquire the land
required by the Maharashtra State Road Development Corporation Limited,-the Highway Authority,
for building, maintenance, management or operation of the Nagpur-Chandrapur Access Control
Super Communication Expressway (State Highway (Special) No.09);
And whereas, the notifications published under sub-section (2) of section 15 of the said Act for
acquisition of land but as per provision of sub-section (3) of section 18 of the said Act no declaration
under sub-section (1) of section 18 has been published within a period of one year from the date of
publication of such notifications, therefore the said notifications ceased to have effect;
And whereas, due to increased workload of other urgent Government business, it was not possible
to publish the declaration for land acquisition within a period of one year as provided under section 18
of the said Act; and therefore to empower the State Government to extend the said period of one year
for publication of declaration for further period upto one year and for the purpose the Maharashtra
Highways Act (LV of 1955) has been amended by the Maharashtra Highways (Amendment) Act,
2025 (Mah. XXVII of 2025);
And whereas, the Government of Maharashtra is of the opinion that circumstances exists
justifying the delay in order to extend the period for publication of declaration;
Now, therefore, in exercise of powers conferred by the second and third provisos to sub-section
(3) of section 18 of the of the said Act read with section 3 of the Maharashtra Highways (Amendment)
Act, 2025 (Mah. XXVII of 2025), the Government of Maharashtra hereby extend the period for
publication of declaration as required by sub-section (3) of section 18 of the said Act in respect of the
Government Notifications specified in column (4) of the Schedule appended hereto with effect from
the dates specified in column (5) appended thereto and in respect of Districts and talukas as specified
in columns (2) and (3), respectively appended thereto till 28th April 2026.
