No.227 भाग IV PART IV राष्ट्रीय रािधानी राज्य क्षत्रे दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI सतककता जनिेिालय vf/klwpuk दिल्ली, 18 flrEcj] 2023 फा.सं.01/15/डीओवी/एडजिन/2022/पार्क फाइल/10746.—केंद्रीय सरकार, आधार (जवत्तीय और अन्य सहाजयदकयों, प्रसुजवधाओं और सेवाओं का लजक्षत पररिान) अजधजनयि 2016 की धारा 4 (4) (ख) (ii) के अंतगकत, अथॉररर्ी के पराििक से राज्य सरकार के जहत िें स्ट्वैजछिक आधार पर प्रिाणीकरण करने की अनुिजत िे सकती है। िबदक, इस पररयोिनाथक, भारत सरकार ने सुिासन हेतु (सिाि कल्याण, नवाचार और िानकारी) जनयिावली, 2020 के तहत, आधार प्रिाणीकरण तैयार दकया है जिसके अंतगकत राज्य सरकार स्ट्वैजछिक आधार पर आधार का उपयोग करने के जलये उक्त जनयिो के अंतगकत अनुिजत िांग सकती है। िबदक, भारत सरकार ने दिनांक 22 िून 2023 के ई-फाइल संख्या 13(4)/2020-ईिी-II (वॉल्यूि–9) के प्राजधकार पत्र द्वारा सतककता तथा भ्रष्टाचार जनरोधी रैप जिकायतें ििक करने के जलए ऑनलाइन पोर्कल पर पंिीकरण के सिय हााँ/नहीं अथवा/और ई-केवाईसी प्रिाणीकरण सुजवधा का उपयोग करके, जिकायतकताकओं की पहचान सत्याजपत करने हेतु स्ट्वैजछिक आधार पर आधार प्रिाणीकरण का जनष्पािन करने के उद्देश्य से आधार (जवत्तीय तथा अन्य सजससडी, लाभ 5929DG/2023 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] एवं सेवाओं का लजक्षत जवतरण) अजधजनयि, 2016 ("अजधजनयि") धारा 4 की उप-धारा (4) के खंड (ख) के उप-खंड (ii) के साथ परित सुिासन (सिाि कल्याण, नवाचार, िानकारी) जनयिावली, 2020 हेतु आधार प्रिाणीकरण के जनयि 5 के अंतगकत अजधसूजचत करने के जलए सतककता जनिेिालय, राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को केंद्र सरकार द्वारा प्राजधकार सम्प्रेजित दकया गया है। अब इसजलए, राष्ट्रीय रािधानी क्षेत्र, दिल्ली के उप-राज्यपाल एति् द्वारा अजधसूजचत करते हैं दक जवजिलेंस कम्पलेंर् इंफोिेिन िैनेििेंर् जसस्ट्र्ि (VCIMS) पोर्कल हेतु, राष्ट्रीय सूचना जवज्ञान केंद्र सुिासन (सिाि कल्याण, नवाचार, िानकारी) जनयिावली, 2020 हेतु जनम्नजलजखत ितों के अधीन आधार प्रिाणीकरण के जनयि 5 के अनुसार पहचान के उद्देश्य से स्ट्वैजछिक आधार पर आधार प्रिाणीकरण की िांग कर सकता है: (i) तत्काल अनुिोिन “हां/नहीं प्रिाणीकरण या / और ई-केवाईसी प्रिाणीकरण” िोनों ही सुजवधाओं के जलए है। उपरोक्त उद्देश्य हेतु आधार सेवा प्रभाग, एन.आई.सी. ए.यू.ए./ के.यू.ए. होगा तथा डी.ओ.वी. सब-ए.यू.ए. / सब-के.यू.ए. होगा। (ii) उक्त अजधजनयि की धारा 29 के जनबंधन िें प्रिाणीकरण के प्रयोिनाथक जिकायतकताक की सहिजत प्राप्त की िाएगी। जिस उद्देश्य से आधार संख्या और संबंजधत िानकारी िांगी िा रही है वह जिकायतकताक को स्ट्पष्ट रूप से बताया िाना चाजहए। जविेि रूप से, आधार संख्या का जिस तरीके से एकजत्रकरण, संग्रण व उपयोग दकया िायेगा, उसकी िानकारी जिकायतकताक को स्ट्पष्ट रूप से िी िाएगी। (iii) अपवाि प्रबंधन से संबंजधत प्रावधानों को आधार अजधजनयि, 2016 तथा उससे संबंजधत जवजनयिनों के अनुसार सख्ती से लागू दकया िाएगा। (iv) जिकायतकताक को पहचान या सत्यापन के वैकजल्पक तंत्र के बारे िें सूजचत दकया िाएगा क्योंदक आधार प्रिाणीकरण के तत्काल उपयोग की अनुिजत पूणकतः स्ट्वैजछिक आधार पर है। (v) आधार आधाररत प्रिाणीकरण की जवफलता के कारण जिकायतकताक को दकसी भी सेवा या लाभ से वंजचत नहीं दकया िाएगा क्योंदक जिकायतकताक को प्रिाणीकरण के वैकजल्पक तरीके प्रिान दकए गये हैं। (vi) जसस्ट्र्ि िें कहीं भी आधार संख्या प्रिर्िकत नहीं की िाएगी और िहां भी आवश्यक हो, आधार संख्या के केवल अंजति चार अंक प्रिर्िकत दकए िा सकते हैं। (vii) जिकायतकताक की ई-केवाईसी िानकारी का संपूणक जववरण स्ट्रीन पर प्रिर्िकत नहीं दकया िाएगा, अजपतु केवल आवश्यक िनसांजख्यकीय जववरण िैसे प्रथि नाि, िन्ि जतजथ आदि को प्रिर्िकत दकया िा सकता है। (viii) यदि आधार संख्या को संग्रहीत करने की आवश्यकता है, तो उसे आधार डेर्ा वॉल्र् िें सुरजक्षत रूप से संग्रहीत दकए िाएंगे। (ix) सूचना एवं प्रौद्योजगकी जवभाग, राष्ट्रीय रािधानी क्षेत्र, दिल्ली सरकार, इस आवेिन को डी.ई.िी.एस. पैनलबद्ध लेखा परीक्षक द्वारा ऑजडर् करवाएगा तथा ररपोर्क डी.ओ.वी. और एन.आई.सी. को प्रस्ट्तुत करेगा। डी.ओ.वी. और एन.आई.सी. िांच के बाि ररपोर्क यूआईडीएआई को सौंपेंगे। डी.ओ.वी. और एन.आई.सी. / यूआईडीएआई द्वारा बाि िें दिए गए दकसी भी सुझाव का भी अनुपालन दकया िा सकता है। (x) डी.ओ.वी. आधार अजधजनयि के सिस्ट्त प्रासंजगक प्रावधानों, इससे संबंजधत जवजनयिनों तथा यूआईडीएआई द्वारा सिय-सिय पर िारी अन्य अनुिेिों का अनुपालन करेगा। राष्ट्रीय रािधानी क्षेत्र दिल्ली के उप-राज्यपाल के आिेि से तथा उनके नाि पर, सुधीर कुिार, सजचव-एवं-जनिेिक[PART IV DELHI GAZETTE : EXTRAORDINARY 3 DIRECTORATE OF VIGILANCE NOTIFICATION Delhi, the 18th September, 2023 F. No. 01/15/DOV/Admn/2022/Pt. File./10746.—Section 4(4) (b) (ii) of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (hereinafter referred to as “the said Act”), allows performing authentication on voluntary basis, for such purpose, as the Central Government in consultation with the Authority, and in the interest of State, may prescribe. Whereas for such purpose Government of India has framed the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 wherein the State Government can seek permission under the said rules to use Aadhaar on voluntary basis. Whereas Government of India vide Authorization Letter of e-File No. 13(4)/2020-EG-II(Vol-9) dated 22nd June 2023 has conveyed the authorization by the Central Government for the Government of NCT of Delhi, Directorate of Vigilance, to notify under rule 5 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 read with sub-clause (ii) of clause (b) of sub-section (4) of section 4 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (“Act”), performance of Aadhaar authentication, on a voluntary basis, for verifying the identity of the complainants, using Yes/No or/and e- KYC authentication facility, at the time of registration on the online portal for filing vigilance as well as anti- corruption trap complaints. Now, therefore, the Lt. Governor of National Capital Territory of Delhi hereby notifies that for Vigilance Complaint Information Management System (VCIMS) Portal, National Informatics Centre can seek Aadhaar Authentication on voluntary basis, for the purpose of identification as per rule 5 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020, subject to the following conditions: (i) The instant approval is for both ‘Yes/No authentication or/and e-KYC authentication’ facilities. Aadhaar Services Division, NIC shall be the AUA/KUA for the above purpose and DOV shall be the Sub-AUA/Sub-KUA. (ii) The informed consent of the complainant shall be obtained for the purpose of authentication in terms of Section 29 of the said Act. The purpose for which the Aadhaar number and related information is being sought must be communicated clearly to the complainant. Specifically, the manner in which the Aadhaar number will be collected, stored and used shall be clearly communicated to the complainant. (iii) Provisions related to exception handling shall be implemented strictly in accordance with Aadhaar Act, 2016 and its associated regulations. (iv) The complainant shall be informed of alternate mechanism of identification or verification as the instant usage of Aadhaar Authentication is permitted purely on voluntary basis. (v) There shall not be denial of any service or benefit to complainant on account of failure of Aadhaar based authentication as the complainant has also been provided alternate modes of authentication. (vi) There shall not be display of Aadhaar number anywhere in system and wherever required only last four digits of Aadhaar number may be displayed. (vii) Complete details of the e-KYC information of the complainant shall not be displayed on the screen instead only necessary demographic details such as first name, date of birth, etc, may be displayed. (viii) Aadhaar numbers, if need to be stored, shall be stored securely in Aadhaar Data Vault. (ix) Information Technology Department, GNCTD shall get this application audited by DeGS empanelled Auditor and submit the report to DOV and NIC. The DOV and NIC after examination shall submit the report to UIDAI. Any subsequent suggestions made by DOV and NIC/ UIDAI may also be complied with. (x) DOV shall comply with all the relevant provisions of the Aadhaar Act, its associated regulations and other instruction issued by UIDAI from time-to-time. By Order and in the Name of Lt.
