(सी.) संख्या 9173/2015 और सी. एम. अपल. संख्या 51495/2019, 21613/2021, 17886/2022, 20392/2022, 524 DG/2024 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 45299/2022 और 6186/2023 जिनका िीर्ाक जवनोि रािौठरया बनाम डी. डी. ए. व अन्य ह ै के संिभा म ें अपन े आिेि दिनांक 08 दिसम्बर 2023 द्वारा छूट िी ह।ै इसजलए अजधग्रहण के अधीन मापन कुल 2 बीघा 4.5 जबस्ट्वा (0.1876 हक्े टेयर) भूजम का जहस्ट्सा िजक्षण पजिम जिले के कापसहड़े ा उप मण्डल के भरथल गााँव म ें उपरोक्त पठरयोिना के जलए अजधसूजचत दकया िाता ह,ै अजधग्रहण की िाने वाली िमीन का जवस्ट्तृत जववरण जनम्नजलजखत ह:ै क्रम खसरा गावाँ भूजम का अजधग्रहण के जहतबद्ध र्व्जक्त का सीमाएाँ स.ं न.ं का प्रकार अतं गता नाम एव ंपता उत्तर िजक्षण पवु ा पजिम नाम क्षत्रे (हक्े टेयर म)ें 1 4//21 भरथल कृजर् 0.1876 जवनोि कुमार 4//20 12//1 4//22 5//25 रािोठरया पुत्र रािोठरया पता 189 एकता माग ा वेस्ट्टन ा एवन्यू सैजनक फामा नई दिल्ली पेड़ संरचना प्रकार संख्या प्रकार संख्या िून्य िून्य िून्य िून्य यह अजधसूचना सभी संबंजधत के जलए भूजम अिान, पुनवाासन और पुनर्व्ावस्ट्थापन म ें उजचत प्रजतकर और पारिर्िाता का अजधकार अजधजनयम, 2013 (2013 का 30) की धारा 11(1) के प्रावधानों के तहत उन सभी के जलए बनाई गई ह,ै जिनस ेयह संबंजधत हो सकता ह।ै अजधग्रजहत की िाने वाली भूजम स े संबंजधत नक्िा एवं अन्य जववरण का जनरीक्षण जहतधारी र्व्जक्तयों द्वारा , जिला कलेक्टर (िजक्षण-पजिम), रािस्ट्व जवभाग, राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार और उप-जनिेिक (एल.एम.), साऊथ वैस्ट्ट िोन, दिल्ली जवकास प्राजधकरण, जनयर पोस्ट्ट आाँदफस, डी. डी. ए. मार्काट, सेक्टर-6, द्वारका, नई दिल्ली - 110075 को दकसी भी काया दिवस को काया समय के िौरान िेखा िा सकता ह ै। सरकार न े उक्त अजधजनयम की धारा 12 म ें दिए गए और जनर्िष्टा अनुसार अजतठरक्त जिला मजिस्ट्रेट (िजक्षण- पजिम) और उनके कमाचाठरयों को भूजम म ें प्रवेि करन े और सवेक्षण करन,े दकसी भी भूजम का स्ट्तर मापने , उप-जमट्टी म ें खुिाई करन ेया बोर करन े और उनके उजचत जनष्पािन के जलए अन्य सभी काय ा करन े के जलए अजधकृत दकया ह।ै अजधजनयम की धारा 11 (4) के तहत , कोई भी र्व्जक्त कलक्े टर की पूवा अनुमजत के जबना इस अजधसूचना के प्रकािन की तारीख स े कोई लेन िने नहीं करेगा या इस भूजम का कोई लेनिने यानी जबक्री/खरीि नहीं करेगा या ऐसी भूजम पर कोई अजतक्रमण नहीं करेगा। कोई जहतबद्ध र्व्जक्त, जिसे अजधग्रहण पर कोई आक्षेप हो, अजधजनयम की धारा 15 के तहत इस अजधसूचना के प्रकािन की तारीख से 60 (साि) दिनों के भीतर कलेक्टर (िजक्षण-पजिम) के समक्ष िायर की िा सकती ह।ै उप-राज्यपाल राष्ट्रीय रािधानी क्षत्रे दिल्ली के आिेि एव ं उनके नाम पर, लक्ष्य ससंघल, आई.ए.एस. कलक्े टर (जिला िजक्षण-पजिम)[PART IV DELHI GAZETTE : EXTRAORDINARY 3 OFFICE OF THE DISTRICT MAGISTRATE (SOUTH WEST) PRELIMINARY NOTIFICATION Delhi, the 18th January, 2024 No. ADM/LAC/SW/2023-24/5938.—In the exercise of the power conferred by sub section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 read with Government of India, Ministry of Home Affairs Notification No. S. O. 2740(E) dated 12st October, 2014 read with S. O. 2014 (E) dated 21.07.2015, it appears to Lieutenant Governor of National Capital Territory of Delhi, being the appropriate Government that in total 2 Bigha 4.5 Biswa (0.1876 Hectare) land bearing Khasra No. 4//21min is required in the Bharthal Village of Sub Division of Kapashera in District South-West for public purpose namely for providing the access of road no. 226 in Bharthal Village. The compliance of Section 4 to 8 of Chapter II of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 are exempted by Hon’ble High Court of Delhi vide order dated 08/12/2023 in W.P. (C) 9173/2015 & CM APPL. 51495/2019, CM APPL. 21613/2021, CM APPL. 17886/2022, CM APPL. 20392/2022, CM APPL. 45299/2022, CM APPL. 6186/2023titled as Vinod Rajoria Vs. DDA & ors. Therefore it is notified that for the above said project in the Bharthal Village of Kapashera Sub-Division, South West District a piece of land measuring 0.1876 Hectare viz; 2 Bigha 4.5 Biswa of standard measurement, whose detail description is as follows, is under acquisition:- Sl. The Plan and other details of the land to be acquired can be inspected by the interested person in the office of the Collector District (South-West), Revenue Department. Government of NCT of Delhi and office of the Dy. Director, DDA Market, Sector – 6, Dwarka, N. Delhi- 75, South-west Delhi on any working day during the working hours. The Government is pleased to authorise Additional District Magistrate and his staff to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in section 12 of the said Act. Under section 11(4) of the Act, no person shall make any transaction or cause any transaction of land i.e., sale/purchase, etc., or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector. Objections to the acquisition, if any, may be filed by the person interested within 60 (sixty days) from the date of publication of this notification as provided under section 15 of the Act before Collector.
