## Policy Analysis Report: Constitution of Advisory Board under the National Security Act, 1980 (Amendment)
**1. Executive Summary:**
This report analyzes a notification from the Government of the National Capital Territory of Delhi regarding the constitution of an Advisory Board under the National Security Act (NSA), 1980. This notification supersedes a previous notification from 2007 and establishes a new Advisory Board consisting of three judges from the Delhi High Court. The core purpose of this amendment is to appoint a new Advisory Board for the effective implementation of the NSA, 1980 within the National Capital Territory of Delhi. Key findings indicate that the Lt. Governor of Delhi, acting on the recommendation of the Chief Justice of the Delhi High Court, is responsible for the board's constitution.
**2. Introduction:**
The purpose of this report is to provide a comprehensive analysis of the provided government notification pertaining to the constitution of an Advisory Board under the National Security Act, 1980, within the National Capital Territory of Delhi. This analysis is based solely on the information provided in the given policy text.
**3. Policy Overview:**
* **Amendment:** This notification represents an *amendment* to a previous notification, F.No. 21189HP IIPart2479, dated March 30, 2007. This previous notification dealt with the same subject matter of an Advisory Board under NSA 1980.
* **Core Objective(s):** The core objective of this amendment is to establish a functional Advisory Board, as required by Section 9 read with clause (e) of Section 2 of the National Security Act, 1980, to advise the Lt. Governor on matters related to national security.
**4. Background and Rationale:**
Since this document represents an *amendment* to a pre-existing notification, the most logical rationale is that the previously appointed Advisory Board either became defunct (perhaps due to the retirement or reassignment of its members) or was deemed in need of revision. The explicit superseding of the 2007 notification strongly suggests a need to update the composition of the Advisory Board to ensure continued functionality and legal compliance with the National Security Act, 1980.
**5. Key Provisions / Changes:**
This notification focuses specifically on the *changes* to the composition of the Advisory Board.
* **Specific Part of Original Policy Changed:** The notification supersedes the previous notification of March 30, 2007, implying the composition of the previously appointed board is being altered.
* **New Rule/Provision:** The new provision establishes a new Advisory Board comprising of:
* Honble Mr. Justice Yogesh Khanna, High Court of Delhi - Chairman
* Honble Mr. Justice Chandra Dhari Singh, High Court of Delhi - Member
* Honble Mr. Justice Rajnish Bhatnagar, High Court of Delhi - Member
* **Difference/Effect of Change:** The direct effect is the replacement of the previous Advisory Board members with the newly appointed judges listed above. This ensures that the Advisory Board is populated with current members of the Delhi High Court, enabling it to fulfill its statutory obligations under the NSA, 1980.
**6. Target Audience and Stakeholders:**
The primary stakeholders directly affected by these changes are:
* The Lt. Governor of the National Capital Territory of Delhi, who relies on the Advisory Board's recommendations.
* The Delhi High Court, specifically the Chief Justice, who recommends the board members.
* Individuals potentially detained under the National Security Act, 1980, as the Advisory Board reviews their cases.
* The Home Department of the Delhi Government, which is responsible for implementing the provisions of the NSA and facilitating the Advisory Board's functioning.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The key bodies involved in implementation are the Lt. Governor's office and the Home Department of the Delhi Government. The Delhi High Court, through the Chief Justice's recommendations, also plays a crucial role.
* **Timelines/Procedures:** The notification states that the constitution of the Advisory Board is effective "with immediate effect." This implies that the new board is expected to commence its duties immediately following the notification's publication.
* **Specifically related to the changes:** The Home Department is responsible for formally notifying the previous board members that their service has ended and ensuring the new board members are onboarded and prepared to commence their duties.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of these changes is to ensure the continuous and effective operation of the Advisory Board under the National Security Act, 1980. This aims to provide timely and informed recommendations to the Lt. Governor regarding detentions under the Act. The amendment's impact is expected to be smoother and more legally sound implementation of the NSA by ensuring that a current, legally constituted advisory board exists to perform it's statutory duty.
**9. Conclusion:**
The notification analyzed represents a crucial amendment ensuring the proper functioning of the Advisory Board under the National Security Act, 1980, in the National Capital Territory of Delhi. By superseding the 2007 notification and appointing a new board comprised of sitting Delhi High Court judges, the Lt. Governor aims to maintain legal compliance and enable the effective implementation of the NSA. This demonstrates the government's commitment to national security while adhering to legal and judicial processes.
