**1. Executive Summary:**
This report analyzes a notification issued by the Government of the National Capital Territory of Delhi on January 28, 2022, which amends the Delhi Preservation of Trees Rules, 1996. The key changes involve replacing the requirement for court fee stamps with self-certification on applications and replacing the need for attested copies of documents with self-attested copies. This amendment aims to simplify the application process.
**2. Introduction:**
This report provides an overview and analysis of the amendment to the Delhi Preservation of Trees Rules, 1996, as detailed in the provided notification. The analysis focuses on the specific changes introduced and their likely implications, based solely on the content of the given text.
**3. Policy Overview:**
* **Original Policy:** Delhi Preservation of Trees Rules, 1996 (amendment to).
* **Core Objective(s):** The original policy, the Delhi Preservation of Trees Rules, 1996, likely aims to regulate and ensure the preservation of trees within the National Capital Territory of Delhi, as inferred from the name of the policy itself. The amendment's objective, from the text, is to streamline application procedures.
**4. Background and Rationale:**
The amendment likely stems from a need to simplify and expedite the application process related to the Delhi Preservation of Trees Rules, 1996. The replacement of court fee stamps with self-certification and attested copies with self-attested copies suggests a move towards reducing bureaucratic hurdles and increasing efficiency. It could be a response to public feedback or a broader government initiative to promote self-attestation and reduce reliance on official certifications for routine administrative tasks.
**5. Key Provisions / Changes:**
This notification introduces specific amendments to the Delhi Preservation of Trees Rules, 1996. The critical changes are:
* **Rule 4, clause 3:** The requirement for "Court fee stamps of value Rs. 5.00 Rupees five only shall be affixed on every application" is being **replaced** with "Only selfcertification is required on every application, made under these rules." This change **eliminates the cost and effort associated with obtaining court fee stamps**, placing the onus on the applicant to certify the application themselves.
* **Form B and Form C Declarations:** The requirement for "Attested copies of" supporting documents is **replaced** with "Selfattested copies of" supporting documents. This change **removes the need to have copies officially attested**, again shifting responsibility to the applicant for the accuracy of the provided information.
**6. Target Audience and Stakeholders:**
The target audience and stakeholders directly affected by these changes include:
* Individuals or entities seeking permissions or approvals under the Delhi Preservation of Trees Rules, 1996. This includes anyone needing to interact with the Department of Forests and Wildlife regarding tree-related matters.
* The Department of Forests and Wildlife, as the agency responsible for implementing and enforcing the rules. The changes will impact their administrative procedures.
**7. Implementation Aspects (Inferred):**
* **Responsible agency:** The Department of Forests and Wildlife, Government of NCT of Delhi, is responsible for implementing these changes.
* **Timelines:** The notification states that the changes come into effect from the date of publication in the Official Gazette (January 28, 2022).
* The implementation involves revising application forms (Forms B and C) and internal processes to reflect the acceptance of self-certified applications and self-attested documents.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these changes are:
* **Reduced burden on applicants:** Eliminating the need for court fee stamps and attested copies reduces costs and simplifies the application process, encouraging compliance and potentially increasing the number of applications.
* **Increased efficiency:** Streamlining the application process can lead to faster processing times and reduced administrative overhead for the Department of Forests and Wildlife.
* **Increased accountability:** While simplifying the process, self-certification and self-attestation place a greater responsibility on the applicant to provide accurate information. This could lead to stricter enforcement and penalties for false declarations.
**9. Conclusion:**
The amendment to the Delhi Preservation of Trees Rules, 1996, represents a move towards simplified administrative procedures, specifically concerning application processes. By replacing court fee stamps with self-certification and attested copies with self-attested copies, the government aims to reduce the burden on applicants, increase efficiency, and promote greater accountability. This change signifies a commitment to streamlining regulatory processes and fostering a more user-friendly environment for stakeholders involved in tree preservation in Delhi.
