## Report on Amendment to Permanent Lok Adalat Rules, 2025
**1. Executive Summary:**
This report analyzes an amendment to the Permanent Lok Adalat Other Terms and Conditions of Appointment of Chairman and Other Persons Rules, 2003, as published in the Gazette of India on May 15, 2025. The amendment primarily focuses on revising the conveyance allowance for Chairpersons and other persons attending Permanent Lok Adalat sittings, based on the classification of cities, and mandates increased sitting frequency for Lok Adalats based on case pendency. These changes aim to improve the efficiency and accessibility of Permanent Lok Adalats.
**2. Introduction:**
The purpose of this report is to provide an informative overview and analysis of the amendment to the Permanent Lok Adalat Other Terms and Conditions of Appointment of Chairman and Other Persons Rules, 2003, based solely on the official government policy text provided. This report aims to clarify the key provisions of the amendment and its potential impact.
**3. Policy Overview:**
* This document is an amendment to the Permanent Lok Adalat Other Terms and Conditions of Appointment of Chairman and Other Persons Rules, 2003.
* The core objective of the amendment, as inferred from the text, is to improve the functioning and accessibility of Permanent Lok Adalats by adjusting financial incentives and mandating more frequent sittings.
**4. Background and Rationale:**
This amendment likely seeks to address potential issues within the original 2003 rules regarding:
* **Inadequate Conveyance Allowance:** The increase in conveyance allowance suggests that the previous rates were deemed insufficient, potentially hindering participation or creating a financial disincentive for Chairman and other persons.
* **Insufficient Sitting Frequency:** The new mandate for increased sitting frequency based on case pendency indicates a desire to expedite case resolution and reduce backlog within the Permanent Lok Adalat system.
**5. Key Provisions / Changes:**
This section focuses on the specific changes introduced by the amendment:
* **Change 1: Conveyance Allowance Revision:**
* **Original Policy Part Changed:** Rule 3, subrule 5 of the Permanent Lok Adalat Other Terms and Conditions of Appointment of Chairman and Other Persons Rules, 2003.
* **New Rule:** The amendment introduces a revised conveyance allowance structure based on city classification by population:
* Class X (50 lakhs and above): Rs. 1,000 per sitting
* Class Y (5 lakhs to 50 lakhs): Rs. 750 per sitting
* Class Z (Below 5 lakhs): Rs. 500 per sitting
* Subject to a monthly ceiling of Rs. 8,000.
* **Effect of Change:** This change increases the conveyance allowance and bases it on a tiered system related to the city's population size. This likely aims to provide more equitable compensation reflecting the cost of travel and time commitment in different urban areas.
* **Change 2: Sitting Frequency Mandate:**
* **Original Policy Part Changed:** Rule 7, subrule 3 of the Permanent Lok Adalat Other Terms and Conditions of Appointment of Chairman and Other Persons Rules, 2003.
* **New Rule:** The Permanent Lok Adalat sitting schedule is now dependent on the number of pending cases. An Adalat with up to 100 pending cases must sit at least once a week and list at least five matters. An Adalat with over 100 pending cases must sit at least twice a week and list at least five matters.
* **Effect of Change:** This change mandates more frequent sittings for Permanent Lok Adalats with higher caseloads, directly addressing the need for faster case resolution.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders affected by these amendments include:
* Chairman and other persons appointed to Permanent Lok Adalats (directly affected by conveyance allowance changes).
* Litigants and citizens who utilize the Permanent Lok Adalat system (indirectly affected by potentially faster case resolution due to increased sitting frequency).
* The Department of Justice, Ministry of Law and Justice (responsible for implementing and overseeing these changes).
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The Department of Justice, Ministry of Law and Justice, is responsible for the implementation of these amendments. The notification is issued under the authority of the Central Government, in consultation with the Chief Justice of India, suggesting a coordinated approach.
* **Timelines:** The amendment came into force on the date of its publication in the Official Gazette (May 15, 2025).
* **Specific procedures**: The sitting of the Permanent Lok Adalat, as and when necessary, shall be convened by the Chairman.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these changes are:
* **Increased participation:** The revised conveyance allowance is expected to incentivize greater participation from qualified individuals as Chairman and other persons, especially in larger cities.
* **Reduced Case Backlog:** The mandated increase in sitting frequency for Permanent Lok Adalats with high case pendency is expected to lead to faster case disposal and a reduction in backlog.
* **Improved Access to Justice:** By expediting case resolution and incentivizing participation, the amendment aims to improve access to justice for citizens who rely on the Permanent Lok Adalat system.
**9. Conclusion:**
The 2025 amendment to the Permanent Lok Adalat Other Terms and Conditions of Appointment of Chairman and Other Persons Rules, 2003, represents a targeted effort to improve the efficiency and accessibility of the Permanent Lok Adalat system. By adjusting conveyance allowances and mandating increased sitting frequency, the amendment seeks to incentivize participation, reduce case backlogs, and ultimately enhance the delivery of justice to citizens.
