परन्त ु यदि केन्द्रीय सरकार का यह समाधान हो िाता ह,ै ऐसा जििाह ऐसे व्यजि और जििाह के अन्य पिकार को लागू स्ट्िीय जिजध के अधीन अनज्ञु ेय ह ै और ऐसा करन े के जलए अन्य आधार ह ैं तो िह दकसी व्यजि को इस जनयम के प्रितना स े छूट िे सकेगी। 5. जिजर्ल करन े की िजक्त :- िहां केंद्रीय सरकार की यह राय ह ै दक ऐसा करना आिश् यक या समीचीन ह,ै िहा ं िह उसके जलए िो कारण ह ै उन्ह ें लेखबद्ध करके इन जनयमों के दकसी उपबंध को दकसी िगा या प्रिगा के व् यजियों की बाबत, आिेि द्वारा जिजर्ल कर सकेगी। 6. व्य ािृजत्त :- इन जनयमों की कोई बात, ऐस े आरिण, आय-ु सीमा म ें छूट और अन् य जनयायतों पर प्रभाि नहीं डालेगी, जिनका केंद्रीय सरकार द्वारा इस संबंध म ें समय-समय पर िारी दकए गए आिेिों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, अन्य जपछडे िगों, भूतपूि ा सैजनकों और अन्य जििषे प्रिग ा के व् यजक्त यों के जलए उपबंध करना अपेजित ह।ै अनसु चू ी पि का नाम पि की सखं य् ा िगीकरण िते न-मैट्ररक म ें चयन अर्िा सीधी भती दकए िान े िाल े व्य जिे ें के िते न-स्ट्तर अचयन पि जलए आय ुसीमा 1 2 3 4 5 6 उच् च श्रेणी 315* सामान्य केंद्रीय स्ट्तर-4 चयन पि आयु 18 और 27 िषा के बीच। जलजपक (2023) सेिा, समूह 'ग', (रुपए 25500- *कायाभार के 81100/-) अरािपजत्रत, (केंद्र सरकार द्वारा िारी दकए गए अनुिेिों आधार पर या आिेिों के अनुसार सरकारी सेिकों के अनुसजचिीय। पट्ररितान दकया िा जलए पांच िषा तक जिजर्ल की िा सकती सकता ह।ै ह।ै) ट्रटप् पण: आय-ुसीमा अिधाट्ररत करने के जलए जनणाायक तारीख भारत में अभ् यर्थर्ायों से आिेिन प्राप् त करने के जलए जनयत की गई अंजतम तारीख होगी। (न दक िह अंजतम तारीख िो असम, मेघालय, अरुणाचल प्रिेि, जमिोरम, मजणपुर, नागालैंड, जत्रपुरा, जसजक्क म, लद्दाख संघ राज्य ित्रे , जहमाचल प्रिेि के लाहोल और स्ट् पीजत जिल े एिं चम् बा-जिले के पांगी उप- खंड, अंडमान और जनकोबार द्वीप या लिद्वीप के अभ्यर्थर्ायों के जलए जिजहत की गई ह।ै)[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 सीध ेभती दकए िान ेिाल ेव्य जियों के सीध े भती दकए िान े िाल े व्य जियों के पट्ररिीिा की भती की पद्धजत: भती सीधी होगी या जलए अपजेित िजैिक और अन्य जलए जिजहत आय ु और िजैिक अहता ाएं अिजध, यदि कोई प्रोन्न जत द्वारा या प्रजतजनयुजि या आमेलन अहता ाएं प्रोन्न त व्य जियों की ििा में लाग ू होंगी द्वारा तर्ा जिजभन्न पद्धजतयों द्वारा भरी हो या नहीं। िाने िाली ट्ररजियों की प्रजतितता (7) (8) (9) (10) अजनिाया: दकसी मान्य ता प्राप् त लाग ूनहीं सीधी भती के (क) 50 प्रजतित सीधी भती द्वारा। जिश्ि जिद्यालय या संस्ट् र्ा से स्नातक जलए िो िषा। (ख) 40 प्रजतित प्रोन्न जत द्वारा जिसके न जडग्री या समतुल् य। हो सकने पर प्रजतजनयुजि द्वारा। (ग) 10 प्रजतित सीजमत जिभागीय प्रजतयोगी परीिा प्रिेि (एलडीसीई) द्वारा। प्रोन्न जत या प्रजतजनयजुक्त या आमले न द्वारा भती यदि जिभागीय प्रोन्न जत सजमजत ह ैतो उसकी संरचना भती करन े म ें दकन की ििा म ें िे श्रजेणया ाँ जिनसे प्रोन्न जत या पट्ररजस्ट्र्जतयों म ें सघं प्रजतजनयजुक्त या आमले न दकया िाएगा लोक सेिा आयोग स े परामि ादकया िाएगा (11) (12) (13) प्रोन्न जत: जिभागीय प्रोन्न जत सजमजत :- लाग ूनहीं िेतन मैट्ररक् स के स्ट् तर 2 में ऐसे अिर श्रेणी 1. जनिेिक या संयुक् त जनिेिक - अध् यि; जलजपक जिन्ह ोंने उस श्रेणी में आठ िषा की 2. उप जनिेिक - सिस्ट् य; तर्ा जनयजमत सेिा प्रिान की ह।ै 3. सहायक जनिेिक श्रेणी-I/ श्रेणी-II (प्रिासन) - सिस्ट् य ट्रटप् पण 1: िहााँ ऐसे कजनष् ठों के संबंध में, जिभागीय पजुष्ट सजमजत :- जिन्ह ोंने अपनी अहका या पात्रता सेिा पूरी कर 1. जनिेिक या संयुक् त जनिेिक - अध् यि; ली ह,ै पर प्रोन्न जत के जलए जिचार दकया िा 2. उप जनिेिक - सिस्ट् य; तर्ा रहा हो िहााँ उनस े ज् यष्े ठ व् यजियों के संबंध में 3. सहायक जनिेिक श्रेणी-I/ श्रेणी-II (प्रिासन) - सिस्ट् य भी जिचार दकया िाएगा परंतु यह तब िब दके उसके द्वारा की गई ऐसी अहका या पात्रता सेिा, अपेजित अहका या पात्रता सेिा के आध े स े अजधक से या िो िषा से, इनम ेंसे िो भी कम हो, कम न हो और उन्ह ोंने अपने ऐसे कजनष् ठों सजहत, जिन्ह ोंने ऐसी अहका या पात्रता सेिा पहले ही पूरी कर ली ह,ै अगली उच् चतर श्रेणी में प्रोन्न जत के जलए अपनी पट्ररिीिा की अिजध सफलतापूिाक पूरी कर ली हो। प्रजतजनयजुि: केंद्र सरकार या राज् य सरकार या केंद्र िाजसत प्रिेिों के अधीन ऐसे अजधकारी: (क) (1) िो मूल संिगा या जिभाग में जनयजमत आधार पर अनुरूप पि धारण दकए हुए ह,ैं या (2) जिन्ह ोंने िेतन मैट्ररक् स के स्ट् तर 2 में या समतुल् य पिों में जनयजमत आधार पर जनयुजि के पश्च ात उस श्रेणी में आठ िषा जनयजमत सेिा प्रिान की हो। ट्रटप् पण 1: पोषक िग ा के ऐसे जिभागीय अजधकारी, िो प्रोन्न जत की सीधी पंजि में ह,ैं प्रजतजनयुजि पर जनयुजि के जलए जिचार दकए िाने के पात्र नहीं होंगे। इसी प्रकार, प्रजतजनयुक्त व् यजि प्रोन्न जत द्वारा जनयुजि के जलए जिचार दकए िाने के पात्र नहीं होंगे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ट्रटप् पण 2: केंद्र सरकार के उसी या दकसी अन्य संगठन या जिभाग में इस जनयुजि से ठीक पहल े धाट्ररत दकसी अन्य पूिा-संिगा पि पर प्रजतजनयुजि की अिजध आमतौर पर तीन िषा से अजधक नहीं होगी। प्रजतजनयुजि पर जनयुजि के जलए अजधकतम आय ु सीमा आिेिन प्राप् त करने की अंजतम जतजर् को 56 िषा से अजधक नहीं होगी। सीजमत जिभागीय प्रजतयोगी परीिा प्रििे (एलडीसीई): िेतन मैट्ररक् स के स्ट् तर 2 में सूक्ष् म, लघु और मध् यम उद्यम जिकास संगठन के ऐस े अिर श्रेणी जलजपक जिन्ह ोंने उस श्रेणी में पााँच िषा की जनयजमत सेिा प्रिान की ह।ै [फा. स.ं ए-12035/2/2023-ए(पीएंडटी)] पंकि कुमार झा, उप जनिेिक (प्रिासन) MINISTRY OF MICRO, SMALL AND MEDIUM ENTERPRISES (Office of the Development Commissioner) (MICRO, SMALL AND MEDIUM ENTERPRISES) NOTIFICATION New Delhi, the 18th April, 2023 G.S.R. 306(E).—In exercise of the powers conferred by proviso to article 309 of the constitution, and in supersession of the Ministry of Micro, Small and Medium Enterprises, the Micro, Small and Medium Enterprises Development Organisation, Upper Division Clerk, Group ‘C’ posts, Recruitment Rules, 2012, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Upper Division Clerk in the Micro, Small and Medium Enterprises Development Organization, Ministry of Micro, Small and Medium Enterprises, namely:- 1. Short title and commencement.- (i) These rules may be called the Ministry of Micro, Small and Medium Enterprises, the Micro, Small and Medium Enterprises Development Organization, Upper Division Clerk, General Central Service, Group ‘C’, Non-Gazetted, Ministerial Post, Recruitment Rules, 2023. (ii) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification, level in the pay matrix.- The number of post, its classification, level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age-limit, qualifications, etc.– The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the aforesaid Schedule. 4. Disqualification.– No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person; shall be eligible for appointment to the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to Relax.– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 6. Saving. – Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. Note 2: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years. Note 3: The maximum age limit for appointment by deputation shall be "Not exceeding 56 years" as on the closing date of receipt of applications.
