Ms. No.119, Municipal Administration and Water Supply (Election), 26th June 2025, ஆனி 12, விசுவாாவாசு, திருவாள்ளுவார் ஆண்டு-2056.] No.SRO A-17(d)/2025. In exercise of the powers conferred by section 198 of the Tamil Nadu Urban Local Bodies Act, 1998 (Tamil Nadu Act 9 of 1999), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Urban Local Bodies Rules, 2023. Amendments. In the said Rules,— (1) after CHAPTER III, the following Chapter shall be inserted, namely:— “CHAPTER III-A. NOMINATION OF PERSON WITH DISABILITY. 153-A. Manner of nomination of person with disability as member of the council.— (1) The person with disability to be nominated under clause (i-a) of sub-section (1) of section 37 as a member of the council shall,— (a) be the resident of the municipality concerned; (b) be a person with disability; (c) possess a valid disability certificate obtained from the certifying authorities designated under rule 10 of the Tamil Nadu Rights of Persons with Disabilities Rules, 2018. (2) The qualification and disqualification for being elected as councillor provided under section 12 of the Act shall also be applicable to the person with disability to be nominated as a member to the council. Ex-III-1(a)—(333) [1]2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY (3) The Commissioner shall call for application in Form-1 along with an affidavit from among the persons with disability in the municipality concerned for nomination as member in the council by publishing in two local daily newspapers atleast one in vernacular language having wide circulation in the municipality by giving at least fifteen days time for making application and shall forward the same to the District Level Committee. (4) (a) There shall be a District Level Committee consisting of the following members, namely:— (i) in respect of town panchayats, municipal councils and municipal corporations other than Greater Chennai City municipal corporation,— (A) the District Collector, who shall be the Chairman; (B) the Commissioner of urban local body concerned; (C) the District Differently Abled Welfare Officer (DDAWO); (D) One member from among the three representatives of the registered organisation in the District Level Committee on Disability nominated under clause (iii) of sub-rule (1) of rule 17 of the Tamil Nadu Rights of Persons with Disabilities Rules, 2018 to be nominated by the District Collector; and (E) Assistant Director (Panchayat) to the District Collector, who shall be the Convenor. (ii) in respect of Greater Chennai City municipal corporation,— (A) the Commissioner, who shall be the Chairman; (B) the District Collector; (C) the Secretary to Council; (D) One member from among the three representatives of the registered organisation in the District Level Committee on Disability nominated under clause (iii) of sub-rule (1) of rule 17 of the Tamil Nadu Rights of Persons with Disabilities Rules, 2018 to be nominated by the District Collector; and (E) the District Differently Abled Welfare Officer (DDAWO), who shall be the Convenor. (b) The District Level Committee shall scrutinise the applications forwarded, finalise the eligible candidate based on the facts furnished in Part C of Form 1, qualifications and service rendered to the society and then send the recommended candidates list to the Director in respect of town panchayats and municipal councils, and in respect of municipal corporations other than Greater Chennai City municipal corporation to the Government through Director concerned: Provided that in respect of the Greater Chennai City Municipal Corporation, the Committee shall send the list of recommended candidates to the Government. (5) The Government or the Director as the case may be shall, on receipt of communication relating eligible candidates from the District Level Committee, verify the same and nominate the eligible candidate as member of the council in Form 2. (6) The nominated member shall have the duties and powers as provided under section 43 of the Act.
