ना नई दिल् ली, 12 अगस्ट् त, 2026 का.आ. 4627(अ).—सांजयिकी और काियक्रम कािायन्विन मत्रं ालि, सांजयिकी संग्रहण जनिमावली, 2024 के जनिम 5 और 7 के साथ पठित सांजयिकी संग्रहण अजधजनिम, 2008 (2009 का 7) तथा 2017(2017 का 21) एवं िन जवश्वास (प्रावधानों का संिोधन) अजधजनिम, 2023 संयिा 18, 2023 में िथा संिोजधत की धारा 3 और 4 द्वारा प्रित्त िजििों का उपिोग करते हुए, एति द्वारा एक सांजयिकीि सवेक्षण, जिसे इसके आगे ‘वार्षयक औद्योजगक सवेक्षण 2025- 26’ के रूप म ें संिर्भयत दकिा िाएगा, के माध्िम स े अनुसचू ी-I म ें उजल्लजखत ब्िोरे के अनुसार जवजनमायण तथा इसस े संबंजधत काियकलापों के बारे म ेंआंकड़ े एकत्र करन े का जनििे िते ा ह।ै 2. इसके अलावा, मंत्रालि उपिुयक् त जनिेिों के संिभय म ें अनुसूची-II म ें उजल्लजखत व्यजििों और साथ ही कािायलि म ें उनके नाजमजतिों को सांजयिकी अजधकारी, अनुसूची-III में न्िािजनणायिक अजधकारी और अनुसूची-IV में अपीलीि प्राजधकारी, उसम ें िी गई भौगोजलक इकाइिों के संबंध म ें जनिक्ु त करता ह ै । प्रत् िके सांजयिकी अजधकारी, न्िािजनणायिक अजधकारी और अपीलीि प्राजधकारी, जनधायठरत प्रारूप, अथायत ् सांजयिकी संग्रहण जनिम, 2024 के साथ संलग्न प्रपत्र-I, म ें अपर महाजनिेिक, क्षेत्रीि संकािय प्रभाग, राष्ट्रीि सांजयिकी कािायलि, दिल्ली को तत्काल एक वचनबद्ध प्रस्ट्ततु करेंगे। 3. संबंजधत सांजयिकी अजधकारी द्वारा प्राजधकृत व्यजि, सांजयिकी संग्रहण जनिमावली, 2024 के साथ संलग्न फामय-I नामक जनधायठरत प्रपत्र म ें भरा गिा वचनबन् ध सांजयिकी अजधकारी को प्रस्ट् तुत करने के पश् चात प्रपत्र म ें सूचनािाता द्वारा िी गई सूचना के सत्िापन, तत्संबंधी ठरकॉडों की िांच, और िसै ा भी आवश्िक हो, स्ट्पष्टीकरण मागं न े के जलि,े सांजयिकी अजधकारी के भौगोजलक काियक्षेत्र म ें जनिुि दकि े िाएंग े । इन कतव्य िों के अनुसार, प्रत्िेक व्यजि फोटो पहचान पत्र अथवा 6453 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संबंजधत सांजयिकी अजधकारी द्वारा िारी प्राजधकार पत्र अपने साथ रखगे ा । सांजयिकी अजधकारी प्राजधकृत व् िजििों द्वारा प्रस्ट् तुत वचनबन्ध को सुरजक्षत अजभरक्षा म ें रखगे ा तथा उपरोि वचनबन् ध प्राप् त करने का प्रमाण पत्र अपर महाजनिेिक, क्षत्रे संकाि य प्रभाग, राष्‍टर ीि सांजयिकी कािायलि, दिल्ली को अग्रेजषत करेगा। 4. वार्षयक औद्योजगक सवेक्षण (एएसआई) अनुसूची के भाग I म ें एकत्र दकए गए आंकड़,े उजचत सत्िापन और िांच के बाि, अपर महाजनिेिक, उद्यम सवेक्षण प्रभाग, कोलकाता के कािायलि म ें काियरत अजधकाठरिों द्वारा संसाजधत दकिा िाएगा तथा वार्षयक औद्योजगक सवेक्षण (एएसआई) अनुसचू ी के भाग II म ें एकजत्रत आकं ड़ो को श्रम ब्िरू ो म ें काियरत अजधकाठरिों द्वारा संसाजधत दकिा िाएगा I सांजयिकी संग्रहण अजधजनिम 2008 तथा 2017(2017 का 21) एवं िन जवश्वास (प्रावधानों का संिोधन) अजधजनिम, 2023 संयिा 18, 2023 में िथा संिोजधत के प्रावधानों तथा सांजयिकी संग्रहण जनिमावली, 2024 के प्रावधानों के अनुसार, सांजयिकीि तकनीकों के माध् िम स े उत् पादित डाटा स े तैिार ईकाई स्ट् तरीि आंकड े एवं ठरपोटें मन्त्र ालि के उद्यम सवेक्षण प्रभाग तथा डेटा सूचना और नवाचार प्रभाग और श्रम तथा रोिगार मन्त्र ालि के अन् तगयत श्रम ब्िूरो की अजभरक्षा म ें रख े िाए ं तथा उनके द्वारा सरकार के नीजत जनिेिों के अनुसार सरकार तथा सरकार के बाहर के प्रिोगकताओंय , राज्ि ों/संघ राज्ि क्षेत्रों तथा आम िनता के प्रिोग हते ु प्रसाठरत दकिा िाए। 5. वार्षयक औद्योजगक सवेक्षण 2025-26 स े सम्बंजधत दकसी भी काियकलाप, िैसे आंकडा संग्रहण, आंकडा प्रसंस्ट् करण तथा प्रचार प्रसार म ें लगे सभी व्यजि सांजयिकी संग्रहण अजधजनिम, 2008 तथा 2017(2017 का 21) एवं िन जवश्वास (प्रावधानों का संिोधन) अजधजनिम, 2023 संयिा 18, 2023 में िथा संिोजधत और सांजयिकी संग्रहण जनिमावली, 2024 के प्रावधानों द्वारा अजधिाजसत होंगे । 6. साजं यिकी अजधकाठरिों को जनम्न जलजखत िजििा ं प्रिान की गई ह:ैं (क) सांजयिकी अजधकारी उपिुयक् त जनििे ों के अनुसार आंकडा संग्रहण के जलए, व्यवसाि सबं ंधी ठरकाड य तथा अन् ि ठरकाड य के आधार पर सूचनािाताओं द्वारा िी गई िानकारी का सत् िापन करन े तथा फैक्र ी के स्ट् वामी िा अजधभोक्त ा िा फैक्र ी के प्रभारी व्यजि अथवा प्रजतष्‍टि ान िा प्रबन् धन, िैसा भी मामला हो, िहां ऐसा ठरकाडय रखा गिा ह ै वहां पर स्ट् पष्‍टट ीकरण प्राप् त करनें के जलए कमयचाठरिों को प्रजतजनिक्ु त /प्राजधकृत करन े के जलए अजधकार प्रित् त ह।ैं सांजयिकी अजधकारी राज्ि सरकारों/संघ िाजसत क्षेत्रों के प्रिासजनक जनिन् त्रणाधीन ऐसे कमयचाठरिों को प्रजतजनिुक् त/प्राजधकृत करन े के जलए अजधकार प्रित् त ह ैं िो उनम ें स े दकसी फैक्र ी/प्रजतष्‍टि ान स े आंकडे एकत्र करना चाहता हो जिसके जलए सांजयिकी अजधकारी द्वारा उसके प्रिासजनक जनिन् त्रणाधीन दकसी कमयचारी को प्रजतजनिुक्त /प्राजधकृत न दकिा गिा हो। (ख) सांजयिकी अजधकारी प्रत् िके सूचनािाता को आंकडा सग्रं हण के उद्दश्े ि स े जनधायठरत फामय म ें एक माह िा िो भी अवजध उजचत समझ,े ठरटन य प्रस्ट्त ुत करने के जलए नोठटस िारी करन े के जलए अजधकार प्रित् त ह।ैं (ग) सांजयिकी अजधकारी दकसी भी सूचनािाता को वेब पोटयल/ अनुप्रिोग के माध् िम स े एक जनजित अवजध के जलए, िो उसके द्वारा सूचनािाता को िारी नोठटस म ें ििायिी गई हो, इलेक्र ाजनक रूप म ें ठरटनय प्रस्ट्त ुत करने की सुजवधा प्रिान करने के जलए अजधकार प्रित् त करता ह।ै 7. न्िािजनणािय क अजधकारी की िजििा-ाँ अजधजनिम की धारा 15 क के अधीन िााँच करने और िुमायना लगान े के जलए जनिुि न्िािजनणायिक अजधकारी के पास जनम्नजलजखत िजििााँ भी होंगी- (i) पक्षकारों से िपथ पत्र पर मौजखक िा जलजखत साक्ष्ि मांगना, जिसमें दकसी अन्ि व्यजि से भी साक्ष्ि मांगना सजम्मजलत ह,ै जिसे बुलािा गिा हो; (ii) सुसंगत िस्ट्तावेिों, अजभलखे ों िा उनकी प्रजतिों का अवलोकन िा जनरीक्षण करना; (iii) मामले के तथ्िों और पठरजस्ट्थजतिों से पठरजचत दकसी भी व्यजि को बलु ाना और उसकी उपजस्ट्थजत सुजनजित करना। जिला प्रिासन सजहत कोई भी उपिुि अजभकरण, अजधजनिम के अधीन जनििु न्िािजनणायिक अजधकारी के कतयव्यों का जनवयहन करते समि दकसी भी व्यजि की उपजस्ट्थजत सुजनजित करने के संबंध म ें संिभय प्राप्त होने पर ऐसी सहािता प्रिान करेगी। 8. न्िािजनणािय क अजधकारी के आिेि के जवरुद्ध अपील- (1) समुजचत सरकार, न्िािजनणायिक अजधकारी के पि से ऊपर के अपने दकसी भी अजधकारी को अजधजनिम के उपबंधों के अधीन अपीलीि प्राजधकारी जनिुि कर सकेगी ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (2) िो कोई इस अजधजनिम के अधीन न्िािजनणायिक अजधकारी द्वारा पाठरत आििे से असंतुष्ट है, वह आिेि प्राजप्त की जतजथ से तीस दिन के भीतर, प्ररूप-III म ेंअपीलीि प्राजधकारी को अपील कर सकेगा। (3) तीस दिन की अवजध समाप्त होने के बाि भी अपील स्ट्वीकार की िा सकेगी, िदि अपीलकताय अपीलीि प्राजधकारी को िह संतुजष्ट िे िे दक उसके पास उस अवजध के भीतर अपील न करन े का पिायप्त कारण था| िदि अपील न्िािजनणायिक अजधकारी के आिेि के जवरुद्ध की गई है, तो न्िािजनणायिक अजधकारी के आिेि का दक्रिान्विन अपील के जनपटारे तक स्ट्थजगत रखा िाएगा। (4) िब कभी ऐसी अपील प्राप्त होती ह,ै तो अपीलीि प्राजधकारी व्यजिगत रूप से िा वचुयअल रूप स े िा दकसी अन्ि स्ट्वीकािय माध्िम स,े िैसा दक अपीलीि प्राजधकारी द्वारा ति दकिा िाए, सुनवाई करेगा। (5) अपीलीि प्राजधकारी मामले के तथ्िों और पठरजस्ट्थजतिों से पठरजचत व्यजि (व्यजििों) सजहत पक्षकारों को सुनवाई की जनधायठरत तारीख स े कम से कम पंद्रह दिन पूव य नाम, जतजथ, स्ट्थान और सुनवाई के माध्िम के साथ-साथ अपील की प्राजप्त के सुसंगत िस्ट्तावेिों सजहत सुनवाई की सूचना िारी करेगा। (6) सुनवाई की सूचना में पक्षकारों द्वारा जलजखत संचार प्रस्ट्तुत करने का भी प्रावधान दकिा िा सकता है, िदि वे ऐसा चाह ें तो, सुनवाई की तारीख से कम से कम 5 दिन पहले अपील पर जनणयि लेन े के जलए सुसंगत हो सकता ह ै | (7) सनु वाई की सूचना जनम्नजलजखत माध्िम से िी िाएगी, अथायत्:- (i) स्ट्पीड पोस्ट्ट िा रजिस्ट्री डाक द्वारा; (ii) इलेक्रॉजनक पता उपलब्ध होने की जस्ट्थजत में इलेक्रॉजनक मेल द्वारा; और सुपुिगय ी का सबूत केस की फाइल के ठरकॉडय म ें रखा िाएगा। (8) पक्षकार मामल े की सुनवाई के समि व्यजिगत रूप से िा अपने जवजधवत प्राजधकृत प्रजतजनजध के माध्िम से वीजडिो कॉन्रेंससंग सजहत अपीलीि प्राजधकारी द्वारा जनधायठरत सुनवाई के जनर्ियष्ट माध्िम से उपजस्ट्थत हो सकत े हैं, िदि वीजडिो कॉन्रेंससंग की सुजवधा उपलब्ध ह ै | (9) अपीलीि प्राजधकारी, िैसा वह उजचत समझे, अपील के पक्षकारों को सुनवाई का अवसर िेने के पिात् ऐसा आििे पाठरत कर सकेगा | अनसु चू ी-I साजं यिकी सग्रं हण का जवषि और प्रिोिन : 1. वार्षयक औद्योजगक सवेक्षण 2025-26 के माध् िम स े संगठित जवजनमायण क्षत्रे की वृजद्ध, संरचना और ढांच े जिसम ें जवजनमायण प्रदक्रिा स े संबंजधत काियकलाप, मरम् मत सेवाए,ं गसै और िलापूर्त य तथा कोल् ड स्ट्ट ोरेि स े संबंजधत काियकलाप िाजमल ह,ैं के बारे म ेंआंकड़ े एकत्र दकए िाते ह ैं। साजं यिकी सग्रं हण के जलए भौगोजलक क्षत्रे : 2. वार्षयक औद्योजगक सवक्षे ण 2025-26 पूरे भारत म ेंआिोजित दकिा िा रहा ह।ै आकं ड़ा सग्रं हण की पद्धजत : 3. प्रत् िके सांजय िकी अजधकारी उसके काियक्षेत्र म ें आने वाले सूचनािाताओं को एक नोठटस िारी करेगा, जिसम ें सूचना िेने की तारीख, जिसे सूचना िी िानी ह ैउस अजधकारी अथवा कािायलि का नाम, जिस इकाई अथवा जिन इकाइिों के बारे म ें सूचना िी िानी ह,ै उसका ब् िौरा और प्रपत्र तथा जवजध जिसके अनुसार सूचना प्रिान की िानी अपेजक्षत ह,ै जिसम ें इस उद्देश् ि के जलए जनरुजपत तथा सूचनािाताओं के जलए नोठटस म े ििायिी गई जनजित जतजथ तक उपलब् ध करवाए िान े वाल े वेब पोटयल/ अनप्रु िोग के माध् िम स े इलेक्र ाजनक रुप म ेंसूचना प्रस्ट् तुत करना भी िाजमल ह ैका उल् लेख होगा। सचू नािाताओं का स्ट्वरूप जिनस ेआकं ड़े एकत्र दकए िान ेह:ैं 4. सूचनािाता कारखाना अजधजनिम, 1948 के अन्त गयत पंिीकृत कारखानों अथवा बीड़ी एव ं जसगार कामगार (रोिगार की पठरजस्ट् थजतिां) अजधजनिम, 1966 के तहत पंिीकृत प्रजतष्‍टि ानो िा जनम् नजलजखत म ें स े दकसी भी अजधजनिम/बोड/य प्राजधकरण िसै े कंपनी अजधजनिम, 2013, िकू ान तथा व् िवसाजिक प्रजतष्‍टि ान अजधजनिम, सोसािटी पंिीकरण अजधजनिम, सहकारी सजमजत अजधजनिम, खािी एव ं ग्रामोद्योग बोड,य उद्योग जनििे ालि (जिला उद्योग केन् द्र) के4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अन् तगयत पंिीकृत ह ैं के माजलक अथवा अजधभोगी िा प्रभारी ह,ैं जिन्ह े सांजय िकी अजधकारी द्वारा उपिुयक् त जनििे ों के अनुसार, इकाइिों के बारे में सचू ना उपलब् ध करवाने के जलए नोठटस िारी दकिा िाएगा । 5. सांजय िकी अजधकारी उन िो िा िो से अजधक इकाइिों िा प्रजतष्‍टि ानों, िो एक ही प्रबन्ध न के अधीन राज्ि िा संघीि क्षत्रे म ें चल रही हो जिनके बारे म ें प्रत् िके इकाई के अनुसार अलग-अलग सूचना उपलब्ध नहीं ह ै तो संबंजधत प्रबन् धन के माजलक अथवा अजधभोगी िा प्रभारी व् िजि को नोठटस िारी कर समेदकत सूचना प्रस्ट् तुत करने के जलए कह सकता ह ै | साजं यिकी सग्रं हण का कािय सम्पन्न करन ेकी अवजध 6. प्रत् िके सूचनािाता द्वारा सूचना प्रस्ट् ततु करने की तारीख नोठटस म ें उजल्ल जखत की िाएगी और िह आमतौर पर अगस्ट्त, 2026 स ेिुलाई, 2027 के बीच होगी । सिं भ यअवजध 7. प्रस्ट्त ुत की िान े वाली सूचना, 01 अप्रैल, 2025 स े िुरू होने वाल े और 31 माच,य 2026 को समाप् त होन े वाल े जवत् तीि वषय अथवा इकाई के लेखा वषय, िो 01 अप्रलै , 2025 और 31 माच,य 2026 के बीच दकसी भी तारीख को समाप् त होता ह,ै के बारे म ेंहोगी । एकत्र की िाने वाली सचू ना की प्रकृजत 8. अपेजक्षत सूचना पठरसम् पजत् तिों और िेिताओं, प्राजप् तिां, व् िि, जनवेि की मिें (स्ट्विेिी अथवा आिाजतत), उत् पाि और उप-उत् पाि, जवतरण संबंधी व् िि, रोिगार तथा श्रम लागत, काि य दिवस, काि य दकए गए श्रम दिवस, अनुपजस्ट्थजत, श्रम टनयओवर, काि य दकए गए श्रम घटं े, आि तथा सामाजिक सुरक्षा स े संबंजधत ह।ै भाषा जिसम ेंसचू नािाता द्वारा सचू ना िी िानी ह ै 9. सूचनािाता जनधायठरत प्रपत्र म ें सहिं ी अथवा अग्रं ेिी म ेंसूचना उपलब् ध कराएगा । सचू नािाता का िाजित्व 10. कारखाना िा प्रजतष्‍टि ान अथवा प्रबन्ध न, िैसा भी मामला हो, का माजलक िा अजधभोगी संबंजधत सांजयिकी अजधकारी स े प्राप् त नोठटस म ें दिए गए तरीके स े और तारीख तक सूचना उपलब् ध कराएगा । वह सांजयिकी अजधकारी अथवा उसके द्वारा प्राजधकृत व्ि जक्त द्वारा मांगे िाने पर अपजे क्षत सूचना के संबंध में जनरीक्षण के जलए तत्स ंबंधी ठरकाड य उपलब् ध कराएगा और पूछ े गए प्रश् नों के उत् तर भी िेगा । जनरीक्षण दकए िान े वाल ेकारोबारी ठरकॉडय और अन्ि ठरकॉडों की प्रकृजत 11. सांजयिकी अजधकारी अथवा उसके द्वारा प्राजधकृत व् िजक्त इकाई द्वारा उपलब्ध कराई गई सूचना के समथयन म ें उस इकाई के कारोबारी ठरकाड य िसै े दक बलै ेंस िीट, लाभ और हाजन खाता, मस्ट्ट ररोल, उपजस्ट्थ जत रजिस्ट् टर, वेतन नामावली, जनिेिक की ठरपोटय अथवा कोई अन् ि िस्ट् तावेि की िांच कर सकता ह ै। जनरीक्षण का तरीका 12. संबंजधत सांजयिकी अजधकारी अथवा उसके द्वारा प्राजधकृत व्यजि उपिुयक् त वर्णतय जनिेिों के अनूसार इकाई के कारोबार ठरकाडय और अन् ि िस्ट् तावेिों के आधार पर इकाई द्वारा उपलब् ध कराई गई सूचना की पुजष्‍टट कर सकता ह ै और संबंजधत माजलक अथवा िखलकार िा प्रभारी व् िजि अथवा इकाई के प्रबंधन द्वारा प्राजधकृत व्यजि स े ईकाई प्रांगण म ें स्ट् पष्‍टट ीकरण मागं The Ministry further appoints the persons as also their assignees in office, mentioned in the Schedule-II as Statistics Officers, Adjudicating Officer in Schedule-III and Appellate Authority in Schedule-IV in respect of the geographical units mentioned thereof with reference to the aforesaid direction. Each Statistics Officer, Adjudicating Officer and Appellate Authority shall immediately submit an undertaking in the prescribed format, namely, Form-I appended to the Collection of Statistics Rules, 2024, to the Additional Director General, Field Operations Division, National Statistics Office, Delhi. 3. The persons authorized by each Statistics Officer, after submission of undertaking in the prescribed format, namely, Form-I appended to the Collection of Statistics Rules, 2024 to the Statistics Officer, would be engaged in the geographical jurisdiction of the Statistics Officer for verification of information furnished by informants, for inspecting relevant records, and for seeking clarifications, as may be necessary, from informants. In accordance with these duties, each person authorized would carry a photo identity card and a letter of authorization issued by the concerned Statistics Officer. The statistics collected in Part-I of Annual Survey of Industries (ASI) schedule after due verification and scrutiny, will be processed by officials working at the Office of the Additional Director General, Enterprise Survey Division, National Statistics Office, Kolkata and the statistics collected in Part-II of the ASI schedule thereof will be processed by officials working at the Labour Bureau. Subject to the provisions of the Collection of Statistics Act, 2008 as amended in 2017 (21 of 2017) and through the Jan Vishwas (Amendment of Provisions) Act, 2023 No. 18 of 2023 in 2023 and the Collection of Statistics Rules, 2024, the unit level data and the reports, generated from the data through statistical techniques, may be kept in custody and disseminated by the Enterprise Survey Division and the Data Informatics and Innovation Division of this Ministry and the Labour Bureau under the Ministry of Labour and Employment to the users within and outside the Government, the States/UTs and the public at large as per policy guidelines of the Government. 5. All persons engaged in any activity in respect of collection of statistics, processing of data and dissemination with respect to ASI 2025-26 are governed by the provisions under the Collection of Statistics Act, 2008 as amended in 2017 (21 of 2017) and through the Jan Vishwas (Amendment of Provisions) Act, 2023 No. 18 of 2023 in 2023 and the Collection of Statistics Rules, 2024. 6. Following powers have been delegated to the Statistics Officers: (a) A Statistics Officer is empowered to depute/authorize officials to collect statistics in respect of the aforementioned direction, to verify any information furnished by informants on the basis of business records and other records and to seek clarifications from any owner or occupier or person in-charge of a factory or establishment or management, as the case may be, at the premises where such records are kept. A Statistics Officer is also empowered to depute/authorize officials under the administrative control of any State Government or Union territory Administration, which is willing to collect statistics from any of those factories/establishment for which the Statistics Officer has not deputed/authorized any official under his administrative control. (b) A Statistics Officer is empowered to give one month notice or for the period deemed fit to each of the informant for furnishing return in the format, specified for the purpose of collection of statistics. (c) A Statistics Officer is empowered to provide to any informant, the facility of furnishing return in electronic form through a web-based application/portal for certain period, to be specified by him in the notice to be issued to the informant. 7. Powers of the adjudicating officer- An adjudicating officer appointed under section 15A of the Act to hold an inquiry and impose penalty, shall also have the powers to- (i) call for oral or written evidence on oath or on affidavit from parties including from any other person who has been summoned; (ii) peruse or inspect relevant documents, records or copies thereof; (iii) summon and enforce the attendance of any person acquainted with the facts and circumstances of the case. Any appropriate agency including the District Administration shall render such assistance on receiving a reference regarding enforcing the attendance of any person while discharging the duties of the adjudicating officer appointed under the Act. 8. Appeal against the order of adjudicating officer- (1) The appropriate Government may appoint any of its officers, above the rank of adjudicating officer, as an appellate authority under the provisions of the Act. (2) Whoever aggrieved by the order passed by the adjudicating officer under this Act, may prefer an appeal to the appellate authority, within thirty days from the date of receipt of order, in Form-III. (3) An appeal may be admitted even after the expiry of the period of thirty days if the appellant satisfies the appellate authority that he had sufficient cause for not preferring the appeal within that period. In case the appeal has been preferred against the order of the adjudicating officer, the operation of the order of the adjudicating officer shall be kept in abeyance, till the disposal of the appeal. (4) Whenever, such an appeal is received, the appellate authority shall hold a hearing, either in person or virtual or by any other admissible mode, as may be decided by the appellate authority. (5) The appellate authority shall issue a notice of hearing to the parties, including persons acquainted with the facts and circumstances of the case, by name, date, venue and mode of hearing, along with the relevant documents of the receipt on appeal, at least fifteen days before the scheduled date of hearing.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (6) The notice of hearing may also provide for submission of written communication, which may be relevant for deciding the appeal, by the parties, if they so desire at least five days before the date of hearing. (7) The notice of hearing shall be served in the following modes, namely:— (i) by speed post or registered post; (ii) by electronic mail in case electronic address is available; and proof of deliveries shall be kept on the record of the case file. (8) The parties may be present in person or through his duly authorised representative by the specified mode of hearing as decided by the appellate authority including video conferencing, if the facility of video conferencing is available, at the time of hearing of the case. (9) The appellate authority may, after giving the parties to the appeal an opportunity of being heard, pass such order as he may think fit. SCHEDULE-I Subject and purpose for collection of statistics: 1. Statistics relating to growth, composition and structure of organized manufacturing sector comprising activities related to manufacturing processes, repair services, gas and water supply and cold storage is collected through Annual Survey of Industries 2025-26. Geographical area for collection of statistics: 2. The Annual Survey of Industries 2025-26 is conducted in the whole of India. Method of data collection: 3. A Notice will be issued by each Statistics Officer to informants under his jurisdiction, indicating therein the date by which, the officer or office to whom, the unit or units for which, and the formats and the manner in which information is required to be furnished, including submission of information in electronic form through a web-based application/portal designed for the purpose and made available to informants up to a certain date, specified in the notice. Nature of informants for whom data may be collected: 4. The informants are owners or occupiers or persons in-charge, of factories registered under the Factories Act, 1948 or of establishments registered under the Beedi & Cigar Workers (Conditions of Employment) Act,1966 or the units registered under any of the following Acts/Boards/Authority viz., Companies Act, 2013, Shops and Commercial Establishments Act, Societies Registration Act, Cooperative Societies Act, Khadi and Village Industries Board, Directorate of Industries (District Industries Centre) who would be issued notice by Statistics Officer for furnishing information under the aforementioned direction. 5. A Statistics Officer may require furnishing of consolidated information in respect of two or more factories or establishments under a single management operating within a State or Union Territory, in case information is not separately available for individual factories or establishments, through a notice issued to the concerned owner or occupier or person in-charge of the management. Period during which collection of statistics may be completed: 6. The date for submission of information by each informant would be mentioned in the notice and would generally fall during August, 2026 to July, 2027. Reference period: 7. Information is required to be furnished for the financial year commencing from 1st April 2025 and ending on 31stMarch 2026 or for the Accounting Year of a unit ending on any date between 1st April 2025 and 31st March 2026. Nature of information to be collected: 8. The information required relates to assets and liabilities, receipts, expenses, input items (indigenous and imported), products and by-products, distributive expenses, employment and labour cost, working days, man-days worked, absenteeism, labour turnover, man-hours worked, earning and social security benefits. Language in which information is to be furnished by informant: 9.
