## Policy Analysis Report: Appointment of Special Public Prosecutor and Fee Structure in Delhi
**1. Executive Summary:**
This report analyzes a notification issued by the Government of the National Capital Territory of Delhi on May 5, 2025. The notification appoints Sh. Akhand Pratap Singh, Advocate, as a Special Public Prosecutor (SPP) for specific cases under the Indian Penal Code (IPC), Unlawful Activities Prevention Act (UAPA), Arms Act, and Prevention of Damage to Public Property (PDPP) Act, and NIA Act. The notification also establishes a fee structure for the SPP’s services, indicating a formalization of compensation for legal representation in these cases. This report provides an overview of the policy, its objectives, key provisions, target audience, and expected outcomes based solely on the provided notification text.
**2. Introduction:**
This report aims to provide a comprehensive analysis of a government notification concerning the appointment of a Special Public Prosecutor and the associated fee structure within the National Capital Territory of Delhi. The analysis is based solely on the text of the provided notification dated May 5, 2025.
**3. Policy Overview:**
This notification appears to be an amendment or continuation of existing policy related to the appointment and compensation of Special Public Prosecutors. Previous notifications are referenced (dated 24062020, 30.07.2020, 26.07.2021, and 07.08.2023) indicating a potentially ongoing process of appointing such prosecutors.
* **Core Objective(s):** Based on the text, the core objectives are:
* To appoint a qualified legal professional (Sh. Akhand Pratap Singh, Advocate) as a Special Public Prosecutor for specific cases.
* To define a structured fee schedule for the SPP's services in those cases.
**4. Background and Rationale:**
This notification appears to be part of an existing framework for prosecuting serious crimes, with references to Acts related to public safety and security. The specific appointment of an SPP and establishment of a fee structure suggest a need for specialized legal expertise and a transparent mechanism for compensating legal services in these complex cases. The repeated reference to earlier notifications suggests an ongoing effort to ensure adequate legal representation.
**5. Key Provisions / Changes:**
This notification acts as an *amendment*, specifically regarding the appointment and compensation of the Special Public Prosecutor.
* **Specific Part of Original Policy Changed:** This notification builds upon prior notifications regarding the appointment of Special Public Prosecutors, seemingly formalizing the appointment of Sh. Akhand Pratap Singh for particular cases as well as defining the fee structure.
* **New Rule/Provision:** The core new provisions are:
* Appointment of Sh. Akhand Pratap Singh, Advocate, as Special Public Prosecutor for FIR No. 2220 under various sections of IPC, UAPA, Arms Act, and PDPP Act at PS Crime Branch, and under the NIA Act.
* Establishment of a fee structure for Sh. Akhand Pratap Singh, including:
* Appearance per hearing: Rs. 40,000
* Conference fee per conference: Rs. 20,000
* Drafting petitions, criminal revisions, etc.: Rs. 1,00,000
* Drafting fee per application: Rs. 25,000
* Drafting fee per reply to application: Rs. 25,000
* Clerkage Charges: 10% of the full bill amount
* **Difference/Effect of Change:** This formalizes the appointment of the Special Public Prosecutor and provides a clear compensation scheme for his services. It introduces a financial commitment by the government for these cases, aiming to ensure adequate legal representation is available.
**6. Target Audience and Stakeholders:**
* **Directly Affected:**
* Sh. Akhand Pratap Singh, Advocate (as the appointed SPP).
* The Delhi Police (specifically the Crime Branch, NIA and those managing the budget).
* Individuals involved in the cases mentioned in the FIR numbers referenced in the notification.
* **Other Stakeholders:**
* The Government of the National Capital Territory of Delhi (GNCTD).
* The legal community in Delhi.
* Citizens concerned with the prosecution of crimes related to public safety and security.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:**
* Delhi Police (Crime Branch, NIA) is responsible for managing the cases and presumably facilitating payments to the SPP based on the established fee structure.
* Home Department of the GNCTD, responsible for issuing the notification and presumably overseeing the implementation.
* **Timelines or Procedures:** No specific timelines are mentioned in the provided text. However, the fee structure suggests a process for billing and payment related to court appearances and legal services rendered. The approval of the Lieutenant Governor indicates a formal approval process.
* **(Amendment Specific)** Implementation requires the Delhi Police to follow the outlined fee structure for payments to Mr. Singh.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these changes are:
* Ensuring qualified legal representation for the prosecution of specific cases related to public safety and security.
* Providing a transparent and defined compensation mechanism for the SPP's services.
* Potentially expediting the legal proceedings by ensuring the availability of an SPP familiar with the complexities of the cases.
* Maintaining accountability in prosecution costs
**9. Conclusion:**
The notification concerning the appointment of Sh. Akhand Pratap Singh as a Special Public Prosecutor and the establishment of a fee structure represents a formalization of legal representation in specific, potentially complex cases within the National Capital Territory of Delhi. The change provides a clear framework for compensation, likely aiming to ensure adequate legal expertise and efficient prosecution of these cases, which is of significant importance to stakeholders in the legal system and those concerned with public safety and security.
