## Report on Appointment of Special Public Prosecutors in Delhi
**1. Executive Summary:**
This report analyzes a notification issued by the Government of the National Capital Territory of Delhi (GNCTD) regarding the appointment of eleven Law Officers (Senior Advocates and Advocates) as Special Public Prosecutors. The core purpose of this policy is to appoint legal professionals to conduct cases on behalf of the State, including those related to protests against the three Farm laws in Delhi, as well as bail, trial, appeals, and other miscellaneous matters connected with all FIRs. The key finding is that this policy aims to strengthen the prosecution's legal representation in handling a specific category of cases, especially those concerning the Farm laws protests, within the Delhi jurisdiction.
**2. Introduction:**
This report provides an overview and analysis of a government notification pertaining to the appointment of Special Public Prosecutors in Delhi. The analysis is based solely on the text provided, and aims to inform stakeholders about the policy's objectives, key provisions, target audience, and expected outcomes.
**3. Policy Overview:**
This is a new policy establishing a specific provision for legal representation.
* **Core Objective(s):**
* To appoint specific Law Officers (Senior Advocates and Advocates) as Special Public Prosecutors.
* To ensure the State is represented by these appointed individuals in legal proceedings, including bail applications, trials, appeals, and miscellaneous matters related to FIRs.
* Specifically, to address legal matters connected to protests against the three Farm laws in Delhi.
**4. Background and Rationale:**
* Given the context, it is likely that the government aims to ensure effective legal representation in cases related to the Farm laws protests. The appointment of multiple Special Public Prosecutors suggests a significant caseload or perceived complexity in these cases. Appointing these legal officers is likely intended to provide specialized legal expertise, particularly for the protest-related matters and provide adequate support to deal with related legal issues.
**5. Key Provisions / Changes:**
* **Appointment of Special Public Prosecutors:** The notification formally appoints eleven individuals, including Senior Advocates and Advocates, as Special Public Prosecutors. The appointees are: Sh. Tushar Mehta, SG; Sh. S.V. Raju, ASG; Sh. Aman Lekhi, ASG; Sh. Sanjay Jain, ASG; Sh. Chetan Sharma, ASG; Sh. Amit Mahajan, Advocate; Sh. Rajat Nair, Advocate; Sh. Madhukar Pandey, Advocate; Sh. Sanjeev Sahay, Advocate; Sh. Manu Sharma, Advocate; and Sh. Pranav Diesh, Advocate.
* **Scope of Representation:** These prosecutors are tasked with conducting all cases on behalf of the State, including bail, trial, appeals, and other miscellaneous matters related to FIRs. The policy explicitly includes any matters related to protests against the three Farm laws in Delhi within the scope of their representation.
* **Fee and Terms:** The fees, terms and conditions for these positions will be settled at a later stage.
* **Approval:** The policy is issued with the approval of the Hon'ble Lieutenant Governor of the National Capital Territory of Delhi.
**6. Target Audience and Stakeholders:**
* **Directly Affected:** The appointed Special Public Prosecutors, defendants and accused in cases related to Farm law protests and other FIR-related matters in Delhi, the Delhi Police, and the courts involved in these cases.
* **Indirectly Affected:** The general public in Delhi, particularly those involved in or affected by the Farm law protests, and legal professionals.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Home (Police II) Department of the Government of the National Capital Territory of Delhi is responsible for issuing the notification. The Competent Authority mentioned in the notification is responsible for making the appointments. The Lieutenant Governor's office is involved through the approval process.
* **Procedures:** The notification follows the procedures outlined in subsection 8 of section 24 of the Code of Criminal Procedure, 1973, read with the Government of India, Ministry of Home Affairs Notification No. 11011274UTL i dated the 20th March, 1974.
* **Timelines:** No specific timelines are mentioned in the text, but the immediate effect of the notification implies an urgency in addressing the identified legal needs, especially regarding the Farm laws protests.
**8. Expected Outcomes / Impact of Changes:**
* The intended outcome is likely to improve the efficiency and effectiveness of the prosecution in handling cases related to the Farm laws protests and other FIR-related matters. This could lead to faster case resolution, improved conviction rates (depending on the strength of evidence), and a clearer legal stance on issues arising from the protests. The appointment of experienced lawyers might also ensure a more robust defense of the State's position in these legal proceedings.
**9. Conclusion:**
The notification regarding the appointment of Special Public Prosecutors represents a significant step towards addressing the legal challenges arising from the Farm laws protests and other FIR-related cases in Delhi. By appointing a team of experienced legal professionals, the GNCTD aims to strengthen its legal representation and ensure the effective administration of justice in these sensitive matters. The policy highlights the government's focus on addressing the legal ramifications of the protests and its commitment to upholding the law.
