## Report on Government of National Capital Territory of Delhi Notification Regarding Judicial Appointments
**1. Executive Summary:**
This report analyzes a notification issued by the Government of the National Capital Territory of Delhi on May 13, 2022, regarding appointments and promotions within the Delhi Higher Judicial Service (DHJS) and Delhi Judicial Service. The notification outlines the appointment of Mr. Gopal Singh Chauhan to a regular position in the DHJS and the promotion of Ms. Prabh Deep Kaur to the DHJS on an ad-hoc basis to a Fast Track Special Court position. The key finding is that the notification reflects ongoing efforts to staff judicial positions in Delhi, including specialized courts, while also clarifying the conditions and limitations associated with ad-hoc promotions.
**2. Introduction:**
This report aims to provide a comprehensive overview of a Government of National Capital Territory of Delhi notification pertaining to appointments and promotions within the Delhi Higher Judicial Service and Delhi Judicial Service. The analysis is based solely on the text provided in the notification, focusing on the key provisions, target audience, and inferred implementation aspects.
**3. Policy Overview:**
This notification does not amend an existing policy, but rather enacts appointments and promotions under the existing Delhi Higher Judicial Service Rules, 1970.
* **Core Objective(s):** The primary objectives, as inferred from the text, are:
* To fill vacant positions within the Delhi Higher Judicial Service.
* To staff Fast Track Special Courts by promoting officers on an ad-hoc basis.
* To formalize the appointments and promotions of specific individuals.
**4. Background and Rationale:**
This appears to be a new policy. The notification likely addresses the need to fill existing vacancies within the Delhi Higher Judicial Service and to ensure adequate staffing for specialized courts like Fast Track Special Courts. The ad-hoc promotion of Ms. Prabh Deep Kaur suggests a potential urgency in filling the Fast Track Special Court position, perhaps due to caseload demands or specific mandates for these courts. The need to fill a regular vacancy that arose on 01.05.2022 suggests an ongoing process of staffing and maintaining the Judicial Services.
**5. Key Provisions / Changes:**
Since this isn't an amendment, this section details the main components of the notification:
* **Appointment of Mr. Gopal Singh Chauhan:** Appointed on a regular basis against a regular vacancy in DHJS that arose on 01.05.2022, under Rule 7(1)(a) of the Delhi Higher Judicial Service Rules, 1970. He will be placed on probation for two years from the date he joins the regular post.
* **Promotion of Ms. Prabh Deep Kaur:** Promoted on an ad-hoc basis to Delhi Higher Judicial Service against one post of Fast Track Special Courts after the prior office holder vacated the post. This is subject to her furnishing a requisite undertaking to the High Court of Delhi.
* **Conditions of Ad-hoc Promotion:** The promotion of Ms. Prabh Deep Kaur is explicitly stated to *not* confer any right of absorption or seniority in the Delhi Higher Judicial Service cadre. Furthermore, the notification specifies that if the Fast Track Special Court is discontinued, Ms. Kaur will revert back to her substantive cadre of Delhi Judicial Service.
**6. Target Audience and Stakeholders:**
The primary stakeholders directly affected by this notification are:
* **Mr. Gopal Singh Chauhan:** As he is being appointed to a regular position in the DHJS.
* **Ms. Prabh Deep Kaur:** As she is being promoted to the DHJS on an ad-hoc basis.
* **The Delhi High Court:** In consultation with whom the appointments/promotions were made, and to whom Ms. Kaur must furnish an undertaking.
* **The Delhi Higher Judicial Service:** As these appointments affect the composition and staffing of the service.
* **Litigants and the Public:** Who are served by the judicial system and the Fast Track Special Courts.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Lieutenant Governor of the National Capital Territory of Delhi, acting in consultation with the High Court of Delhi, is responsible for the appointments and promotions. The Department of Law, Justice and Legislative Affairs is likely responsible for implementing the notification.
* **Timelines/Procedures:** The notification specifies the date (01.05.2022) the regular vacancy arose and the date from which the probation period for Mr. Chauhan commences (the date he joins the regular post). Ms. Kaur's promotion is effective from the date she assumes charge and furnishes the required undertaking to the High Court.
* **Ad-Hoc Promotion Specifics:** It appears from the text that the undertaken is required by the High Court of Delhi for the promotion to be realized.
**8. Expected Outcomes / Impact of Changes:**
* The appointment of Mr. Chauhan is expected to contribute to filling a regular vacancy and strengthening the DHJS's capacity.
* The ad-hoc promotion of Ms. Kaur to a Fast Track Special Court is intended to ensure that these courts are adequately staffed and able to address their caseload efficiently. The explicit conditions attached to her promotion (no absorption or seniority rights, reversion upon discontinuation of the court) suggest a cautious approach, likely aimed at maintaining flexibility within the judicial system.
**9. Conclusion:**
The Government of National Capital Territory of Delhi notification, dated May 13, 2022, signifies an effort to address staffing needs within the Delhi Higher Judicial Service and Fast Track Special Courts. The appointment of Mr. Gopal Singh Chauhan and the ad-hoc promotion of Ms. Prabh Deep Kaur are key components of this effort. The conditions attached to Ms. Kaur's promotion highlight the temporary nature of the assignment and the importance of maintaining flexibility within the judicial system. This notification is significant because it reflects the ongoing efforts to manage judicial resources and ensure the efficient operation of the court system in Delhi.
