No. 3 (212)/2019-TC/228-238.—Whereas, Government of India has allotted 33.5 acres (1552 feet x 940.245 feet) land to the Board of Trustees of Ayurvedic and UnaniTibbi College, Delhi, forever, for the operation of Ayurvedic and UnaniTibbi College (now known as Ayurvedic and UnaniTibbia College & Hospital, Karol Bagh, New Delhi), through a Registered Permanent Lease Deed dated 15.07.1925, after the payment of full Premium Money. The said land is bounded in North by New Rohtak Road, in South by other land belonging to Government ofIndia, in East by West Park Road (presently known as Ajmal Khan Road) and in West by Darhaliya Road (presently known as MaharanaPratap Road). AND Whereas, Ayurvedic and UnaniTibbia College & Hospital is being run on the said land since allotment. The College has been taken over by the Government of NCT of Delhi vide the Delhi Tibbia College (Takeover) Act, 1997 (Delhi Act No. 6 of 1998) which came into force with effect from 01.05.1998. Whereas, as per the provisions defined by Section 14 of the said Act, the Government of NCT of Delhi has notified the Delhi Tibbia College (Takeover) Rules, 2006. Under provision of rule 3(h) of the said rules, the Director has to ensure that properties (moveable and immovable) of the College or relatable to the College are taken in the control of the Government. Whereas, in pursuance to the above, a General Notice No. F.3 (212)/2019-TC/243-246 in three languages (English, Hindi, and Urdu) was published in newspapers on 14.12.2023 under the provisions of rule 7(1) and 7(2) of the Delhi Tibbia College (Takeover) Rules, 2006 by way of which an opportunity of being heard was given to all the occupier(s) of the property/properties of the College or relatable to the College, and informing them to submit their representations, if any, within 60 (sixty) days of the publication of the Notice. Whereas, in response to this General Notice, representations from the occupiers of the property/properties were received and many of them requested to provide them an opportunity of Personal hearing. Whereas, a General Notice no. F. 3 (212)/2019 – TC/407-409 dated 08.07.2024 in three languages (English, Hindi & Urdu) was published in local newspapers on 10.07.2024 and a copy of this Notice was sent by speed post to all such claimants as per Annexure attached seeking personal hearing; giving them an opportunity of personal hearing to establish their lawful possession and to produce documents to determine their rights in the property/properties of the College or relatable to the College. Whereas, the personal hearings were conducted from 16.07.2024 to 26.07.2024.Further on request of some of these claimants seeking more time for providing documents; additional time was given to them to produce documents till 30.08.2024. Whereas, on scrutiny of the documents submitted by each claimant, it has been found that none of the claimants has provided any documentary evidence to establish his/her right to the property/properties. Whereas, the Delhi Tibbia College (Takeover) Rules, 2006 were notified on 13.07.2006and notices for vacation were issued to all the occupants. A considerable period of time has passed since the notification of these Rules. Despite of passage of a long period of time and providing ample opportunities to the claimants/occupiers, they have failed to establish or produce any document to establish their right to property/properties of Ayurvedic and Unani Tibbia College or relatable to Ayurvedic and Unani Tibbia College.[PART IV DELHI GAZETTE : EXTRAORDINARY 9 Now, therefore, in pursuance of Rule 7 (1) and 7 (2) of the Delhi Tibbia College (Takeover) Rules, 2006 and after giving personal hearing, the representations/claims of the occupiers of properties annexed herewith are disposed off as being DEVOID OF MERIT.
