Executive Summary:** This report analyzes the Members of the Legislative Assembly of the National Capital Territory of Delhi Salaries, Allowances, Pension, etc. Amendment Act, 2022 (hereinafter referred to as “the Amendment Act, 2022”), based solely on the provided government document. The core purpose of this amendment is to revise the salaries, allowances, and other benefits of the Members of the Legislative Assembly (MLAs) of the National Capital Territory (NCT) of Delhi. Key findings indicate an increase in various allowances, including monthly salary, conveyance allowance, office allowance, and pension benefits. The amendment also introduces a one-time allowance for the purchase of electronic devices. This report provides a detailed overview of the changes, their rationale, and their likely impact. **2. Introduction:** The purpose of this report is to provide an informative analysis of the Members of the Legislative Assembly of the National Capital Territory of Delhi Salaries, Allowances, Pension, etc. Amendment Act, 2022. This analysis is based exclusively on the text of the provided government document and aims to elucidate the key changes introduced by the amendment, their potential implications, and relevant implementation aspects as inferred from the text. **3. Policy Overview:** This document pertains to an *amendment* of the existing “Members of the Legislative Assembly of the National Capital Territory of Delhi Salaries, Allowances, Pension, etc. Act, 1994” (Delhi Act 06 of 1995), referred to as the "principal Act". The core objective of the Amendment Act, 2022, as inferred from the text, is to increase the salaries, allowances, pension and other facilities for the Members of the Legislative Assembly of the National Capital Territory of Delhi. **4. Background and Rationale:** The provided text suggests the rationale for this amendment stems from two primary considerations: * **Increased Cost of Living:** The statement mentions "persistent demand from the MLAs for the increase in their salaries and perks facilities having regard to the increase in the price index," indicating that the existing compensation levels were deemed insufficient to maintain the MLAs' standard of living. * **Inadequate Compensation:** The text states, "It was also felt that salaries perks facilities of Ministers Speaker Deputy Speaker Leader of Opposition Chief Whip are a bit inadequate which should be upgraded and enhanced to a commensurate extent." This suggests a perceived need to improve the overall compensation package for MLAs to facilitate effective performance of their duties. **5. Key Provisions / Changes:** The Amendment Act, 2022 introduces the following key changes to the principal Act: * **Section 3 Amendments (Salary and Allowances):** * **Subsection 1(i):** The monthly salary is increased from twelve thousand rupees to thirty thousand rupees. *Effect:* A significant increase in base salary for MLAs. * **Subsection 1(ii):** The daily allowance is increased from one thousand rupees to one thousand five hundred rupees. *Effect:* A moderate increase in daily allowance for MLAs attending assembly sessions or committee meetings. * **Subsection 2:** The constituency allowance is increased from eighteen thousand rupees to twenty-five thousand rupees. *Effect:* Increase in funds available to MLAs for constituency-related expenses. * **Subsection 3:** The office allowance is increased from six thousand rupees to ten thousand rupees. *Effect:* Increase in funds for office-related expenses. * **Subsection 4:** The secretarial assistance allowance is increased from ten thousand rupees to fifteen thousand rupees. *Effect:* Increase in funds to cover the costs of secretarial staff. * **Subsection 5:** A new subsection is inserted, providing each Member with a one-time allowance of one lakh rupees per term of office for the purchase of a laptop, personal computer, printer, mobile handset, etc. *Effect:* Provides a lump sum to MLAs to procure essential technology. * **Section 6 Amendment (Conveyance Allowance):** The conveyance allowance is increased from eight thousand rupees to ten thousand rupees. *Effect:* Increased allowance for transportation-related expenses. * **Section 6A Amendment (Medical Facilities):** The medical facilities allowance is increased from fifty thousand rupees to one lakh rupees. *Effect:* Increased allowance for medical-related expenses. * **Section 8 Amendment (Pension):** The pension benefit is increased from four lakh rupees to eight lakh rupees. *Effect:* A significant increase in the pension benefits received by former MLAs. * **Section 9 Amendment (Telephone Charges):** The telephone charges allowance is increased from seven thousand five hundred rupees to fifteen thousand rupees. *Effect:* Increased allowance for telephone charges. **6. Target Audience and Stakeholders:** The primary target audience and directly affected stakeholders are the Members of the Legislative Assembly of the National Capital Territory of Delhi. Other stakeholders indirectly affected include: * The Government of the National Capital Territory of Delhi (due to increased expenditure). * The citizens of Delhi (as the expenditure is funded from the Consolidated Fund). * Former MLAs who will benefit from the increased pension. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** The Delhi Legislative Assembly Secretariat is responsible for implementing the provisions of the Amendment Act, 2022. The Lieutenant Governor plays a role in setting the date of enforcement. * **Timelines:** The amendment will come into force on a date to be notified by the Lieutenant Governor in the Official Gazette. * **Financial Implications:** The implementation of the Amendment Act, 2022, will result in an additional annual recurring expenditure from the Consolidated Fund of the National Capital Territory of Delhi. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome of these changes is to improve the financial well-being of MLAs, enabling them to: * Maintain a reasonable standard of living given the rising cost of living. * Effectively perform their duties by having adequate resources for constituency work, office management, and technology. * Attract and retain qualified individuals to serve as MLAs by offering a more competitive compensation package. * Reduce the need for MLAs to engage in potentially corrupt activities to supplement their income. **9. Conclusion:** The Members of the Legislative Assembly of the National Capital Territory of Delhi Salaries, Allowances, Pension, etc. Amendment Act, 2022, represents a significant revision of the compensation package for Delhi MLAs. By increasing salaries, allowances, and pension benefits, the amendment aims to address concerns related to the cost of living and the adequacy of existing compensation levels. This report provides a detailed overview of the changes introduced by the amendment, their rationale, and their likely impact, based solely on the provided government document. This amendment is significant as it reflects an effort to enhance the financial capacity of MLAs, which, in turn, is intended to facilitate more effective governance.
