A BILL Further to amend the Speaker and Deputy Speaker of the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994. Be it enacted by the legislative assembly of the National Capital Territory of Delhi in the Seventy-second year of the Republic of India as follows:— 1. Short title, and commencement.—(1) This Act may be called the Speaker and Deputy Speaker of the Legislative Assembly National Capital Territory of Delhi (Salaries and Allowances) (Amendment) Act, 2022. (2) It shall come into force on such date as the Lieutenant, Governor may, by notification in the official Gazette, appoint. 2. Amendment of section 3.—In the Speaker and Deputy Speaker of the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994 (Delhi Act 7 of 1995)(hereinafter referred to as the principal Act), for section 3, the following section shall be substituted, namely:— “(3) The Speaker and Deputy Speaker shall be entitled to receive a salary, allowances, and such other entitlements as are admissible to a Minister under the Ministers of the Government of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994.”. 3. Omission of section 4 and section 5 and re-numbering of section 7 and section 8. —In the principal Act, section 4, section 5 and section 6 shall be omitted, and section 7, section 8 and section 9 shall be re-numbered as section 4, section 5 and section 6, respectively. STATEMENT OF OBJECTS & REASONS For some time past, there has been persistent demand from the MLAs for the increase in their salaries and perks/ facilities having regard to the increase in the price index. It has also been pointed out that salaries/ perks/ facilities of Ministers/ Speaker/ Deputy Speaker/ Leader of Opposition/ Chief Whip are a bit inadequate which should be upgraded and enhanced to a commensurate extent. Considering the exigency of demand, the Speaker of Delhi Legislative Assembly appointed a Committee of Experts on 20.08.2015 to undertake a comprehensive study of the structure of salaries and allowances of Members of Legislative Assembly of Delhi and to recommend revision of salary allowances and other facilities for the Members of Legislative Assembly of National Capital Territory of Delhi. The Expert Committee after deliberating on the issues has made its recommendations for increasing the salaries and allowances etc. of Members of Legislative Assembly of National Capital Territory of Delhi. For the purpose, the Speaker and Deputy Speaker of the Legislative Assembly of the Government of National Capital Territory of Delhi (Salaries and Allowances) (Amendment) Bill, 2022, has been initiated to amend the Speaker and Deputy Speaker of the Legislative Assembly of the Government of National Capital Territory of Delhi (Salaries and Allowances) Act, 1994. This Bill proposes to increase the salaries, allowances & other facilities of the Speaker and Deputy Speaker of the Legislative Assembly of the Government of National Capital Territory of Delhi, so as to facilitate them to work effectively. The Bill seeks to achieve the aforesaid objectives.
