NOTIFICATION
Maharashtra Zilla Parishads and Panchayat saMitis act, 1961.
No. ZPE-2025/C.R.158/PR-2.—Whereas, it is expedient further to amend the Maharashtra
Panchayat Samitis (Electoral Colleges and Conduct of Election) Rules, 1962 for the purpose of
conduct of election of Panchayat Samitis ;
And whereas, the Government of Maharashtra is satisfied that circumstances exist which
render it necessary to take immediate action ; and for that purpose to dispense with the condition
of previous publication thereof.
Now, therefore, in exercise of the powers conferred by clauses (xii) and (xiii) of sub-section
(2) of section 274 read with sub-section (3) of section 57 of the Maharashtra Zilla Parishads and
Panchayat Samitis Act, 1961 and of all other powers enabling it in that behalf, the Government of
Maharashtra hereby, in consultation with the State Election Commissioner, makes the following
rules further to amend the Maharashtra Panchayat Samitis (Electoral Colleges and Conduct of
Election) Rules, 1962 as follows, namely :—
1. These rules may be called the Maharashtra Panchayat Samitis (Electoral Colleges and
Conduct of Election) (Second Amendment) Rules, 2025.
2. In rule 19 of the Maharashtra Panchayat Samitis (Electoral Colleges and Conduct of
Election) Rules, 1962 (hereinafter referred to as “ the Principal Rules ”), in sub-rule (7), the
words “subject to the provisions of Rule 19-A,” shall be deleted.
3. Rule 19-A of the principal Rules shall be deleted.
4. In rule 20 of the principal Rules for sub-rule (1), the following sub-rule shall be
substituted, namely :—
“ (1) Any candidate may withdraw his candidature by notice in writing subscribed
by him and delivered to the Returning Officer within three days, after the affixing of
a list of candidates on the notice board, whose nomination have been accepted under
sub-rule (7) of rule 19 and if third day is a public holiday, the withdrawal may be permitted
on the next succeeding day which is not a public holiday.”.
5. Form II-C appended to the principal Rules shall be deleted.
