खंड (i) के उपखडं (क) और खडं (v) के अधीन िारी भारत सरकार के पयाावरण, वन और िलवाय ु पररवतान मंत्रालय म ें
अजधसूचना संख्या का.आ. 804(अ) तारीख 14 माचा, 2017 (जिसे इसमें इसके पश्चात् उक्त अजधसूचना कहा गया ह)ै द्वारा
उन पररयोिनाओं का जिन्द्होंन े पूवा पयाावरण अनापजि अजभप्राप्त दकए जबना काया आरंभ कर ददया ह ै और ऐस े मामलों को

[का.आ.1533(अ), तारीख 14 जसतंबर, 2006] के अधीन पवू ा पयाावरणीय अनापजि की अपेक्षावाली पररयोिनाओं या
दियाकलापों या जवद्यमान पररयोिनाओं या दियाकलापों के जवस्ट्तार या आधुजनकीकरण को पयाावरण समाघात जनधाारण
अजधसूचना, 2006 के उल्लंघन का मामला माना िाएगा;

के पैरा 13 के उपपैरा (2) से (7) म ेंजवजनर्ददष्ट प्रदिया के अनुसार सख्ती से जनपटा िाएगा;
और पयाावरण (संरक्षण) अजधजनयम, 1986 की धारा 3 की उपधारा (3) द्वारा प्रदि िजक्तयों का प्रयोग करत े हुए
और उक्त अजधसूचना के पैरा 13 के उपपैरा (4) के अनुसरण म ें भारत के रािपत्र, असाधारण में सं.का.आ. 1805(अ) द्वारा
तारीख 6 िून, 2017 को प्रकाजित भारत सरकार के पयाावरण, वन और िलवायु पररवातन मंत्रालय के आदिे द्वारा सभी
क्षेत्रों में उल्लघं न के मामलों का मूल्यांकन करने और केन्द्रीय सरकार को जसफाररिें करने के जलए जवजभन्न क्षेत्रों स े जमलकर
बनने वाली एक जविेषज्ञ मूल्याकं न सजमजत (ईएसी) का गिन करने का प्रस्ट्ताव ह;ै
और तारीख 6 िून, 2017 के उक्त आदेि के परै ा 4 म ें जवजनर्ददष्ट अनुसार इस प्रकार गरित इस जविेषज्ञ मूल्यांकन
सजमजत की पदावजध तीन वष ा (अथाात ् 5 िून, 2020 तक) के जलए ह;ै
और, अब, केंरीय सरकार, पयाावरण (संरक्षण) अजधजनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) द्वारा
प्रदि िजक्तयों का प्रयोग करत े हुए और उक्त अजधसूचना के पैरा 13 के उपपैरा (4) के अनुसरण म ें भारत के रािपत्र,
असाधारण, भाग 2 खंड 3, उपखंड (ii) म ें तारीख 6 िून, 2017 को प्रकाजित भारत सरकार के पयाावरण, वन और
िलवायु पररवातन मंत्रालय की अजधसचूना सं.का.आ. 1805(अ) द्वारा तारीख 6 िून, 2017 के आदेि में जनम्नजलजखत और
संिोधन करती ह,ै अथाात्:--

(i) सारणी म,ें िम संख्यांक 10 और उससे संबंजधत प्रजवजष्टयों के पश्चात् जनम्नजलजखत िम संख्यांक और

ORDER
New Delhi, the 23rd July, 2020
S.O. 2424 (E).—Whereas, by the notification of the Government of India in the Ministry of Environment,
Forest and Climate Change number S.O. 804(E), dated the 14th March, 2017, issued under sub-section (1), sub-clause
(a) of clause (i) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986),
read with clause (d) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 (hereinafter referred to as
the said notification), the Central Government has established an arrangement to appraise the projects, which have
started the work without obtaining prior environmental clearance and such cases have been termed as cases of

And whereas, vide sub-paragraph (1) of paragraph 13 of the said notification, it has been directed that the
projects or activities or the expansion or modernisation of existing projects or activities requiring prior environmental
clearance under the Environment Impact Assessment Notification, 2006 [S.O.1533(E), dated the 14th September,
2006] entailing capacity addition with change in process or technology or both, undertaken in any part of India
without obtaining prior environmental clearance from the Central Government or by the State Environment Impact
Assessment Authority, as the case may be, duly constituted by the Central Government under the aforesaid Act, shall
be considered a case of violation of the Environment Impact Assessment Notification, 2006;
And whereas, the said notification further provides that the projects and activities referred above, shall be dealt
strictly as per the procedure specified in sub-paragraphs (2) to (7) of paragraph 13 of the said notification;
And whereas, in exercise of the power conferred by sub-section (3) of section 3 of the Environment (Protection)
Act, 1986 and in pursuance of sub-paragraph (4) of paragraph 13 of the said notification, an Expert Appraisal
Committee (EAC) was constituted by the order of the Government of India in the Ministry of Environment, Forest
and Climate Change, published in the Gazette of India, Extra ordinary vide number S.O.1805(E), dated the 6th June,
2017 comprising members with expertise in different sectors to appraise and make recommendations to the Central
Government as cases of violation in all the sectors;
And whereas, the tenure of this Expert Appraisal Committee so constituted, is for three years (i.e. up to the 5th
June, 2020), as specified in paragraph 4 of the said order dated the 6th June, 2017;
And now, therefore, in exercise of the powers conferred by sub-section (3) of section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) and in pursuance of sub-paragraph (4) of paragraph 13 of the said notification
[number S.O.804(E), dated the 14th March, 2017], the Central Government hereby makes the following further
amendments in the order of the Government of India, in the Ministry of Environment, Forest and Climate Change,
number S.O.1805(E), dated the 6th June, 2017, published in the Gazette of India, Extraordinary, Part II, Section 3,
Sub-section (ii), dated the 6th June, 2017, namely:-
In the said order,
(i) in the Table, after serial number 10 and the entries relating thereto, the following serial number and
entries shall be inserted, namely: -
