CHENNAI PORT TRUST CHENNAI PORT (SAFETY) AMENDMENT REGULATIONS, 2017 (RRC/14671/2012/GA) No. SRO C-13/2017. In exercise of the powers conferred under Section 123 (n) of the Major Port Trust Act, 1963 (Act 38 of 1963), the Board of Trustees of Chennai Port hereby makes the following Amendment Regulations subject to approval of the Central Government and publication as required under Section 124 of the said Act:- Short Title: 1. (i) These regulations may be called the Chennai Port Safety (Amendment) Regulations, 2017. (ii) These Regulations shall come into force on the date of their publication in the Official Gazette under Section 124 (1) of the Major Port Trusts Act, 1963. 2. In the Chennai Port (Safety) Regulations, 1981, the following amendments shall be made:- (i) In regulation 1, sub-clause 3 (k) shall be deleted. (ii) In regulation 1, sub-clause 3(l) shall be substituted as under.- “(l) ‘IMCO Code’ or ‘IMDG Code’ means the International Maritime Dangerous Goods Code issued by the International Maritime Organization”. (iii) In the aforesaid regulations the existing title of “PART 3” shall be substituted as under.- “SPECIAL RULES TO REGULATE IMPORT / EXPORT OF IMDG CARGO CLASS I” (iv) In regulation 3, in sub-clause 2, the second paragraph the words “Chennai Port Trust General Regulations No. 55(3) ………… regulation under this head” shall be deleted. (v) In regulation 3, in sub-clause 2, in the last paragraph the words “Naval Officer-in-Charge of Chennai” shall be substituted by the words “Flag Officer Commanding TN & P Naval Area”. (vi) In regulation 3, the sub-clause 3 shall be substituted as under: “3.3. Prohibited Explosives: Explosives which is prohibited by the Central Government under Section 6 of the Explosive Act, 1884 (4 of 1884)”. (vii)In regulation 3, the sub-clause 6 shall be substituted as under: “3.6.The handling of IMDG Cargo Class - I (Explosives) in Chennai Port shall be as laid down in the ‘Standard Operating Procedure (SOP) for handling of IMO- CSC - Container carrying IMDG Class I Explosives Cargo’ at Chennai Port”. (viii) In regulation 3, the sub-clause 7, shall be substituted as under: “3.7. The SOP referred to in sub-regulation 3.6 above shall be amended from time to time as may be necessary by the Chairman, Chennai Port Trust, with the approval of the Chief Controller of Explosives, Petroleum and Explosives Safety Organisation (PESO), Nagpur”. (ix) In regulation 3, sub-clause 8 shall be substituted as under: “3.8. An up-to-date copy of the Standard Operating Procedure shall be displayed in the web-site of the Chennai Port Trust.” (x) In regulation 3, sub-clauses 9,10,11,12,13,14,15,16,17,18,19 and 20 shall be deleted.
