Whereas sub clause (ii) of clause (b) of sub-section (4) of Section 4 of the Aadhaar (Targeted delivery of Financial and other Subsidies, Benefits and Services) Act, 2016 (Central Act 18 of 2016) (hereinafter referred to as “the said Act”), allows performing authentication on voluntary basis, for such purpose, as the Central Government in consultation with the Unique Identification Authority of India and in the interest of State, may prescribe; AND WHEREAS, for such purpose the Government of India framed the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 wherein the State Government can seek permission under the said rules to use Aadhaar on Voluntary basis. AND WHEREAS, the Government of India vide Office Memorandum eF.No.13(6)/2021-EG.II, dated 23.05.2023 has conveyed the approval of the competent authority to allow the Revenue and Disaster Management Department, Government of Tamil Nadu to use Aadhaar authentication services on voluntary basis, in seeding Aadhaar Numbers of landowners in computerized land records in terms of rule 5 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation Knowledge) Rules, 2020 read with sub clause (ii) of clause (b) of sub-section (4) of Section 4 of the said Act; NOW, THEREFORE the Government of Tamil Nadu hereby notifies that the Revenue and Disaster Management Department, Government of Tamil Nadu can seek Aadhaar authentication services on voluntary basis, for seeding Aadhaar Numbers of landowners in computerized land records, in terms of rule 5 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020, subject to the following conditions namely:- 1. The informed consent of the landowners shall be obtained for the purpose of authentication in terms of Section 29 of the said Act. The purposes for which the Aadhaar number and related information is being sought must be communicated clearly to the landowner. Specifically, the manner in which the Aadhaar number will be collected, stored and used shall be clearly communicated to the residents. 2. The Revenue and Disaster Management Department, Government of Tamil Nadu shall ensure that provisions of clause (2) and (3) of Section 8 of the said Act, relating to Aadhaar authentication of children are strictly adhered to without fail. 3. There shall not be denial of any service/benefit to resident on account of failure of Aadhaar based authentication. 4. The landowners shall be informed of alternate mechanism of identification/verification as the instant usage of Aadhaar authentication is permitted purely on voluntary basis. 5. There shall not be display of Aadhaar number anywhere in system and wherever required only last 4 digits of Aadhaar number may be displayed. 6. Aadhaar number shall be stored securely in Aadhaar Data Vault and in accordance with directions provided vide Unique Identification Authority of India (UIDAI) Circular dated 25-07-2017 in this regard. Any sharing of Aadhaar number shall be done in an encrypted and secured manner and only in accordance with provisions of Section 29 of the said Act. 7. Complete details of the e-KYC information of the resident shall not be displayed on the screen, instead only necessary demographic details such as first name, year of birth etc, may be displayed. 8. Bio-metric authentication of beneficiaries shall be performed only by the persons / agencies authorized for this purpose by the Revenue and Disaster Management Department, Government of Tamil Nadu. 9. The Revenue and Disaster Management Department, Government of Tamil Nadu shall get its software applications used for this purpose audited by a CERT-IN empanelled IS Auditor and submit the report to the UIDAI. Any subsequent suggestion made by the UIDAI may also be complied with.Aug. 9, 2023] TAMIL NADU GOVERNMENT GAZETTE 101 10. The Revenue and Disaster Management Department, Government of Tamil Nadu may encourage use of Iris-based biometric authentication, wherever required, considering that it is more accurate, contactless and safe particularly in current Covid-19 pandemic times. 11. The Revenue and Disaster Management Department, Government of Tamil Nadu shall comply with all the relevant provisions of the said Act, its associated regulations and other instructions issued by UIDAI from time-to-time. 12. The Revenue and Disaster Management Department, Government of Tamil Nadu shall separately notify the alternate methods of identification in case any of the landowners does not intend to authenticate using his Aadhaar. The consent form to be collected from the claimants is specified in schedule “A” Schedule "A" Consent Form Format I ________________________ (Aadhaar holder) hereby consent for the use of my Aadhaar Number on voluntary basis to use for yes/no demographic authentication OR for fetching my identity and other information for purpose of e-KYC through Unique Identification Authority of India (UIDAI), using the Aadhaar OTP or Biometric authentication with UIDAI and to use it in computerized land records and seed the details in the database of computerized land records created by the National Informatics Centre, Chennai. The consent and purpose of collecting Aadhaar has been explained to me in local language. The Department has informed me that my Aadhaar shall not be used for any purpose other than mentioned above. I have been given other alternative means by the department for KYC purposes including physical KYC by submitting officially valid documents and I have voluntarily chosen Aadhaar based KYC. I understand that the Biometrics and/or OTP, I provide for authentication shall be used only for authenticating my identity through the Aadhaar authentication system for that specific transaction and for no other purposes.
