और केंरीय सरकार का यह समाधान हो गया ह ैदक इस अजधसूचना से संलग्न अनुसूची में जिजहत की गई उक्त भूजम के भाग में कोयला अजभप्राप्य ह;ै अतः, अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए इससे संलग्न अनुसूची में यथाजिजनर्िजष्ट 125.03 एकड़ (लगभग) या 50.59 हक्े टेयर (लगभग) माप की उक्त भूजम में के या उस पर के सभी अजधकार के अिजन करने के अपने आिय की सूचना िेती है; रटप्पण - 1 : इस अजधसूचना के अधीन आने िाले क्षेत्र के रेखांक धारक संखया आरईिी/06/2023, तारीख 25 अक्तूबर, 2023 का जनरीक्षण उपायुक्त, जिला – रामगढ़ (झारखंड) के कायाजलय में या कोयला जनयंत्रक, कोयला जनयंत्रक संगठन, कोयला मंत्रालय, स्ट्कोप मीनार, 5िीं मंजिल, कोर-2, लक्ष्मी नगर, दिल्ली – 110092 के कायाजलय में अथिा महाप्रबंधक कुिू क्षेत्र, जिला – रामगढ़ (झारखंड) के कायाजलय में या महाप्रबंधक (भूजम और रािस्ट्ि), सेंरल कोलफील््स जलजमटेड, िरभंगा हाउस, 2657 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] रााँची (झारखंड) – 834001 या मुखय महाप्रबंधक (गिेषण जिभाग), सेंरल माइन प्लाननंग एंड जडिाइन इंस्ट्टीच्यूट जलजमटेड, गोंडिाना पैलेस, कांके रोड, रााँची (झारखंड)– 834008 में दकया िा सकता ह।ै रटप्पण - 2: उक्त अजधजनयम की धारा 8 के उपबंधों की ओर ध्यान आकृष्ट दकया िाता है, जिसमें जनम्नजलजखत उपबंध ह ैं:- ‘’8. अिजन की बाबत् आपजत्तयां – (1) कोई व्यजक्त, िो दकसी भूजम में जिसकी बाबत् धारा 7 के अधीन अजधसूचना जनकाली गई ह,ै जहतबद्ध है, अजधसूचना के िारी दकए िाने के तीस दिनों के भीतर सम्पूणज भूजम या उसके दकसी भाग या ऐसी भूजम में या उस पर के दकन्द्हीं अजधकारों का अिजन दकए िाने के बारे में आपजत्त कर सकेगा। स्ट्पष्टीकरण.- इस धारा के अथाजन्द्तगजत यह आपजत्त नहीं मानी िाएगी दक कोई व्यजक्त दकसी भूजम म ेंकोयला उत्पािन के जलए स्ट्ियं खनन संदियाएाँ करना चाहता ह ैऔर ऐसी संदियाएाँ केन्द्रीय सरकार या दकसी अन्द्य व्यजक्त को नहीं करनी चाजहए। (2) उपधारा (1) के अधीन प्रत्येक आपजत्त सक्षम प्राजधकारी को जलजखत रूप में की िाएगी और सक्षम प्राजधकारी आपजत्तकताज को स्ट्ियं सुने िाने का या जिजध व्यिसायी द्वारा सुनिाई का अिसर िेगा और ऐसी सभी अपजत्तयों को सुनने के पश्चात और ऐसी अजतररक्त िांच, यदि कोई हो, करने के पश्चात िो िह आिश्यक समझता है, िह या तो धारा 7 की उप-धारा (1) के अधीन अजधसूजचत भूजम के या ऐसी भूजम में या उस पर के अजधकारों के संबंध में एक ररपोटज या ऐसी भूजम के जिजभन्न टुकड़ों या ऐसी भूजम में या उस पर के अजधकारों के संबंध में आपजत्तयों पर अपनी जसफ़ाररिों और उसके द्वारा की गई कारजिाई के अजभलेख सजहत जिजभन्न ररपोटज केन्द्रीय सरकार को उसके जिजनश्चय के जलए िेगा। (3) इस धारा के प्रयोिनों के जलए िह व्यजक्त दकसी भूजम में जहतबद्ध समझा िाएगा, िो प्रजतकर में जहत का िािा करने को हकिार होता, यदि भूजम या दकसी ऐसी भूजम में या उस पर के अजधकार इस अजधजनयम के अधीन अर्िजत कर जलए िाते। ‘’ रटप्पण - 3: केन्द्रीय सरकार ने कोयला जनयंत्रक, कोयला जनयंत्रक संगठन, कोयला मंत्रालय, स्ट्कोप मीनार, 5िीं मजं िल, कोर-2, लक्ष्मी नगर, दिल्ली – 110092 को उक्त अजधजनयम की धारा 3 के अधीन अजधसूचना संखयाकं का.आ. 2518, तारीख 27 मई, 1983, िो भारत के रािपत्र भाग 2, खंड 3, उपखण्ड (ii), तारीख 11 िून, 1983 में प्रकाजित की गई थी, सक्षम प्राजधकारी जनयुक्त दकया ह।ै अनसु चू ी पुंडी ओसीपी जिला रामगढ़ (झारखण्ड) [रेखांक धारक संखया आरईिी/06/2023, तारीख 25 अक्तूबर, 2023 ] सभी अजधकार: अिजन के अधीन रकबा ब्लॉक ग्राम थाना सं. अंचल जिला अभ्युजक्त एकड़ में हक्े टेयर में ए 124.28 50.29 मांडू 114 मांडू रामगढ़ भाग बी 0.75 0.30 भाग हसे ागढ़ा 122 मांडू रामगढ़ अिजन के अधीन कुल रकबा (ए +बी ) 125.03 एकड़ 50.59 हेक्टेयर (लगभग) (लगभग) पुंडी ओसीपी के जलए अिजन के अधीन प्लॉटों के ब्यौरे:- ब्लॉक –ए : ग्राम – मांडू : प्लॉट संखया - 2324(भाग), 2325(भाग), 2336(भाग), 2337(भाग), 2338(भाग), 2339, 2340, 2341, 2342, 2343, 2344, 2345, 2346, 2347, 2348, 2349(भाग), 2652(भाग), 2654(भाग), 2659(भाग), 2660, 2661 और 2718(भाग). ब्लॉक – बी : ग्राम – हसे ागढ़ा :[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 प्लॉट संखया – 7 (भाग). सीमा िणजन : ब्लॉक सीमा रेखा सीमा िणजन रेखा जबन्द्ि ु ‘क’ से आरंभ होकर जबन्द्ि ु ख, ग, घ, ङ, च, और छ से ए क – ख – ग – घ – ङ –च – छ – क. गुिरते हुए आरंजभक जबन्द्ि ु‘क’ पर जमलती ह।ै बी रेखा जबन्द्ि ु ‘ि’ से आरंभ होकर जबन्द्ि ु झ और ञ से गुिरते हुए ि – झ – ञ – ि. आरंजभक जबन्द्ि ु ‘ि’ पर जमलती ह।ै [फा. स.ं 43015/18/2022-एलएआईआर] भबानी प्रसाि पजत, संयुक्त सजचि MINISTRY OF COAL NOTIFICATION New Delhi, the 22nd April, 2024 S.O. 1767(E).—Whereas by the notification of Government of India in the Ministry of Coal number S.O 539 (E), dated the 2nd February, 2023, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) , published in the in the Gazette of India, part II, Section 3, Sub-Section (ii) dated the 2nd February, 2023, the Central Government gave notice of its intention to prospect for coal in 125.03 acres (approximately) or 50.59 hectares (approximately) of the land in the locality specified in the schedule annexed to that notification; And whereas the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed in the schedule appended to this notification. Now, therefore, in exercise of powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 125.03 acres (approximately) or 50.59 hectares (approximately) and all rights in or over the said lands as described in the schedule appended hereto; Note - 1: The plan bearing number Rev/06/2023, dated the 25th October, 2023 the area covered by this notification may be inspected in the office of the Deputy Commissioner, District Ramgarh (Jharkhand) or at the office of the Coal Controller, Coal Controller’s Organization, Ministry of Coal, SCOPE MINAR, 5th Floor, Core – II, Laxmi Nagar, Delhi – 110092 or at the office of the General Manager, Kuju Area, District Ramgarh, Jharkhand or General Manager (Land and Revenue), Central Coalfields Limited, Darbhanga House,Ranchi-834001, Jharkhand or General Manager (Exploration Division), Central Mine Planning and Design Institute Limited, Gondwana Palace, Kanke Road, Ranchi-834008, Jharkhand. Note - 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:- “8. Objections to acquisition.- (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land. EXPLANATION.-It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] shall after hearing all such objections and after making such further inquiry if any, as he thinks necessary either makes a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land to the Central Government, containing his recommendations on the objections, together with the record of the proceeding held by him, for the decision of the Government. (3) For the purposes of the section, a person shall be deemed to be interested in land, who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act.” Note - 3: The Coal Controller, Coal Controller’s Organization, Ministry of Coal, SCOPE MINAR, 5th Floor, Core – II, Laxmi Nagar, Delhi - 110092 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2518, dated the 27th May, 1983 published in part II, section - 3, sub-section (ii) of the Gazette of India, dated the 11th June, 1983.
