का.आ. 5485(अ).— कोयला धारक क्षेत्र (अिनज और जिकास) अजधजनयम, 1957 (1957 का 20) (जिसे इसम ें
इसके पश्चात् उक्त अजधजनयम कहा गया ह)ै की धारा 9 की उपधारा (1) के अधीन िारी भारत के रािपत्र, असाधारण,
भाग II, खडं 3, उपखंड (ii), तारीख 28 निम्बर, 2023 में प्रकाजित, भारत सरकार के कोयला मंत्रालय की अजधसूचना
संख यांक का.आ. 5063(अ), तारीख 28 निम्बर, 2023 को िारी, उक्त अजधसूचना स े संलग्न अनुसूची म ें माप िाली भूजम
82.602 हक्े टेयर (लगभग) या 204.109 एकड़ (लगभग) की िर्णिंत भूजम और ऐसी भूजम (जिसे इसमें इसके पश्चात ् उक्त
भूजम कहा गया ह)ै , म ें या उस पर के सभी अजधकार उक्त अजधजनयम की धारा 10 की उपधारा (1) के अधीन, सभी
जिल् लंगमों से मुक्त होकर, आत् यजं तक रूप से केन्द रीय सरकार म ेंजनजहत हो गए थे;
और, केन्द रीय सरकार का यह समाधान हो गया ह ै दक मेससज दि आंध्र प्रिेि जमनरल डेिलपमेंट कारपोरेिन
जलजमटेड, कारपोरेट कायाजलय 294/1डी, ताड़ीगडप्पा से एजनकेपाडू, 100 फीट रोड, केन्नूर, जिियिाड़ा-521137, आध्रं
प्रिेि (जिसे इसम ें इसके पश्चात ् सरकारी कंपनी कहा गया ह)ै , ऐसे जनबंधनों और ितों का, िो केन्द रीय सरकार इस जनजमत्त
अजधरोजपत करना उजचत समझे, अनुपालन करन े के जलए सहमत है;

अत:, अब, केन्द रीय सरकार, उक्त अजधजनयम की धारा 11 की उपधारा (1) द्वारा प्रित् त िजक्त यों का प्रयोग करत े
हुए, यह जनिेि िेती ह ै दक इस प्रकार जनजहत भूजम 82.602 हक्े टेयर (लगभग) या 204.109 एकड़ (लगभग) माप िाली
उक्त भूजम म ें या उस पर के सभी अजधकार तारीख 28 निम्बर, 2023 स े केन्द रीय सरकार म ें इस प्रकार जनजहत बन े रहन े के
जसिाए, जनम्न जलजखत जनबंधनों और ितों के अधीन रहत ेहुए, सरकारी कंपनी म ेंजनजहत हो िाएंगे, अथातज ् :-
(1) सरकारी कंपनी, उक्त अजधजनयम और अन्दय सुसंगत जिजधयों के उपबंधों के अधीन यथा अिधाररत प्रजतकर, ब्याि,
नुकसाजनयों और िैसी ही मिों की बाबत दकए गए सभी संिायों की प्रजतपूजत करेगी;
(2) उक्त अजधजनयम की धारा 14 के अधीन एक अजधकरण का गठन दकया िाएगा जिसमें ितज (1) के अधीन सरकारी
कंपनी द्वारा संिेय रकमों का अिधारण करने के प्रयोिनों के जलए और ऐसे दकसी अजधकरण और उक्त अजधकरण की
सहायता करन े के जलए जनयुक्त व्यजक्तयों के संबंध म ें उपगत सभी व्यय, सरकारी कंपनी द्वारा िहन दकए िाएगं े और
इस प्रकार जनजहत उक्त भूजम में या उस पर के अजधकारों के जलए या उनके संबंध में अपीलों आदि सभी जिजधक
कायजिाजहयों की बाबत उपगत, सभी व्यय भी, सरकारी कंपनी द्वारा िहन दकए िाएगं े;
(3) सरकारी कंपनी, केन्द रीय सरकार या उसके पिधाररयों की, ऐस ेदकसी अन्द य व् यय के संबंध म ेंक्षजतपूर्तज करेगी, िो इस
प्रकार जनजहत उक्त भूजम में या उस पर के अजधकारों के बारे में, केन्द रीय सरकार या उसके पिधाररयों द्वारा या उनके
जिरूद्ध दकन्द हीं कायजिाजहयों के संबंध में आिश् यक हो ;
(4) सरकारी कंपनी को केन्दरीय सरकार के पूिज अनुमोिन के जबना, इस प्रकार जनजहत उक्त भूजम म ें या उस पर के पूिोक्त
अजधकारों को दकसी अन्दय व्यजक्त को अंतररत करने की िजक्त नहीं होगी; और
(5) सरकारी कंपनी, ऐसे जनिेिों और ितों का पालन करेगी, िो केन्द रीय सरकार द्वारा, िब कभी आिश् यक हो, उक्त
भूजम के जिजिष्ट क्षेत्रों के जलए दिए िाएं या अजधरोजपत दकए िाएं ।

NOTIFICATION
New Delhi, the 29th December, 2023
S.O. 5485(E).— Whereas, on the publication of the notification of the Government of India in the Ministry
of Coal, number S.O. 5063(E), dated the 28th November, 2023, published in the Gazette of India, Extraordinary, Part
II, section 3, sub-section (ii), dated the 28th November, 2023, issued under sub-section (1) of section 9 of the Coal
Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the
land and all rights in or over the lands measuring 82.602 hectares (approximately) or 204.109 acres (approximately)
described in the Schedule appended to the said notification (hereinafter referred to as the said land) vested absolutely
in the Central Government free from all encumbrances under sub-section (1) of section 10 of the said Act ;
And, whereas, the Central Government is satisfied that the M/s. The Andhra Pradesh Mineral Development
Corporation Limited, Corporate Office 294/1D, Tadigadpa to Enikepadu 100 Feet Road, Kanuru, Vijayawada-521137,
Andhra Pradesh (hereinafter referred to as the Government company) is willing to comply with such terms and
conditions as the Central Government thinks fit to impose in this behalf ;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 11 of the said Act, the
Central Government hereby directs that the said land measuring 82.602 hectares (approximately) or 204.109 acres
(approximately) with all rights in or over the said land so vested, shall with effect from 28th November, 2023, instead
of continuing to so vest in the Central Government shall vest in the Government company subject to the following
terms and conditions, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
(1) The Government company shall make all payments in respect of compensation, interest, damages and the like as
determined under the provisions of the said Act and other relevant laws;
(2) A Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining the amounts
payable by the Government company under condition (1) and all expenditure incurred in connection with any
such Tribunal and persons appointed to assist the Tribunal shall be borne by the Government company and
similarly, all expenditure incurred in respect of all legal proceedings like appeals, etc., for or in connection with
the rights in or over the said land so vested, shall also be borne by the Government company;
(3) The Government company shall indemnify the Central Government and its officials against any other
expenditure that may be necessary in connection with any proceedings by or against the Central Government or
its officials regarding the rights in or over the said land so vested;
(4) The Government company shall have no power to transfer the aforesaid rights in the said land so vested to any
other persons without the prior approval of the Central Government ; and
(5) The Government company shall abide by such directions and conditions as may be given or imposed by the
Central Government for particular areas of the said land as and when necessary.
