में या उस पर के दकन्द्हीं अजधकारों का अजनज दकए जान े के बारे में आपजत्त कर सकेगा।
स्ट्पष्टीकरण.-इस धारा के अधीन यह आपजत्त नहीं मानी जाएगी, दक कोई व्यजक्त दकसी भूजम म ें कोयला उत्पादन के जलए
स्ट्ियं खनन संदियाएं करना चाहता ह ैऔर ऐसी संदियाएं केंरीय सरकार या दकसी अन्द्य व्यजक्त को नहीं करनी चाजहए।
(2) उपधारा (1) के अधीन प्रत्येक आपजत्त सक्षम प्राजधकारी को जलजखत रूप में की जाएगी और सक्षम प्राजधकारी,
आपजत्तकताज को स्ट्ियं सुने जाने या जिजध व्यिसायी द्वारा सुनिाई का अिसर देगा और ऐसी सभी आपजत्तयों को सुनने के
पश्चात ् और ऐसी अजतररक्त जाचं ,यदद कोई हो, करन े की पश्चात् जो िह आिश्यक समझता ह,ै िह या तो धारा 7 की
उपधारा (1) के अधीन अजधसूजचत भूजम के या ऐसी भूजम में या उस पर के अजधकारों के संबंध में एक ररपोट ज या ऐसी भूजम
के जिजभन्न टुकड़ों या ऐसी भूजम में या उस पर के अजधकारों के संबंध में आपजत्तयों पर अपनी जसफाररिों और उसके द्वारा की
गई कायजिाही के अजभलेख सजहत जिजभन्न ररपोटें केन्द्रीय सरकार को उसके जिजनश्चय के जलए देगा।
(3) इस धारा के प्रयोजनों के जलए िह व्यजक्त दकसी भी भूजम में जहतबद्ध समझा जाएगा जो प्रजतकर म ें जहत का दािा करन े
का हकदार होता यदद भूजम या दकसी ऐसी भूजम में या उस पर के अजधकार इस अजधजनयम के अधीन अर्मजत कर जलए
जाते ''।

NOTIFICATION
New Delhi, the 27th June, 2022
S.O. 2909(E).—Whereas by Notification of the Government of India in the Ministry of Coal,
S.O. number 100, dated the 27th January, 2022 under sub-section (1) of section 4 of the Coal Bearing Areas
(Acquisition and Development) Act, 1957 (20 of 1957) ( hereinafter referred to as the said Act) published in the
Gazette of India, Part II, Section-3, Sub-section (ii), dated the 29th January, 2022, the Central Government gave notice
of its intention to prospect for coal in 51.590 acres (approximately) or 20.878 hectares (approximately) of the lands in
the locality specified in the Schedule annexed to that notification;
And, whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed
in the Schedule appended to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the
Central Government hereby gives notice of its intention to acquire the land measuring 51.590 acres (approximately)
or 20.878 hectares (approximately) and all rights in or over the said lands as described in the Schedule appended
hereto;
Note 1 : The plan bearing number MCL/SA/SBOCP/GP(W)-EXTN./7(1)/2022/20, dated the 12th February, 2022 of
the area covered by this notification may be inspected at the office of the Collector, District Angul
(Odisha)- 759122 or at the office of the Coal Controller, 1, Council House Street, Kolkata-700 001 or at the4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
office of the Director (Personnel), Mahanadi Coalfields Limited, Post Office Jagruti Vihar, Burla, District
Sambalpur-768020, Odisha.
Note 2 : Attention is hereby invited to the provisions of section 8 of the said Act, which provides as follows:-
" 8. Objections to acquisition.- (1) Any person interested in land in respect of which a notification under section 7
has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any
part of the land or any rights in or over such land.
Explanation.- It shall not be an objection within the meaning of this section for any person to say that he himself
desires to undertake mining operation in the land for the production of coal and that such operation should not be
undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing and the competent
authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall,
after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a
report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such
land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the
Central Government, containing his recommendations on the objections, together with the record of the proceedings
held by him, for the decision of that Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim
an interest in compensation if the land or any rights in or over such land were acquired under this Act.”
Note 3. The Coal Controller, 1, Council House Street, Kolkatta- 700001 has been appointed by the Central
Government as the Competent Authority under section 3 of the said Act, vide notification number S.O. 2015,
dated the 10th July, 1995 published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the
22nd July, 1995.
