L.-33004/99 सी.जी.-डी.एल.-अ.-22022023-243796 xxxGIDHxxx CG-DL-E-22022023-243796 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 97] नई दिल्ली, बुधवार, फरवरी 22, 2023/फाल्ग नु 3, 1944 No. 97] NEW DELHI, WEDNESDAY, FEBRUARY 22, 2023/PHALGUNA 3, 1944 कोयला मत्रं ालय अजधसचू ना नई दिल्ली, 17 फरवरी, 2023 सा.का.जन. 119(अ).—केन्द्रीय सरकार,कोयला खान भजवष्य जनजध और प्रकीणण उपबंध अजधजनयम, 1948 (1948 का46) की धारा 7 के साथ पठित धारा 3ङ द्वारा प्रित्त िजियों का प्रयोग करते हुए, कोयला खान पेंिन योिना, 1998 म ेंऔर संिोधन करन े के जलए जनम्नजलजखत योिना बनाती ह,ैअथाणत:् - 1. सजं िप्त नाम और प्रारंभ- (1) इस योिना का संजिप्त नाम कोयला खान पिें न (संिोधन) योिना, 2023 ह।ै (2) यह रािपत्र म ेंइसके प्रकािन की तारीख स ेप्रवृत होगा। 2. कोयला खान पेंिन स्ट्कीम, 1998 (जिसे इसम ें इसके पश्चात उि स्ट्कीम कहा गया ह)ै के परै ा 2 म,ें - (i ) उप पैरा(ड) के स्ट्थान परजनम्नजलजखत उप परै ा रखा िाएगा, अथाणत:्- '(ड) " पेंिन योग्य आय"ु का अथण ह ैसाि वर्ण की आय;ु' (ii) उप-पैरा(प) के स्ट्थान पर जनम्नजलजखत उप पैरा रखा िाएगा, अथातण ्:- 1125 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] '(प) "अजधवर्र्णता" एक कमणचारी के संबंध म ें िो पेंिन योिना का सिस्ट्य ह,ै का अथण उि कमचण ारी द्वारा साि वर्ण की आय ु प्राप्त करना अजभप्रेत ह,ै जिसको उसका जनयोिन समाप्त हो िाता ह;ै' 3. उि स्ट्कीम म,ें पैरा 5 म,ें- (i) उप पैरा (1) के पश्चात,् जनम्नजलजखत उप परै ा अंतःस्ट्थाजपत दकया िाएगा, अथाणत्:- "(1क) भजवष्य जनजध स्ट्कीम और पेंिन स्ट्कीम के अधीन दिए गए “पजत या पत्नी” और पठरवार के जववरण के संबंध म ें नामांकन इस पैरा के प्रयोिन के जलए समान होगा।"; (ii) उप पैरा (3) म,ें "पत्नी/पजत" पि के स्ट्थान पर "पजत या पत्नी" िब्ि रखा िाएगा। 4. उि स्ट्कीम म,ें पैरा 8 म,ें- (i) उप पैरा(1) म,ें "30वें दिन को या उससे पहले" िब्िों, अंकों और अिरों को जनम्नजलजखत िब्िों को रखा िाएगा, अथाणत:्- "के बंि होन े के परं ह दिनों के भीतर"; (ii) उप पैरा (2) के स्ट्थान पर जनम्नजलजखत उप पैरा रखा िाएगा, अथातण ्:- "(2) 01अक्त ूबर, 2017से प्रत्येक जनयोिा िये मूल वते न के सात प्रजतित के भगु तान के जलए जिम्मेिार होगा जिस े इस स्ट्कीम के पैरा 3 के खडं (छ) के संिभण म ें कमणचारी के पठरवतनण ीय महगं ाई भत्त े को जनयोिा के अिं िान के रूप म ें जनजध म ेंअंतठरत दकया िाएगा। 5. उि स्ट्कीम म,ें पैरा 9 के, उप पैरा (2) म,ें पैरा 3 के "खंड (ख), (ग), (घ), (ङ) और (च)", के स्ट्थान पर िब्ि, कोष्ठक, अिर और अंक के स्ट्थान पर परै ा 3 के "खंड(ङ), (च) और (छ)" िब्ि, कोष्ठक, अिर और अंक को रखा िाएगा। 6. उि स्ट्कीम के, पैरा 10 म,ें उप पैरा(3) के स्ट्थान पर, जनम्नजलजखत उप पैरा को रखा िाएगा, अथाणत्: - "(3) िहां एक कमणचारी न े िस वर्ण की पिें न योग्य सेवा पूरी कर ली ह ैऔर पचास वर् ण की आयु प्राप्त कर लते ा ह,ै वहा ं ऐसे कमणचारी को िये माजसक पेंिन की रकम अनुसूची-2 म ें जवजनर्िष्टण आधार पर जनधाणठरत की िाएगी।" 7. उि स्ट्कीम म,ें पैरा 15 के स्ट्थान पर जनम्नजलजखत परै ा रखा िाएगा, अथाणत्:- "15. पेंिन की रकम - पेंिन योिना के उपबंधो के अधीन पेंिन का हकिार कमणचारी 'न्द्य ू सहि' प्रारूप म ेंपेंिन के जलए आवेिन कर सकता ह,ै और पेंिन की स्ट्वीकाय ण राजि प्राप्त करेगा।" 8. उि स्ट्कीम म,ें पैरा 16 का लोप दकया िाएगा। 9. उि स्ट्कीम म,ें पैरा 17 के स्ट्थान पर, जनम्नजलजखत पैरा को रखा िाएगा, अथाणत्:- "17. बकाया लाभ का भुगतान- िहां दकसी कमणचारी की सेवा म ें मृत्य ु हो िाती ह ैया साि वर्ण की आय ु प्राप्त करन े के पश्चात ् और स्ट्कीम के उपबंधो के अधीन प्रोद्भूत कुछ रकम का भुगतान नहीं दकया गया ह,ै तब ऐसी राजियों का भुगतान िीजवत पजत या पत्नी के न होने की जस्ट्थजत म ें िीजवत बच् चों को समान जहस्ट्स े म,ें या िहां कोई पजत या पत्नी और बच् च े नहीं ह,ैं तो नाम जनिेजिती को दकया िाएगा।” 10. उि स्ट्कीम के, पैरा 19 म,ें- (i) उप पैरा(1) के स्ट्थान पर, जनम्नजलजखत उप पैरा रखा िाएगा, अथातण ्:-[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 "(1) आयुि प्रत्येक वर्ण बोड ण के समि अलग स े संभाजवत प्राजप्तयों और व्यय को ििाणत े हुए एक बिट पिे करेगा जिसको उस वर्ण के अप्रैल के पहल े दिन स े िरूु होन े वाल े वर् ण के िौरान खच ण होने की उम्मीि ह ै और बोड ण द्वारा अनुमोदित बिट बोड ण के समि रख े िान े के एक महीन े की अवजध के भीतर केन्द्रीय सरकार को मंिरू ी के जलए प्रस्ट्तुत दकया िाएगा।” (ii) उप-पैरा (3) म,ें "और जवत्तीय वर्ण की समाजप्त स े पहले इसके जलए केंर सरकार का अनमु ोिन भी प्राप्त दकया िाएगा" िब्िों को हटा दिया िाएगा। 11. उि स्ट्कीम म,ें प्रारूप पीएस-6 के स्ट्थान पर, जनम्नजलजखत प्रारूप से रखा िाएगा, अथाणत:्- “FORM ‘NEW SAHAJ (पैरा 15 िेख)ें “प्रारूप ‘नया सहि’ CLAIM FORM FOR PROVIDENT FUND REFUND AND PENSION भजवष्य जनजध वापसी एव ंपिें न िावा के जलए प्रारूप (For all kinds of Provident Fund and Pension Claims) सभी प्रकार के भजवष्य जनजध एव ं पेंिन िावा के जलए SL. Short title and commencement.- (1) This scheme may be called the Coal Mines Pension (Amendment) Scheme, 2023. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Coal Mines Pension Scheme, 1998 (hereinafter referred to as the said scheme), in paragraph 2,- (i) for sub-paragraph (m), the following sub-paragraph shall be substituted, namely:- ‘(m) “pensionable age” means the age of sixty years;’ (ii) for sub-paragraph (u), the following sub-paragraph shall be substituted, namely:- ‘(u) “superannuation” in relation to an employee who is a member of the Pension Scheme means the attainment of sixty years of age by the said employee on which employment is vacated;’ 3. In the said scheme, in paragraph 5,- (i) after sub-paragraph (1), the following sub-paragraph shall be inserted, namely:- “(1A) The nomination regarding spouse and family particulars given under the Provident Fund Scheme and the Pension Scheme shall be the same for the purpose of this paragraph.”; (ii) in sub-paragraph (3), for the expression “wife/husband”, the word “spouse” shall be substituted. 4. In the said scheme, in paragraph 8,- (i) in sub-paragraph (1), for the words, figures and letters “on or before the 30th day of” the following words shall be substituted, namely:- “within fifteen days of the close of”; (ii) for sub-paragraph (2), the following sub-paragraph shall be substituted, namely:- “(2) With effect from the 1st October, 2017, every employer shall be responsible for payment of seven per cent. of the payable basic and variable dearness allowance of the employee to be transferred to the fund as employer share in terms of clause (g) of paragraph 3 of this Scheme.” 5. In the said scheme, in paragraph 9, in sub-paragraph (2), for the words, brackets, letters and figure "clauses (b), (c), (d), (e) and (f) of paragraph 3", the words, brackets, letters and figure "clauses (e), (f) and (g) of paragraph 3" shall be substituted. 6. In the said scheme, in paragraph 10, for sub-paragraph (3), the following sub-paragraph shall be substituted, namely:- “(3) Where an employee having completed ten years of pensionable service and would be attaining the age of fifty years, the amount of monthly pension payable to such employee shall be determined on the basis specified in Schedule-2.” 7. In the said scheme, for paragraph 15, the following paragraph shall be substituted, namely:- "15. Amount of pension. - An employee entitled for pension under the provisions of the pension scheme may make an application for pension in Form 'NEW SAHAJ', and shall draw the admissible amount of pension." 8. In the said scheme, paragraph 16 shall be omitted. 9. In the said scheme, for paragraph 17, the following paragraph shall be substituted, namely:- “17. Payment of outstanding benefits. - Where an employee dies in service or after attaining the age of sixty years and certain amounts accrued under the provisions of the scheme have not been paid, such amounts shall be paid in equal share to the surviving spouse or in case there is no spouse, to the surviving children in equal share, or where there is no spouse and children, to the nominee.”[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 10. In the said scheme, in paragraph 19,- (i) for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:- “(1) The Commissioner shall place before the Board each year a budget showing separately probable receipts and expenditure which is expected to be incurred therefrom during the year commencing on the first day of April of that year and the budget as approved by the Board shall be submitted for sanction to the Central Government within a period of one month of its being placed before the Board.” (ii) in sub-paragraph (3), the words “and the approval of Central Government shall also be obtained for the same before the expiration of the financial year” shall be omitted. 11. Explanatory Memorandum: Provisions in paragraph 15 of the Coal Mines Pension Scheme, 1998 were proposed and accepted for deletion by the Board of Trustees, Coal Mines Provident Fund Organisation in its 152nd meeting held on 13th December, 2010. The proposal for its notification was sent to the Ministry of Coal by the Coal Mines Provident Fund Organisation vide its letter number CPF/CP/116(7)/Gazette Notification/Vol-II/1372/11687, dated the 4th/5th March, 2011. Pending notification, the provisions under paragraph 15 of the Coal Mines Pension Scheme, 1998 were withdrawn by the Coal Mines Provident Fund Organisation vide its Administrative Office Order number 17 of 2011, dated the 4th March, 2011 and Circular number 18 of 2011, dated the 4th March, 2011, giving effect to the decision of the Board of Trustees. To give legal status to the Administrative Order in the present notification, withdrawal of benefits under paragraph 15 of the Coal Mines Pension Scheme, 1998 is effective retrospectively from 21st February, 2011. Such retrospective effect will have no adverse impact on the existing beneficiaries or pensioners.
