L.-33004/99 सी.जी.-डी.एल.-अ.-30112023-250323 CG-DxLx-xEG-I3D0H1x1x2x0 23-250323 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4866] नई दिल्ली, बुधवार, नवम्ब र 29, 2023/अग्रहायण 8, 1945 No. 4866] NEW DELHI, WEDNESDAY, NOVEMBER 29, 2023/AGRAHAYANA 8, 1945 कोयला मत्रं ालय अजधसचू ना नई दिल्ली, 29 नवम् बर, 2023 का.आ. 5082 (अ).— केन्‍दर ीय सरकार ने कोयला धारक क्षेत्र (अिजन और जवकास) अजधजनयम, 1957 (1957 का 20) (जिसे इसमें इसके पश् चात ् उक्त अजधजनयम कहा गया ह)ै की धारा 4 की उपधारा (1) के अधीन भारत सरकार के कोयला मंत्रालय द्वारा िारी भारत के रािपत्र, भाग 2, खण् ड 3, उपखण् ड (ii), तारीख 20 माच,ज 2023 में प्रकाजित अजधसूचना संख यांक का.आ. 1316(अ), तारीख 20 माचज, 2023 से उपाबद्ध अनुसूची में जवजनर्िजष् ट पररक्षेत्र की भूजम में जिसका माप 0.17 हक्े ट र (लगभग) या 0.42 एकड़ (लगभग) ह,ै कोयले का पूवेक्षण करन े के अपने आिय की सूचना िी थी; और केन्‍द रीय सरकार, का यह समाधान हो गया ह ैदक इस अजधसूचना से संलग्न अनुसूची म ें जवजनर्िजष्ट की गई उक्त भूजम के दकसी भाग में कोयला अजभप्राप् त ह; ै अत:, अब, केन्‍द रीय सरकार उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित् त िजक्त यों का प्रयोग करत े हुए, इसस े संलग्न अनुसूची म ें वर्णिंत 0.17 हक्े ट र (लगभग) या 0.42 एकड़ (लगभग) माप वाली भूजम के या उस पर सभी अजधकार का अिजन करन े के अपने आिय की सूचना िेती ह।ै रटप्प ण 1 : इस अजधसूचना के अधीन आने वाले क्षत्रे के रेखांक धारक संख यांक िीएम/िेएनआर/भूजम/2022- 23/सीबीए(सेक्िन-7)/65, तारीख 25 िलु ाई, 2023 का जनरीक्षण कलेक्ट र, जिला पजिम बद्धमज ान (पजिम बंगाल) के कायाजलय में अथवा कोयला जनयंत्रक, कोयला जनयंत्रक का संगठन, कोर-2, पाचं वीं मंजिल, स्ट्कोप मीनार, लक्ष्मी नगर, दिल्ली – 110092 के कायाजलय म ें अथवा जनििे क तकनीकी (पी एण्ड पी), ईस्ट्टन ज 7389 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] कोलफील् ्स जलजमटेड डाकघर दििेरगढ़, पजिम बद्धमज ान, पजिम बंगाल -713333 के कायाजलय म ें दकया िा सकता ह ै। रटप्प ण 2 : उपरोक्त अजधजनयम की उपधारा 8 के उपबंधों की ओर ध् यान आकृष्ट दकया िाता ह,ै जिसमें जनम्नजलजखत उपबंध ह ैं:- ‘’8. अिजन की बाबत् आपजिया.ं - (1) कोई व्यजक्त िो दकसी भूजम में, जिसकी बाबत धारा 7 के अधीन अजधसूचना िारी की गई ह,ै जहतबद्ध ह,ै अजधसूचना के जनकाल े िान े के तीस दिन के भीतर संपूण ज भूजम या उसके दकसी भाग या ऐसी भूजम के या उस पर दकन्‍दहीं अजधकारों का अिजन दकए िाने के बारे में आपजि कर सकेगा । स्ट् पष्ट ीकरण.-इस धारा के अथाजन्‍दतगजत यह आपजत् त नहीं मानी िाएगी, दक कोई व् यजक्त दकसी भूजम में कोयला उत् पािन के जलए स्ट् वय ं खनन संदियाएं करना चाहता ह ै और ऐसी संदियाएं केन्‍द रीय सरकार या दकसी अन्‍द य व् यजक्त द्वारा नहीं की िानी चाजहए। (2) उपधारा (1) के अधीन प्रत् येक आपजत् त सक्षम प्राजधकारी को जलजखत रूप म ें की िाएगी और सक्षम प्राजधकारी, आपजत् तकताज को स्ट् वयं सुन े िाने या दकसी जवजध व् यवसायी द्वारा सुनवाई का अवसर िेगा और ऐसी सभी आपजत् तयों को सुनने के पश् चात् और ऐसी अजतररक्त िांच, यदि कोई हो, करने के पश् चात् िो वह आवश् यक समझता ह,ै वह या तो धारा 7 की उपधारा (1) के अधीन अजधसूजचत भूजम के या ऐसी भूजम के या उस पर अजधकारों के संबंध में एक ररपोटज या ऐसी भूजम के जवजभन्‍द न टुकड़ों या ऐसी भूजम के या उस पर अजधकारों के संबंध में आपजत् तयों पर अपनी जसफाररिों और उसके द्वारा की गई कायजवाही के अजभलेख सजहत जवजभन्‍द न ररपोटज केन्‍द रीय सरकार को उसके जवजनश् चय के जलए िगे ा । (3) इस धारा के प्रयोिन के जलए वह व्यजक्त दकसी भूजम म ें जहतबद्ध समझा िाएगा िो प्रजतकर म ें जहत का िावा करने का हकिार होता, यदि भूजम या ऐसी भूजम के या उस पर अजधकार इस अजधजनयम के अधीन अर्िजत कर जलए िात े थ े ।‘’ रटप्प ण 3: केन्‍द रीय सरकार न े कोयला जनयंत्रक, कोयला जनयत्रं क का संगठन, कोर-2, 5वीं मंजिल, स्ट्कोप मीनार, लक्ष्मी नगर, दिल्ली-110 092 को उक्त अजधजनयम की धारा 3 के अधीन भारत के रािपत्र, भाग 2, खंड 3, उपखडं (ii) में तारीख 11 िून, 1983 में प्रकाजित की गयी अजधसूचना संख यांक का. आ. 2520, तारीख 27 मई, 1983 द्वारा सक्षम प्राजधकारी जनयुक्त दकया ह।ै अनसु चू ी कुमारडीही ब्लॉक और नाथ ज और सेंरल बंकोला ब्लॉक जिला पजिम बद्धमज ान, राज्य - पजिम बंगाल [ रेखांक धारक संखयाक िीएम/िेएनआर/भूजम/2022-23/सीबीए(सेक्िन-7)/65, तारीख 25 िुलाई, 2023 ] सभी अजधकार : िम सं. मौिा का नाम थाना ब्लॉक जिला क्षेत्र (हक्े टेयर रटप्पजणयां में ) 1. चकबनबहाल अंडाल अंडाल पजिम बद्धमज ान 0.17 हक्े टेयर भाग (लगभग) अजधेकाररता सं. Note 1 : The plan bearing number GM/JNR/LAND/2022-23/CBA(Sec-7)/65, dated the 25th July, 2023 of the area covered by this notification may be inspected at the office of the Collector, District Paschim Bardhaman (West Bengal ) or at the office of the Coal Controller, Coal Controller’s Organisation, Core-2, 5th Floor, Scope Minar, Delhi- 110 092 or at the Office of the Director Technical (P and P), Eastern Coalfields Limited, Sanctoria, Post Office, Dishergarh, District Paschim Bardhaman (West Bengal)– 713333. Note 2 : Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:— “8. Objection to acquisition.- (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Explanation.-It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operation in the land for the production of coal and that such operations should not be undertaken by the Central Government of any other person. (2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal petitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, the decision of that Government. (3) For purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation of the land or any rights in or over such land were acquired under this Act.” Note 3 : The Coal Controller, Coal Controller’s Organisation, Core-II, 5th Floor, Scope Minar, Delhi-110 092 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2520, dated the 27th May, 1983 published the Gazette of India, part II, section 3, sub-section (ii), dated the 11th June, 1983.
