L.-33004/99 सी.जी.-डी.एल.-अ.-24032023-244647 xxxGIDHxxx CG-DL-E-24032023-244647 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 1345] नई दिल्ली, बृहस्ट्प जतिार, माच च23, 2023/चत्रै 2, 1945 No. 1345] NEW DELHI, THURSDAY, MARCH 23, 2023/CHAITRA 2, 1945 कोयला मत्रं ालय अजधसचू ना नई दिल्ली, 23 माच,च 2023 का.आ. 1398(अ).—केन्‍द रीय सरकार न े कोयला धारक क्षत्रे (अिचन और जिकास) अजधजनयम, 1957 (1957 का 20) (जिस े इसम ें इसके पश् चात् उक्त अजधजनयम कहा गया ह)ै की धारा 4 की उपधारा (1) के अधीन िारी भारत सरकार के कोयला मंत्रालय की अजधसचू ना संख यांक का. आ. 2786(अ), तारीख 17 िून, 2022, िो भारत के रािपत्र, भाग II, खण् ड 3, उपखण् ड (ii), तारीख 17 िून, 2022 म ें प्रकाजित की गई थी, अजधसूचना स े उपाबद्ध अनुसूची म ें जिजनर्िचष् ट पररक्षेत्र की भूजम म ेंजिसका माप 729.84 हक्े ट र (लगभग) ह,ै कोयले का पूिेक्षण करने के अपने आिय की सूचना िी थी ; और केन्‍द रीय सरकार का यह समाधान हो गया ह ै दक इस अजधसूचना स े सलं ग् न अनुसूची म ें जिजनर्िचष्ट की गई उक्त भूजम के दकसी भाग म ें कोयला अजभप्राप्य ह;ै अत: अब, केन्‍दर ीय सरकार उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित् त िजक्त यों का प्रयोग करत े हुए, इससे संलग्न अनुसूची म ें यथािर्णिंत 666.273 हक्े टर (लगभग) या 1646.361 एकड़ (लगभग) माप िाली भूजम म ें या उस पर के सभी अजधकार का अिचन करन े के अपन े आिय की सूचना िेती ह;ै रटप्प ण 1: इस अजधसूचना के अधीन आन े िाले क्षत्रे के रेखांक धारक संख यांक पीओ/ बीबीएसआरआई/ सि/े 2022/695, तारीख 9 िनिरी, 2023 का जनरीक्षण कलेक्ट र, जिला अंगलु (ओजडिा) के कायाचलय म ें या कोयला 1937 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जनयंत्रक, कोयला जनयंत्रक का संगठन, कोयला मंत्रालय, कोर-2, 5िीं मंजिल, स्ट्कोप मीनार, लक्ष्मी नगर, दिल्ली- 110 092 के कायाचलय म ेंया जनिेिक (कार्मचक), महानिी कोलफील््स जलजमटेड, िागृजत जिहार, डाकघर िागृजत जिहार, बुलाच, जिला सम्बलपुर (ओजडिा) के कायाचलय म ेंदकया िा सकेगा। रटप्प ण 2: उक्त अजधजनयम की उपधारा 8 के उपबंधों की ओर ध् यान आकृष्ट दकया िाता ह,ै िो जनम्न जलजखत उपबंध करत े ह ैं:- “8. अिनच की बाबत् आक्षेप.- (1)कोई व् यजक्त िो दकसी ऐसी भूजम म,ें जिसकी बाबत् धारा 7 के अधीन कोई अजधसूचना िारी की गई ह,ै जहतबद्ध ह,ै अजधसूचना के िारी दकए िाने स े तीस दिन के भीतर सम् पूण च भूजम या उसके दकसी भाग या ऐसी भूजम म ें या उस पर के दकन्‍द हीं अजधकारों का अिचन दकए िाने के बारे म ें आक्षेप कर सकेगा । स्ट्पष्टीकरण.—इस धारा के अधीन इस े आक्षपे के रूप म ें नहीं माना िाएगा, दक कोई व् यजक्त यह कहता ह ै दक दकसी भूजम म ें कोयला उत् पािन के जलए िह स्ट् ियं खनन संदियाए ं करना चाहता ह ै और ऐसी संदियाए ं केन्‍द रीय सरकार या दकसी अन्‍द य व् यजक्त द्वारा नहीं करनी चाजहए। (2) उपधारा (1) के अधीन प्रत्य के आक्षेप सक्षम प्राजधकारी को जलजखत रूप म ें की िाएगी और सक्षम प्राजधकारी आक्षेपकता च को व्यजक्तगत या दकसी जिजध व् यिसायी के माध्यम स े सुनिाई का अिसर प्रिान करेगा और ऐसी सभी आक्षेपों की सुनिाई करन े और ऐसी अजतररक् त िांच, यदि कोई हो, करने के पश् चात ् िो िह आिश्य क समझे या तो धारा 7 की उपधारा (1) के अधीन अजधसूजचत की गई भूजम के या ऐसी भूजम म ें या उस पर के अजधकारों के संबंध म ें कोई ररपोटच या ऐसी भूजम के जिजभन्‍द न टुकड़ों या ऐसी भूजम म ें या उस पर के अजधकारों के संबंध म ें जिजभन्न ररपोटच जिसम ें उसके द्वारा की गई कायचिाही के अजभलेख सजहत, आपजियों पर अपनी जसफाररिों की अन्‍दतगचजिष्ट ह,ैं केन्‍द रीय सरकार को उसके जिजनश् चय के जलए िगे ा । (3) इस धारा के प्रयोिनों के जलए, कोई व् यजक्त भूजम म ें जहतबद्ध समझा िाएगा िो प्रजतकर म ें दकसी जहत का िािा करने का हकिार हो, यदि दकसी भूजम या ऐसी भूजम म ें या उस पर के अजधकार इस अजधजनयम के अधीन अर्िचत कर जलए गए थे। ‘’ रटप्प ण 3: केन्‍दर ीय सरकार ने कोयला जनयंत्रक, कोयला जनयत्रं क का संगठन, कोयला मंत्रालय, कोर-2, 5िीं मंजिल, स्ट्कोप मीनार, लक्ष्मी नगर, दिल्ली-110 092 को उक्त अजधजनयम की धारा 3 के अधीन अजधसूचना संख या का. आ. 2015, तारीख 10 िलु ाई, 1995, िो भारत के रािपत्र, भाग II, खडं 3, उपखडं (ii) म ें तारीख 22 िलु ाई, 1995 को प्रकाजित की गयी थी, द्वारा सक्षम प्राजधकारी के रूप म ें जनयुक्त दकया ह।ै अनसु चू ी भुबनश्वे री ओपनकास्ट्ट जिस्ट्तार पररयोिना भुबनेश्वरी, अरखपाल 'ए' और साखीगोपाल 'ए' कोयला ब्लॉक का भाग जिला अगं ुल, राज्य - : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF COAL NOTIFICATION New Delhi, the 23rd March, 2023 S.O. 1398(E).—Whereas by the notification of the Government of India in the Ministry of Coal, S.O. 2786(E), dated the 17th June, 2022 issued under sub-section (1) of section-4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 ( 20 of 1957) (hereinafter referred to as the said Act), published in Gazette of India, part II, Section 3, sub-section(ii), dated the 17th June,2022, the Central Government gave notice of its intention to prospect for coal in 729.84 hectares (approximately) of the lands in the locality specified in the Schedule annexed to that notification; And, whereas the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 666.273 hectares (approximately) or 1646.361 (approximately) and all rights in or over the said land as described in the Schedule appended hereto; Note 1: The plan bearing number PO/BBSRI/SURVEY/2022/695, dated the 9th January, 2023 of the area covered by this notification may be inspected at the office of the Collector, District Angul (Odisha) or at the office of the Coal Controller, Coal Controller’s Organisation, Ministry of Coal, Core-II, 5th Floor, Scope Minar, Laxmi Nagar, Delhi-110 092 or at the office of the Director (Personnel), Mahanadi Coalfields Limited, Jagruti Vihar, Post Office Jagruti Vihar, Burla, District Sambalpur (Odisha). Note 2: Attention is hereby invited to the provisions of section 8 of the said Act, which provide as follows:- “8. Objections to acquisition.- (1) Any person interested in land in respect of which a notification under section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or of any rights in or over such land. Explanation.- It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operation in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub -section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections after making such further inquiry , if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government , containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of that Government.
