की धारा 13 द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, केंद्र सरकार खजनज ररयायत जनयम, 1960 म ें और संिोधन करन े के
जलए एतद्द्वारा जनम्नजलजखत जनयम बनाती ह,ै अथाात:्-
1. संजिप्त नाम और प्रारंभ- (1) इन जनयमों को खजनज ररयायत (संिोधन) जनयम, कहा जा सकता ह।ै
(2) िे भारत के राजपत्र म ें उनके प्रकािन की तारीख से लाग ूहोंगे।
2. खजनज ररयायत जनयम,1960 में (इसके बाद मलू जनयम के रुप में जाना जाता ह)ै , जनयम 64 क में-
(i) िब्द ‘’चौबीस प्रजतित‘’ के स्ट्थान पर ‘’बारह प्रजतित’’ िब्द प्रजतस्ट्थाजपत दकए जाएग ें
(ii) िब्द ‘’का साठिां ददन‘’ का लोप कर ददया जाएगा।
3. मूल जनयम म,ें जनयम 64ख म,ें पहले परंतुक के बाद, जनम्नजलजखत परंतुक अंत: स्ट्थाजपत दकया जाएगा, अथाात्:-
बित े दक पहल े परंतुक के तहत भुगतान की गई कोई भी रॉयल्टी जनम्नजलजखत के आधार पर समायोजन के अधीन
होगी-
(क) नमूना लने े के बाद रन -ऑफ - माइन कोयल े या जलग्नाइट के ग्रडे की अंजतम घोषणा, अथिा

(ख) प्रेषण या उपभोग की तारीख पर, जैसा लाग ू हो, कोयला ग्रडे या राष्ट्रीय जलग्नाइट सूचकांक की प्रासंजगक
बॉस्ट्केट के राष्ट्रीय कोयला सूचकांक की अंजतम घोषणा,
जैसा भी मामला हो, और पदाृकत्ताा को कम से कम रॉयल्टी का भुगतान या पट्टेदार को अजतररि रॉयल्टी की
िापसी ऐसे समायोजन के आधार पर की जाएगी।"

42, 44 से 51, जनयम 62 का उप-जनयम (1), जनयमों 66, 66क और 72 का उल्लघं न करता ह,ै तो उस पर दो
साल तक के कारािास या पाचं लाख रुपये तक के जुमाान े अथिा दोनों के साथ दंजडत दकया जा सकता ह ै और
लगातार उल्लघं न के मामले म,ें यदद ऐसे उल्लंघन के जलए दोषी ठहराए जाने के बाद भी ऐसा उल्लंघन जारी
रहता ह ैतो अजतररि जुमााना लगाया जा सकता ह ैजो प्रत्येक ददन के जलए पचास हजार रुपय ेतक हो सकता ह।ै ”
(2) कोई भी व्यजि जो जनयमों 20,21ख, जनयम 22ख के उपजनयम (1), (2), (4), (5) और (6), जनयमों 32,
33, 37क और 40ख, जनयम 40ङ के उप-जनयम (1) के दसू रे परंतुक, जनयम 61, और 64क का उल्लघं न करता ह,ै
तो उस पर पांच लाख रुपय े तक दंड लगाया जा सकता ह,ै और लगातार उल्लंघन के मामले में, यदद ऐसे उल्लंघन
के जलए दोषी ठहराए जान े के बाद भी ऐसा उल्लंघन जारी रहता है तो अजतररि जुमााना लगाया जा सकता ह ै जो
प्रत्येक ददन के जलए पचास हजार रू. तक हो सकता ह।ै ”

NOTIFICATION
New Delhi, the 7th September, 2022
G.S.R. 684(E).⸺In exercise of powers conferred by section 13 of the Mines and Minerals (Development and
Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules further to amend the
Mineral Concession Rules, 1960, namely:—
1. Short title and commencement.⸺(1) These rules may be called the Mineral Concession (Amendment)
Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Mineral Concession Rules, 1960 (hereinafter referred to as principal rules), in rule 64A,⸺
(i) for the words “twenty four per cent”, the words “twelve per cent.” shall be substituted;
(ii) the words “the sixtieth day of” shall be omitted.
3. In the principal rules, in rule 64B, after the first proviso, the following proviso shall be inserted, namely:—[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3
“Provided further that any royalty paid under the first proviso shall be subject to adjustment on the basis of-
(a) final declaration of the grade of run-of-mine coal or lignite after sampling; or
(b) final declaration of the National Coal Index of the relevant basket of coal grade or National Lignite
Index, as applicable, on the date of dispatch or consumption,
as the case may be, and payment of shortfall royalty to the lessor or refund of additional royalty to the
lessee shall be made based on such adjustment.”.
4. In the principal rules, for CHAPTER XI, the following CHAPTER shall be substituted, namely:—
“CHAPTER XI
Penalty
76. Penalty.- (1) Any person who contravenes sub rules (1),(2) and (3) of rule 7, sub-rules (1), (2) and (3) of
rule 14, sub-rules(1) and (2) of rule 16, rules 18, 19, 22A, sub-rule (1) of rule 22 (E), rule 22F, sub-rules (1),
(2) and (3) of rule 27, rules 27A and 29A, sub-rule(1) of rule 37, rules 40D, 42, 44 to 51, sub-rule (1) of rule
62, rules 66, 66A and 72 shall be punishable with imprisonment for a term which may extend to two years or
with fine which may extend to five lakh rupees, or with both, and in the case of continuing contravention,
with additional fine which may extend to fifty thousand rupees for every day during which such
contravention continues after conviction for such contravention.
(2) Any person who contravenes rules 20, 21B, sub-rules (1), (2), (4), (5) and (6) of rule 22B, rules 32, 33,
37A and 40B, second proviso to sub-rule (1) of rule 40E, rules61 and 64Ashall be punishable with fine which
may extend to five lakhs rupees, and in the case of a continuing contravention, with additional fine which
may extend to fifty thousand rupees for every day during which such contravention continues after conviction
for such contravention.”.
