का.आ. 1394(अ).—केन्द्रीय सरकार ने कोयला धारक क्षेत्र (अिचन और जिकास) अजधजनयम, 1957 (1957 का 20) (जिस े इसमें इसके पश्चात ् उक्त अजधजनयम कहा गया ह)ै की धारा 4 की उप-धारा (1) के अधीन भारत सरकार के कोयला मंत्रालय द्वारा िारी की गई अजधसूचना संखयांक का.आ. 2151(अ), तारीख 09 मई, 2023, िो भारत के रािपत्र, असाधारण, भाग 2, खण्ड 3, उप-खण्ड (ii), तारीख 10 मई, 2023 में प्रकाजित की गई थी, उस अजधसूचना स े उपाबद्ध अनुसूची म ें जिजनर्िष्टच पररक्षेत्र की भूजम म ें जिसका माप 350.68 हक्े टेयर (लगभग) या 866.16 एकड़ (लगभग) ह,ै कोयल े का पूिेक्षण करने के अपने आिय की सूचना िी थी; और, केन्द्रीय सरकार का यह समाधान हो गया है दक इस अजधसूचना से संलग्न अनुसचु ी में जिजनर्िष्टच उक्त भूजम के भाग में कोयला अजभप्राप्य ह;ै अतः, अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 7 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, इससे संलग्न अनुसूची म ें यथा जिजनर्िष्टच 350.68 हक्े टेयर (लगभग) या 866.16 एकड़ (लगभग) माप िाली भूजम का या उक्त भूजम में के या उस पर के सभी अजधकारों का अिचन करन ेके अपन ेआिय की सूचना िेती है; पतरात,ु जिला रामगढ़-829119, झारखण्ड के कायाचलय म ेंदकया िा सकता ह।ैं रटप्पण 2: उक्त अजधजनयम की धारा 8 के उपबंधों की ओर ध्यान आकृष्ट दकया िाता है, जिसमें जनम्नजलजखत उपबंध हःै - ’’8. अिचन के संबंध म ें आपजत्त.- (1) कोई व्यजक्त िो दकसी ऐसी भूजम म,ें जिसके संबंध में धारा 7 के अधीन अजधसूचना िारी की गई ह,ै जहतबद्ध ह,ै अजधसूचना के िारी दकए िान े से तीस दिन के भीतर सम्पूण च भूजम या उसके दकसी भाग या ऐसी भूजम में के या उस पर के दकन्द्हीं अजधकारों का अिचन दकए िाने के बारे में आपजत्त कर सकेगा। स्ट्पष्टीकरण.- इस धारा के अथान्द्च तगतच यह आपजत्त नहीं मानी िाएगी, दक कोई व्यजक्त दकसी भूजम में कोयला उत्पािन के जलए स्ट्ियं खनन संदक्रयाएं करना चाहता ह ै और ऐसी संदक्रयाएं केन्द्रीय सरकार या दकसी अन्द्य व्यजक्त द्वारा नहीं की िानी चाजहए। (2) उप-धारा (1) के अधीन प्रत्येक आपजत्त, सक्षम प्राजधकारी को जलजखत म ें की िाएगी और सक्षम प्राजधकारी, आपजत्तकताच को स्ट्िय ं सुन े िान े या जिजध व्यिसायी द्वारा सुनिाई का अिसर िगे ा और ऐसी सभी आपजत्तयों को सुनने के पश्चात् और ऐसी अजतररक्त िांच, यदि कोई हो, करने के पश्चात् िो िह आिश्यक समझ्ता ह,ै िह या तो धारा 7 की उप- धारा (1) के अधीन अजधसूजचत भूजम के या ऐसी भूजम म ें के या उस पर के अजधकारों के संबंध म ें एक ररपोट च या ऐसी भूजम के जिजभन्न टुकडों या ऐसी भूजम में के या उस पर के अजधकारों के संबंध म ें आपजत्तयों पर अपनी जसफाररिों को अन्द्तर्िचष्ट करते हुए और उसके द्वारा की गई कायचिाजहयों के अजभलेख सजहत जिजभन्न ररपोटों को केन्द्रीय सरकार को उसके जिजनश्चय के जलए िगे ा । (3) इस धारा के प्रयोिन के जलए िह व्यजक्त दकसी भूजम में जहतबद्ध समझा िाएगा िो प्रजतकर में जहत का िािा करन े का हकिार होगा, यदि भूजम या ऐसी भूजम में के या उस पर के अजधकार इस अजधजनयम के अधीन अर्िचत कर पजत, संयक्ु त सजचि MINISTRY OF COAL NOTIFICATION New Delhi, the 15th March, 2024 S.O. 1394(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.O. 2151(E), dated the 9th May, 2023, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 10th May, 2023, the Central Government gave notice of its intention to prospect for coal in 350.68 hectares (approximately) or 866.16 acres (approximately) of the land in the locality specified in the Schedule annexed to that notification; And whereas, the Central Government is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification; Now, therefore, in exercise of powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 350.68 hectares (approximately) or 866.16 acres (approximately) and all rights in or over the said land as specified in the Schedule appended hereto; Note1: The plan bearing number PVUNL/BAN/P3/SEC-7(1), dated the 28th August, 2023, the area covered by this notification may be inspected in the office of Objection to acquisition.- (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land. Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of right in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of the Government. (3) For the purpose of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act”.
