बरगि,िीिम, अिुयन एवं अन्य िेिी प्रिाजतया ाँ का एनटीपीसी बिरपुर (5.14 ि्े टेयर) म ें दकया िाएगा। उपभोगी संस्ट्था द्वारा पररयोिना स्ट्थल से 487वृक्षों का प्रत्यारोपण घाटा मजस्ट्िि पाकय (397 वृक्ष) (ख) प्लाट संख्या-30 िारा सुखोि रोड (90 वृक्ष)में स्ट्वयं की लागत पर दकया िाएगा। जनयम एव ंित ें 1. केंद्रीय लोक जनमाणय जवभाग, िो दक उपभोगी संस्ट्था के रूप में संिर्भयत ि,ै को सात वर्षों की अवजध के जलए पौधों के सम्पूणय जवकास एव ं रखरखाव िते ु उपरोिानुसार 2,77,59,000/-रुपय े िो करोड़ सत्तर सात लाख उनतालीस ििार मात्र @ रु. 57000/- प्रजत वृक्ष) की राजि अजिम रूप से िमा करवानी िोगी और यदि उपभोगी संस्ट्था द्वारा 2, 3 और 4 में उजल्लजखत जनयमों और ितों का पालन निीं दकया िाता िै, तो इस राजि को िब्त कर जलया िाएगा और इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए उपयोग दकया िाएगा । 2. उपभोगी सस्ट्ं था द्वारा वक्षृ ोंकी कटाई/ प्रत्यारोपण िरूु करन ेस ेपिल ेजनम्नजलजखत ितों को परू ा दकया िाएगा:- a. दिल्ली वृक्ष laj{k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में उपभोगी संस्ट्था द्वारा सबं ंजधत वृक्ष अजधकारी को जवस्ट्तृत वृक्षारोपण काययक्रम प्रस्ट्ततु प्रस्ट्तुत दकया िाएगा ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 b. उपभोगी संस्ट्था द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा । c. उपभोगी संस्ट्था केद्वारा यि सुजनजित दकया िायगे ा दक वृक्षो की कटाई/ प्रत्यारोपण स े पूवय कोई लंजबत मुकिमेबािी या स्ट्थगन आििे दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो। d. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायय सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा। e. उपभोगी संस्ट्था के द्वारा वन मंिूरी म ें और अन्य मंिूरी म ें उजल्लजखत सभी ितों ितों, यदि कोई िो, का जनष्ठापूवयक पालन दकया िाएगा । 3. वक्षृ ों की कटाई/ प्रत्यारोपण के िौरान जनम्नजलजखत ितों को परू ा दकया िाएगा:- a. क्र.स.ं 2 में ितों के संतुष्ट िोन े के तुरंत बाि उपभोगी संस्ट्था द्वारा वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इस े छ: मिीने के अतं राल म ें पणू य दकया िाएगा ।प्रत्यारोपण प्रदक्रया के पणू य िोन े का बाि एक सम्पूणय ररपोटय संबजन्धत वृक्ष अजधकारी को प्रस्ट्ततु की िायेगी । प्रत्यारोपण स्ट्थल म े प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु स े कम निीं िोनी चाजिए । b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा । c. प्रजतरोपण/कटाई की प्रगजत ररपोटय जनरीक्षण अजधकारी के माध्यम से संबंजधत वृक्ष अजधकारी को वृक्षों के पणू य जववरण के साथ प्रस्ट्ततु की िाएगी। d. यदि दकसी वृक्ष म ें पजक्षयों का घोंसला पाया िाता ि ै तो उस े तब तक निीं काटा/ प्रत्यारोपण दकया िाएगा िब तक दक पक्षी उसे छोड़ न िें। e. उपभोगी संस्ट्था द्वारा 487वृक्षो के अलावा दकसी भी वृक्ष की कटाई/प्रत्यारोपण दिल्ली वक्षृ laj{k.k अजधजनयम, 1994 के अन्तगयत एक अपराध िोगा। f. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धन राजि को सरकार के खाते म ेरािस्ट्व के रूप म ेंिमा की िाएगी। g. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं को काटे िाने केउपरान्त प्राप्त लकजड़यों को मुफ्त में जनकटतम सावयिजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सचू ना वृक्ष अजधकारी (पजिम) को भी िी िाएगी। h. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के स्ट्थल से लकजड़यों को को ले िाने से पूवय वृक्ष अजधकारी (पजिम) स े ढुलाई अनुमजत प्राप्त करनी िोगी। i. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावयिजनक श्मिान म े 90 दिनों के अंिर परू ा दकया िाएगा । j. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तयत निीं दकया िाएगा । k. उपभोगी संस्ट्था के द्वारा वनमिं ूरी में और अन्य मंिूरी में उजल्लजखत सभी ितों ितों, यदि कोई िो, का जनष्ठापूवयक पालन दकया िाएगा । l. उपभोगी संस्ट्था के द्वारा अनुमोदित वृक्ष संरक्षण योिना के अतं गयत प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठा पूवयक पालन दकया िाएगा । m. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िाएगा दक वृक्षप्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के अंतगयत सभी प्रावधानों का जनष्ठा पूवयक पालन दकया गया ि ै और इसका जववरण संबंजधत वृक्ष अजधकारी को प्रस्ट्तुत दकया िाएगा । n. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट ऊंचाई और कम से कम 6 इंच व्यास वाल े स्ट्वििे ी वृक्ष प्रिाजतयों म ें िीजवत निीं रि पाते ि,ैं तो उन्ि ें 1:5 के अनपु ात म ें लगाया िाएगा । आवश्यक अजतररि भजू म उपभोगी संस्ट्था द्वारा प्रिान की िाएगीऔर वृक्षारोपण स्ट्वय ंकी लागत पर दकया िाएगा।4 DELHI GAZETTE : EXTRAORDINARY PART IV] 4. वक्षृ अजधकारी द्वारा सफल वक्षृ ारोपण और िमानत राजि िारी करन े पर जवचार करन े के जलए जनम्नजलजखत ितों को परू ा दकया िाएगा: a. उपरोि ताजलका 1 (क) और (ख) के अनुसार, िेिी प्रिाजतयों के 4870 पौधो का 100 % प्रजत पूरक वृक्षारोपण और उनका सात वर्षो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगा A इस वृक्षारोपण के सफलता पूवयक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी। b. 487 वृक्षो के प्रत्यारोपण/ काटे दकए िाने के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 4870 पौधो का प्रजतपरू क वृक्षारोपण गरै -वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोन े के तीन मिीने के अंिर जनधायररत की गई भूजम पर अजतररि उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वर्षों के जलए रखरखाव तथा उसके बाि उनका रखरखाव उपभोगी संस्ट्था द्वाराअपनी स्ट्वयं की लागत पर दकया िाएगा । c. िो भूजम प्रजतपरू क वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकारकी स्ट्वीकृजत के जबना निीं दकया िाएगा। d. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार को जनधायररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षय के अतं में वृक्ष अजधकारी ¼पजिम½ कोप्रस्ट्तुत की िाएगी। e. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वक्षृ ारोपण के जलए प्रस्ट्ताजवत क्षत्रे में कोई अजतक्रमण न िो। f. उपभोगी संस्ट्था द्वारा प्रजतपरू क वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण कायय की गजतजवजधयों को दकया िाएगा। g. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तयत निीं दकया िाएगा । 5. 487 वृक्षो को प्रत्यारोपण/ काटनेके जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजि के िाव े के पक्षपात के जबना, िो वृक्षो और भूजम पर सिी िो सकती ि,ै िी िा रिी ि ै। यि माननीय पयायवरण एव ं वन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के पूवय अनुमोिन से िारी दकया िाता ि।ै संिय गोयल, प्रधान सजचव (पयायवरण No. 161/WFD/COT/2021-22/dcfpm/57-64.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of8.1747 ha approx.for construction of Executive Enclave in Plot no 36 and 38 and Hon’ble Prime Minister Residence in Plot A and B, New Delhifrom the provision of sub-section (3) of section 9 of the said Act. Total 807 320 487 Nil 487 4870 The said exemption is subject to fulfillment of the following conditions:- Sl. Location of Compensatory plantation. (1) (2) (3) (4) (5) (a) 100% Compensatory Plantation ten times the number of trees permitted for transplantation of 487 no. of trees i.e number of tree saplings proposed to be Deputy 4870 2,77,59,000/- planted of species Neem, Amaltas, Peepal, Conservator of Pilkhan, Gular, Bargad, DesiKikar along Forests with other native species shall be carried (West)/ out by User Agency at NTPC Badarpur. Tree Officer (5.14 ha). (b) Transplantation of 487 no. of trees which are standing on site shall be done by User Agency at Ghata Masjid Park (397 trees) and Plot no 30, Dara Sukhoh road, behind DRDO (90 trees)with their own funds. TERMS & CONDITIONS 1. Central Public Works Department (CPWD) herein referred to as User Agency, shall make an advance deposit of an amount of Rs. 2,77,59,000/- (rupees Two Crore Seventy Seven Lakh Fifty Nine Thousand Only @ Rs. 57000/- per tree) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency. 2. The following conditions shall be fulfilled before starting transplantation of trees by User Agency: a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer in compliance with Section-12 of Delhi Preservation of Trees Act, 1994. b. User Agency shall submit a detailed plan for site preparation and plantation. c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees. d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be obtained by the User Agency. e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other clearances, if any obtained, shall be followed scrupulously. 3. The following conditions shall be fulfilled during the transplantation of trees: a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and should be completed not later than six (06) months of such date, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. b. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency. c. The progress report of transplantation shall be submitted through inspection officer to concerned Tree Officer along with complete details of trees. d. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by the birds. e. Transplantation/felling of any tree apart from 487 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994.6 DELHI GAZETTE : EXTRAORDINARY PART IV] f. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. g. The lops& tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same should be reported to DCF (West) by User Agency. h. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (West) by User Agency. i. Transplantation of trees and transportation of forest produce arising there from to the public crematorium shall be completed within 90 days. j. The User Agency shall ensure that the plan of this proposal shall not be changed. k. It must be ensured by the User Agency that all the conditions mentioned in forest clearance and other clearances, if any obtained, shall be followed scrupulously. l. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously. m. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy 2020 have been followed and details of the same should be submitted to Tree Officer concerned. n. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by User Agency & plantation has to be done at own cost. 4. The following conditions shall be fulfilled for considering successful plantation & release of Security Deposit by the Tree officer: a. 100% Compensatory Plantation of 4870 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment. b. 4870 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of felling/ transplantation 487 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits). d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other purpose without the approval of the State Government. e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Govt. of NCT of Delhi and a copy of the same shall be submitted to the Tree Officer (West) at the end of every financial year. f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation/ transplantation. g. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site. h. The User Agency shall ensure that the plan of this proposal shall not be changed. 5. Permission for transplantation of 487 nos. of trees is being granted to the User Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or the trees.
