रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के िाि उपभोगी संस्ट्था द्वारा जनगरानी की
िाएगी A
3. 57 वृक्षों को प्रत्यारोपण दकए िाने के ििले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 570 पौधों का प्रजतपूरक
वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के छ: मिीन े के अंिर जनधााररत की गई भूजम पर
अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और उनका सात वर्षों तक
रखरखाव उपभोगी संस्ट्था द्वारा अपने स्ट्वयं के धन से दकया िाएगा ।
4. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ि,ै उसका उपयोग दकसी अन्य कायों के जलए राज्य सरकार की स्ट्वीकृजत के जिना निीं
दकया िाएगा।
5. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनपु ालन में वृक्ष अजधकारी
¼पजिम½ को प्रस्ट्तुत दकया िाएगा ।
6. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधााररत करेंगी और
इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में प्रस्ट्तुत की िाएगी ।
7. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा ।
8. अनुमजत िारी िोन े के तुरंत िाि वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे तीन मिीने के अंतराल में पूणा दकया िाएगा ।
प्रत्यारोपण प्रदक्रया के पूणा िोने का िाि एक सम्पूणा ररपोटा संिजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल में
प्रत्यारोजपत वृक्षों की िरू ी 4 मीटर (बिंि ुसे बिंि)ु से कम निीं िोनी चाजिए ।
9. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
10. वृक्षों के प्रत्यारोपण की अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजक्त के िावे के पक्षपात के जिना, िो वृक्षों और भूजम पर
सिी िो सकती ि,ै िी िा रिी ि ै।
11. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक वृक्षों के प्रत्यारोपण से पूवा कोई लंजित मुकिमेिािी या स्ट्थगन आिेि दकसी भी
न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो ।
12. उपभोगी संस्ट्था द्वारा वृक्षों को प्रत्यारोपण का काया सभी वैधाजनक मंिूररयों को लेने के िाि िी िुरू दकया िाएगा ।
13. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संिंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
िाएगी ।
14. उपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण और उसमें पैिा िोने वाली वन उपि को सावािजनक मिान मे 90 दिनों के अंिर पूरा दकया

15. उपभोगी संस्ट्था द्वारा 57 वृक्षों के अलावा दकसी भी वृक्ष का प्रत्यारोपण/ कटाई दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 के अंतगात एक
अपराध िोगा ।
16. उपभोगी संस्ट्था के द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िाएगा ।

F. No. 34/WFD/COT/18-19/4857-65.—In exercise of the powers conferred by section 29 of the Delhi
Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 2.4014 ha. (approx.) as detailed below for construction of 100 bedded
Hospital at Rural Health Training Centre, Najafgarh, Delhi, from the provision of sub-section (3) of section 9 of the
said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. Ministry of Health & Family Welfare, Rural Health Training Center, Govt. of India, Najafgarh, Del herein
referred to as User Agency, shall make an advance deposit of an amount of Rs. 32,49,000/- (Rs. Thirty Two
Lakh Forty Nine Thousand only) towards security deposit for creation and maintenance of compensatory
plantation for a period of Seven years as follows,

(b) Transplantation of 57 no. of trees which are standing on site shall be done by User Agency at suitable vacant
land within the same project site with their own funds.
2. 100% Compensatory Plantation of 570 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.4 DELHI GAZETTE : EXTRAORDINARY PART IV]
3. 570 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of
1:10 on non-forest land in lieu of transplantation of 57 no. of trees. The plantation shall be done by following
site specific plantation techniques with additional measures on identified land within six months of issue of
tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User
Agency with their own funds.
4. The land over which compensatory plantation raised shall not be utilized for any other purpose without the
approval of the State Government.
5. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of
Delhi Preservation of Trees Act, 1994 before initiating felling/ transplantation.
6. User Agency shall maintain plantation journal as prescribed by Department of Forests and Wildlife, Govt. of
NCT of Delhi and submit a copy of same at end of each financial year.
7. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation / transplantation site.
8. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than three (03) months, after which a completion report has to be submitted to the Tree Officer. The
spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
9. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
10. Permission for transplantation of all tress is being granted at their own risk and without prejudice to the claim
(s) of any other person/s who may be having any rights(s) over the land or the trees.
11. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking transplantation of trees.
12. Before the transplantation of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
13. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
14. Transplantation of trees and transportation of forest produce arising threfrom to the public crematorium shall
be completed within 90 days.
15. Transplantation/ felling of any tree apart from 57 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
16. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any
obtained, shall be followed scrupulously.
