जनयम एव ंित ें
1. पररविन जवभाग, िो दक उपभोगी संस्ट्था के रूप म ें संिर्भात िै, को सात वर्षोंकी अवजध के जलए पौधों के सम्पूण ा
जवकास एवं रिरिाव िते ु उपरोिानुसार 1,35,66,000/- रुपय े (एक करोड पतैं ीस लाि जछयासठ ििार मात्र
@ रु. 57000/- प्रजत वृक्ष) की राजि अजिम रूप से िमा करवानी िोगी और यदि उपभोगी संस्ट्था द्वारा 2, 3 और
4 में उजल्लजित जनयमों और ितों का पालन निीं दकया िाता िै, तो इस राजि को िब्त कर जलया िाएगा और
इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए उपयोग दकया िाएगा ।
2. उपभोगी सस्ट्ं था द्वारा वक्षृ ों की कटाई/ प्रत्यारोपण िरूु करन ेस ेपिल ेजनम्नजलजित ितों को परू ा दकया िाएगा:-
a. दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 की धारा 12 के अनुपालन में उपभोगी संस्ट्था द्वारा सबं ंजधत वृक्ष
अजधकारी को जवस्ट्तृत वृक्षारोपण कायाक्रम प्रस्ट्तुत प्रस्ट्तुत दकया िाएगा ।
b. उपभोगी संस्ट्था द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्ततृ योिना प्रस्ट्तुत दकया
िाएगा ।
c. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िायगे ा दक वृक्षो की कटाई/प्रत्यारोपण से पूव ा कोई लंजबत
मकु िमेबािी या स्ट्थगन आिेि दकसी भी न्यायालय/अन्य प्राजधकरण द्वारा पाररत न हुआ िो।
d. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/प्रत्यारोपण का काया सभी वैधाजनक मंिूररयों को लने े के बाि िी
िुरू दकया िाएगा।
e. उपभोगी संस्ट्था के द्वारा वन मंिूरी में और अन्य मंिूरी म ें उजल्लजित सभी ितों ितों, यदि कोई िो, का

3. वक्षृ ों की कटाई/प्रत्यारोपण के िौरान जनम्नजलजित ितों को परू ा दकया िाएगा:-
a. क्र.स.ं 2 में ितों के संतष्टु िोन े के तुरंत बाि उपभोगी सस्ट्ं था द्वारा वृक्षो का प्रत्यारोपण िुरू दकया िाएगा
और इसे छ: मिीने के अंतराल में पूण ा दकया िाएगा। प्रत्यारोपण प्रदक्रया के पणू ा िोन े का बाि एक सम्पूण ा
ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी। प्रत्यारोपण स्ट्थल म े प्रत्यारोजपत वृक्षों की िरू ी 4
मीटर (बबंि ुस ेबबंि)ु से कम निीं िोनी चाजिए ।
b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 म ेंउजल्लजित सभी ितों का पालन दकया िाएगा ।
c. उपभोगी संस्ट्था द्वारा 04 वृक्षों को काटन े से पूव ा प्रत्यारोपण दकया िाएगा। 04 वृक्षों की अनमु जत 234
वृक्षों के सफल प्रत्यारोपण और उप-वन संरक्षक (केंद्रीय) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करन े के बाि िी
िायेगी।
d. प्रजतरोपण/कटाई की प्रगजत ररपोटा जनरीक्षण अजधकारी के माध्यम से संबंजधत वृक्ष अजधकारी को वृक्षों के
पूणा जववरण के साथ प्रस्ट्तुत की िाएगी।
e. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ै तो उसे तब तक निीं काटा/प्रत्यारोपण दकया
िाएगा िब तक दक पक्षी उस ेछोड न िें।
f. उपभोगी संस्ट्था द्वारा 238 वृक्षो के अलावा दकसी भी वृक्ष की कटाई/प्रत्यारोपण दिल्ली वृक्ष संरक्षण
अजधजनयम, 1994 के अन्तगता एक अपराध िोगा।
g. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजडयों की नीलामी की िाएगी और उससे
प्राप्त धन राजि को सरकार के िाते मे रािस्ट्व के रूप म ेंिमा की िाएगी।
h. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िािाओं को काटे िाने के उपरान्त प्राप्त लकजडयों को मुफ्त म ें
जनकटतम सावािजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (केंद्रीय) को
भी िी िाएगी।
i. उपभोगी संस्ट्था द्वारा वृक्षों को िटाए िाने के स्ट्थल से लकजडयों को ल े िान े से पूव ा वृक्ष अजधकारी
(िजक्षण) से ढुलाई अनुमजत प्राप्त करनी िोगी।
j. उपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण/ कटाई और उसमें पैिा िोन े वाली वन उपि को सावािजनक
िमिान म े90 दिनों के अंिर परू ा दकया िाएगा ।
k. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं
दकया िाएगा ।
l. उपभोगी संस्ट्था के द्वारा वन मिं ूरी में और अन्य मंिूरी म ें उजल्लजित सभी ितों ितों, यदि कोई िो, का
जनष्ठापूवाक पालन दकया िाएगा ।
m. उपभोगी संस्ट्था के द्वारा अनमु ोदित वृक्ष सरं क्षण योिना के अंतगात प्रस्ट्तुत सभी गजतजवजधयों का
जनष्ठापूवाक पालन दकया िाएगा ।
n. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4
(6-बी) के अंतगात सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया ि ै और इसका जववरण संबंजधत वृक्ष
अजधकारी को प्रस्ट्तुत दकया िाएगा ।
o. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट
ऊंचाई और कम से कम 6 इंच व्यास वाले स्ट्विेिी वृक्ष प्रिाजतयों में िीजवत निीं रि पाते ि,ैं तो उन्ि ें1:5
के अनुपात में लगाया िाएगा। आवश्यक अजतररि भूजम उपभोगी संस्ट्था द्वारा प्रिान की िाएगी और
वृक्षारोपण स्ट्वय ंकी लागत पर दकया िाएगा।4 DELHI GAZETTE : EXTRAORDINARY PART IV]
4. वक्षृ अजधकारी द्वारा सफल वक्षृ ारोपण और िमानत राजि िारी करने पर जवचार करन े के जलए जनम्नजलजित ितों
को परू ा दकया िाएगा:
a. उपरोि ताजलका 1 (क) और (ि) के अनुसार, िेिी प्रिाजतयों के 2380 पौधो का 100% प्रजतपूरक
वृक्षारोपण और उनका सात वर्षो तक रिरिाव उपभोगी संस्ट्था द्वारा दकया िायेगा। इस वृक्षारोपण के
सफलता पूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी।
b. 238 वृक्षों के प्रत्यारोपण/काटे दकए िान े के बिल े म े 1:10 के अनुपात म े स्ट्विेिी प्रिाजतयों के 6-8 फीट
की ऊाँचाई वाले 2380 पौधो का प्रजतपूरक वृक्षारोपण गरै -वन भूजम पर दकया िाएगा । वक्षृ ारोपण की
अनुमजत के िारी िोने के तीन मिीने के अंिर जनधााररत की गई भूजम पर अजतररि उपायों के साथ
वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7)
वर्षों के जलए रिरिाव तथा उसके बाि उनका रिरिाव उपभोगी संस्ट्था द्वारा अपनी स्ट्वयं की लागत
पर दकया िाएगा ।
c. यदि उपभोगी संस्ट्था सफलता पूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्था द्वारा
अजतररि साइट सुधार िचों को िमा दकया िाएगा िो दक वृक्ष अजधकारी (केंद्रीय) द्वारा गणना के
अनुसार वृक्षारोपण के जलए उपयुि बनान ेके जलए आवश्यक िो सकती िै।
d. िो भूजम प्रजतपूरक वृक्षारोपण/वृक्ष प्रत्यारोपण के जलए आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के
जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया िाएगा।
e. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली
सरकार को जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में वृक्ष अजधकारी (केंद्रीय)
को प्रस्ट्तुत की िाएगी।
f. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वक्षृ ारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई
अजतक्रमण न िो ।
g. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों
को दकया िाएगा।
h. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं
दकया िाएगा।
5. 238 वृक्षों को प्रत्यारोपण/काटने के जलए अनुमजत उनके स्ट्वयं के िोजिम पर और दकसी भी अन्य व्यजि के िाव े के
पक्षपात के जबना, िो वृक्षो और भूजम पर सिी िो सकती ि,ै िी िा रिी ि ै।
यि माननीय पयाावरण एव ंवन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के पूवा अनुमोिन से िारी दकया िाता ि ै।

TERMS AND CONDITIONS
1. Transport Department herein referred to as User Agency, shall make an advance deposit of an amount of
Rs.1,35,66,000/- (One Crore Thirty Five Lakh Sixty Six Thousand Only @ Rs. 57000/- per tree) towards
security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and
the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions
mentioned at 2, 3 & 4 are not followed by User Agency.
2. The following conditions shall be fulfilled before starting felling/transplantation of trees by User
Agency:
a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer in
compliance with Section-12 of Delhi Preservation of Trees Act, 1994.
b. User Agency shall submit a detailed plan for site preparation and plantation.
c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall
necessarily be obtained by the User Agency.
e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
3. The following conditions shall be fulfilled during the felling of trees:
a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and
should be completed not later than six (06) months of such date, after which a completion report has to
be submitted to theTree Officer. The spacing of the transplantation of trees shall not be less than 4 meter

b. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by
User Agency.
c. The transplantation shall be carried out prior to felling of 04 Nos. of trees permitted herein. The 04 trees
shall be removed/felled after successful transplantation of 234 trees and submission of compliance
certificate to DCF (Central).
d. The progress report of transplantation/felling shall be submitted through inspection officer to concerned
Tree Officer along with complete details of trees.
e. If any tree is found to have nest of birds it should not be felled/transplanted till the same is abandoned by
the birds.
f. Transplantation/felling of any tree apart from 238 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act (DPTA), 1994.
g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue
to the Government account by the User Agency.
h. The lops and tops of the trees shall be sent/supplied to the nearest crematorium free of cost and the same
should be reported to DCF (Central) by User Agency.
i. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said
wood shall be obtained from the DCF (Central) by User Agency.
j. Transplantation/felling of trees and transportation of forest produce arising there from to the public
crematorium shall be completed within 90 days.
k. The User Agency shall ensure that the plan of this proposal shall not be changed.
l. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.
n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy 2020 have
been followed and details of the same should be submitted to the Tree Officer concerned.
o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with
15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be
provided by User Agency and plantation has to be done at own cost.
4. The following conditions shall be fulfilled for considering successful plantation & release of Security
Deposit by the Tree officer:
a. 100% Compensatory Plantation of 2380 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as mentioned on table above.
b. 2380 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in
ratio of 1:10 on non-forest land in lieu of felling/ transplantation 238 number of trees. The plantation
shall be done by following site specific plantation techniques with additional measures on identified land
within three months of issue of tree removal permission and maintenance for next Seven (7) years shall
be carried out there after by User Agency with their own funds.
c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also
deposit extra site improvement expenses which may be required to make the site suitable for plantation
as calculated by Tree Officer concerned (as deposits).
d. The land over which compensatory plantation/Tree transplantation raised shall not be utilized for other
purpose without the approval of the State Government.
e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,
Govt. of NCT of Delhi and a copy of the same shall be submitted to the Tree Officer (Central) at the end
of every financial year.
f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory
plantation/ transplantation.
g. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/transplantation site.
h. The User Agency shall ensure that the plan of this proposal shall not be changed.[PART IV DELHI GAZETTE : EXTRAORDINARY 7
5. Permission for transplantation/ felling of 238 Nos. of tress is being granted to the User Agency at their own
risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land
or the trees.
