/- (पजिम) अिुान एवं अन्य िेिी प्रिाजतया ाँ का 5, रािपूत रेजिमेंट और िंकर जविार, नई दिल्ली 13536 वगमा ीटर के क्षेत्र म ें दकया िाएगा । उपभोगी संस्ट्था द्वारा पररयोिना स्ट्थल से 60 वृक्षों का प्रत्यारोपण 5, रािपूत रेिीमेंट,नई दिल्ली म ें 2478 वगामीटर के क्षेत्र पर अपने स्ट्वयं की (ख) लागत पर दकया िाएगा । जनयम एव ं ित ें 1. एचक्य ू आईडीएस एडजमन िसे ीओ (रक्षा मंत्रालय), िो दक उपभोगी संस्ट्था के रूप म ें संिर्भात ि,ै को सात वर्षों की अवजध के जलए पौधों के सम्पूणा जवकास एवं रखरखाव िते ु उपरोिानुसार 64,98,000 /-रुपय े (चौंसठ लाख अठानवे ििार मात्र @ रु. 57000/- प्रजत वृक्ष) (वापसी योग्य राजि- 56,50,410/- रुपय े (छप्पन लाख पचास ििार चार सौ िस मात्र) और प्रिासजनक िुल्क और आकजस्ट्मकता- रुपय े 8,47,590/- रुपय े (आठ लाख सैंतालीस ििार पांच सौ नब्बे मात्र)) की राजि अजिम रूप से िमा करवानी िोगी और यदि उपभोगी संस्ट्था द्वारा 2, 3 और 4 में उजल्लजखत जनयमों और ितों का पालन निीं दकया िाता िै, तो इस राजि को िब्त कर जलया िाएगा और इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए उपयोग दकया िाएगा । 2. उपभोगी सस्ट्ं था द्वारा वक्षृ ों का प्रत्यारोपण / कटाई िरूु करन ेस ेपिल ेपरू ी की िान ेवाली आवश्यक ितें:- a. दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 की धारा 12 के अनुपालन म ें उपभोगी सस्ट्ं था द्वारा संबंजधत वृक्ष अजधकारी / उप- वन संरक्षक को जवस्ट्तृत वृक्षारोपण कायाक्रम प्रस्ट्तुत दकया िाएगा । b. उपभोगी संस्ट्था द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा । c. उपभोगी संस्ट्था केद्वारा यि सजु नजित दकया िायेगा दक वृक्षो की कटाई / प्रत्यारोपण से पूवा कोई लंजबत मुकिमा या स्ट्थगन आिेि दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो । d. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का काया सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा। e. उपभोगी संस्ट्था के द्वारा वनमिं ूरी म ें और अन्य मंिूरी म ें उजल्लजखत सभी ितों, यदि कोई िो, का जनष्ठापूवाक पालन दकया िाएगा । f. ररि मैनेिमेंट बोडा (आरएमबी) द्वारा स्ट्वीकृत और माननीय सवोच्च न्यायालय द्वारा अनुमोदित पररयोिना के जलए जनधााररत पररयोिना लागत का 5% आरएमबी के पास उपभोगी संस्ट्था द्वारा िमा दकया िायेगा और इसे संबंजधत वृक्ष अजधकारी / उप-वन संरक्षक को अवगत कराया िाये ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 3. वक्षृ ों के प्रत्यारोपण / कटाई के िौरान परू ी की िान ेवाली आवश्यक ित:ें - a. क्र.स.ं 2 म ें ितों के अनुपालन िोने के तुरंत बाि उपभोगी संस्ट्था द्वारा वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ:मिीन े के अंतराल में पूणा दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का बाि एक सम्पूण ा ररपोटा सम्बंजधत वृक्ष अजधकारी / उप- वन सरं क्षक को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (ंबंि ुसे ंबंि)ु से कम निीं िोनी चाजिए । b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत, 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा । c. उपभोगी संस्ट्था प्रजतरोजपत वक्षृ ों का न्यनू तम तीन वर्षों तक उसी प्रत्यारोपण एिेंसी के माध्यम से अनरु क्षण करेगी जिन के द्वारा प्रत्यारोपण दकया गया था । d. उपभोगी संस्ट्था द्वारा 54 वृक्षो को काटने स े पूव ा प्रत्यारोपण दकया िाएगा । 54 वृक्षो की अनुमजत 60 वृक्षो के सफल प्रत्यारोपण और सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक को अनुपालन प्रमाण पत्र प्रस्ट्तुत करन े के बाि िी िायेगी । e. उपभोगी संस्ट्था द्वारा प्रत्यारोपण / काटे िाने वाले वृक्षों की प्रगजत ररपोटा संबंजधत वृक्ष अजधकारी / उप- वन संरक्षक को वृक्षों के पूण ा जववरण के साथ प्रस्ट्ततु की िाएगी। f. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ै तो उसे तब तक निीं काटा/ प्रत्यारोपण दकया िाएगा िब तक दक पक्षी उसे स्ट्वतः छोड़ न िें। g. उपभोगी संस्ट्था द्वारा 114 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 के अन्तगता एक अपराध िोगा। h. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त ल लकजड़यों की नीलामी की िाएगी और उससे प्राप्त ल धनराजि को सरकार के खाते म ेरािस्ट्व के रूप में िमा की िाएगी । i. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं को काटे िान े के उपरान्त प्राप्त ल लकजड़यों को मुफ्त में जनकटतम सावािजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक को भी िी िाएगी । j. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के स्ट्थल से लकजड़यों को को ले िाने से पूव ा सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक स ेढुलाई अनुमजत प्राप्त ल करनी िोगी । k. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण / कटाई और उसमें पैिा िोन े वाली वन उपि को सावािजनक श्मिान म े90 दिनों के अंिर परू ा दकया िाएगा । l. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा । m. उपभोगी संस्ट्था के द्वारा वन मिं ूरी में और अन्य मंिूरी म ें उजल्लजखत सभी ितों, यदि कोई िो, का जनष्ठापूवाक पालन दकया िाएगा । n. उपभोगी संस्ट्था के द्वारा अनुमोदित वृक्ष संरक्षण योिना के अतं गात प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठापूवाक पालन दकया िाएगा । o. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के अंतगता सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया ि ै और इसका सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक को प्रस्ट्तुत दकया िाएगा । p. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट ऊंचाई और कम से कम 6 इंच व्यास वाले स्ट्विेिी वृक्ष प्रिाजतयों म ें िीजवत निीं रि पाते ि,ैं तो उन्ि ें1:5 के अनुपात4 DELHI GAZETTE : EXTRAORDINARY PART IV] में लगाया िाएगा । आवश्यक अजतररि भूजम उपभोगी संस्ट्था द्वारा प्रिान की िाएगी और वृक्षारोपण स्ट्वय ं की लागत पर दकया िाएगा । 4. वक्षृ अजधकारी / उप-वन सरं क्षक द्वारा सफलतापवू का वक्षृ ारोपण और सरु क्षा िमा राजि िारी करन े पर जवचार करन ेके जलए आवश्यक ित:ें- a. उपरोि ताजलका 1 (क) और (ख) के अनुसार, िेिी प्रिाजतयों के 1140 पौधो का 100% प्रजतपूरक वृक्षारोपण और उनका सात वर्षो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगा । इस वृक्षारोपण के सफलता पूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी । b. 114 वृक्षो के प्रत्यारोपण/ काटे िान े के बिल े म े 1:10 के अनुपात म े स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 1140 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीन े के अंिर जनधााररत की गई भूजम पर अजतररि उपायों के साथ वक्षृ ारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वर्षों के जलए रखरखाव तथा उसके बािउनका रखरखाव उपभोगी संस्ट्था द्वाराअपनी स्ट्वयं की लागत पर दकया िाएगा । c. यदि उपभोगी संस्ट्था सफलतापूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्थाद्वारा अजतररि साइट सुधार खचों को िमा दकया िाएगा िो दक सम्बंजधत वृक्ष अजधकारी / उप-वन संरक्षक द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुि बनाने के जलए आवश्यक िो सकती िै । d. िो भूजम प्रजतपूरक वृक्षारोपण / वृक्ष प्रत्यारोपण के जलए आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकारकी स्ट्वीकृजत के जबना निीं दकया िाएगा। e. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार को जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अतं म ें सम्बंजधत वृक्षअजधकारी@उप- वन संरक्षककोप्रस्ट्तुत की िाएगी ।प्रारूप की एक प्रजत https://www.treeremoval.delhigovt.nic.inपर उपलब्ध ि।ै f. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपरू क वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो । g. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा। h. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा। i. यदि पररयोिना लागत सिं ोजधत िो िाती ि,ै तो अजतररि सुरक्षा राजि िारी करने के अनुरोध से पिल े उपभोगी संस्ट्था के द्वारा आरएमबी के पास िमा कर िी िाए। 5. यदि उपरोि में से कोई भी ित ा उपभोगी संस्ट्था द्वारा परू ी निीं की िाती िै, तो संबंजधत वृक्ष अजधकारी / उप- वन संरक्षक द्वारा दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 की धारा 12 के अनुसार कारावाई की िाएगी । 6. 114 वृक्षो को प्रत्यारोपण/ कटाई के जलए अनुमजत उनके स्ट्वय ंके िोजखम पर और दकसी भी अन्य व्यजि के िावे के पक्षपात के जबना, िो वृक्षो और भूजम पर सिी िो सकती ि,ै िी िा रिी ि ै। राष्ट्रीय रािधानी क्षत्रे दिल्ली के उपराज्यपाल के आिेि स े तथा उनके नाम पर, ए. के. ंसंि, प्रधान सजचव[PART IV DELHI GAZETTE : EXTRAORDINARY 5 DEPARTMENT OF FORESTS AND WILDLIFE NOTIFICATION Delhi, the 15th May, 2023 F. No. 97/WFD/COT/21-22/dcfpm/62-69.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territory of Delhi, hereby, in public interest exempts an area of 4.4775 ha for construction of Office Complex officer’s mess and camp for HQ IDS at survey No. 176, Mehram Nagar, New Delhi from the provision of sub-section (3) of section 9 of the said Act. (1) (2) (3) (4) (5) (a) Compensatory Plantation of 1140 number of tree saplings (10x114=1140, i.e., ten times the number of trees permitted for transplantation / felling of Tree Officer / trees) consisting of species of Neem, 1140 64,98,000 /- Deputy Amaltas, Peepal, Pilkhan, Gular, Bargad, Conservator Desi Kikar and Arjun along with other of Forests native species shall be carried out by (West) User Agency at 5, Rajput Regiment & Shankar Vihar, New Delhi over an area of 13536 sqm. (b) Transplantation of 60 number of trees which are standing on site shall be done by User Agency with their own funds at 5, Rajput Regiment, New Delhi over an area of 2478 sqm. TERMS & CONDITIONS 1. HQ IDS Adm JCO (Ministry of Defence) herein referred to as User Agency, shall make an advance deposit of an amount of Rs 64,98,000 /-/- (Sixty Four Lakh Ninety Eight Thousand Only, i.e., /- @ Rs. 57000/- per tree) (Refundable amount- Rs. 56,50,410/- Rupees (Fifty Six Lakh Fifty Thousand Four Hundred Ten Only) and Administrative charges and contingencies- Rs. 8,47,590/- Rupees (Eight Lakh Forty Seven Lakh Five Hundred Ninety Only)) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency. 2. The conditions required to be fulfilled before starting transplantation / felling of trees by User Agency:- a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer / Deputy Conservator of Forests in compliance with Section-12 of Delhi Preservation of Trees Act, 1994.6 DELHI GAZETTE : EXTRAORDINARY PART IV] b. User Agency shall submit a detailed plan for site preparation and plantation. c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees. d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be obtained by the User Agency. e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other clearances, if any obtained, shall be followed scrupulously. f. 5% of the project cost as prescribed for project cleared by Ridge Management Board (RMB) and approved by Hon’ble Supreme Court should be deposited with Ridge Management Board and the same is conveyed to concerned Tree Officer / Deputy Conservator of Forests. 3. The conditions required to be fulfilled during the transplantation / felling of trees:- a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and should be completed not later than six (06) months of such date, after which a completion report has to be submitted to the concerned Tree Officer / Deputy Conservator of Forests. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by User Agency. c. User Agency shall maintain the transplanted trees for minimum three years by engaging the same transplantation agency which has carried out the transplantation. d. The transplantation shall be carried out prior to felling of 54 numbers of trees permitted herein. The 54 trees shall be removed / felled after successful transplantation of 60 trees and submission of compliance certificate to the concerned Tree Officer / Deputy Conservator of Forests. e. The progress report of transplantation / felling shall be submitted to concerned Tree Officer / Deputy Conservator of Forests along with complete details of trees by the User Agency. f. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by the birds. g. Transplantation / felling of any tree apart from 114 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994. h. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. i. The lops & tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same should be reported to concerned Tree Officer / Deputy Conservator of Forests by User Agency. j. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the concerned Tree Officer / Deputy Conservator of Forests by User Agency. k. Transplantation of trees and transportation of forest produce arising there from to the public crematorium shall be completed within 90 days. l. The User Agency shall ensure that the plan of this proposal shall not be changed. m. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other clearances, if any obtained, shall be followed scrupulously. n. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously. o. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have been followed and details of the same should be submitted to the Tree Officer / Deputy Conservator of Forests concerned. p. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by User Agency & plantation has to be done at own cost.[PART IV DELHI GAZETTE : EXTRAORDINARY 7 4. The conditions required to be fulfilled for considering successful plantation & release of Security Deposit by the Tree Officer / Deputy Conservator of Forests :- a. 100% Compensatory Plantation of 1140 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as mentioned on table above. b. 1140 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of felling / transplantation 114 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer / Deputy Conservator of Forests concerned (as deposits). d. The land over which compensatory plantation / Tree transplantation raised shall not be utilized for other purpose without the approval of the Government. e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Government of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer / Deputy Conservator of Forests at the end of every financial year. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation/ transplantation. g. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site. h. The User Agency shall ensure that the plan of this proposal shall not be changed. i. If project costs get revised, the additional amount should be deposited with Ridge Management Board before requesting for release of security deposit. 5. If any of the above condition is not fulfilled by the User Agency, concerned Tree Officer/ / Deputy Conservator of Forests shall initiate action as per section 12 of Delhi Preservation of Trees Act, 1994. 6. Permission for transplantation / felling of 114 numbers of tress is being granted to the User Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or the trees.
