वृक्षो का वृक्ष अजधकारी/ िस गुना) प्रस्ट्ताजवत प्रिाजतया ाँ नीम, अमलतास, उप-वन संरक्षक (क) पीपल, जपलिन, गूलर, िरगि,िेसी कीकर, अिुान 1,82,97,000/- (पजिम) एवं अन्य िेिी प्रिाजतयााँ का उपभोगी संस्ट्था द्वारा सीवीडी, दिल्ली कैंट, नई दिल्ली में 28,890 3210 वगामीटर क्षेत्र पर दकया िाएगा । उपभोगी संस्ट्था द्वारा पररयोिना स्ट्थल से 111 वृक्षों का प्रत्यारोपण सीवीडी, दिल्ली कैंट, नई दिल्ली में 1776 वगा मीटर क्षेत्र (ि) पर अपने स्ट्वयं की लागत पर दकया िाएगा । जनयम एव ंित ें 1. आमी आर एडं आर िॉजस्ट्पटल,िो दक उपभोगी संस्ट्था के रूप में संिर्भात िै, को सात वषों की अवजध के जलए पौधों के सम्पूणा जवकास एवं रिरिाव िते ु उपरोिानुसार 1,82,97,000/-रुपय े (एक करोड़ ियासी लाि सत्तानवे ििार मात्र @ रु. 57000/- प्रजत वृक्ष)(वापसी योग्य राजि- 1,59,10,365/- रुपय े (एक करोड़ उनसठ लाि िस ििार तीन सौ पैंसठ मात्र) और प्रिासजनक िल्ु क और आकजस्ट्मकता- रुपय े 23,86,635/- रुपय े (तेईस लाि जछयासी ििार छि सौ पैंतीस मात्र) की राजि अजिम रूप से िमा करवानी िोगी और यदि उपभोगी संस्ट्था द्वारा 2, 3 और 4 म ें उजल्लजित जनयमों और ितों का पालन निीं दकया िाता िै, तो इस राजि को िब्त कर जलया िाएगा और इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए उपयोग दकया िाएगा । 2. उपभोगी सस्ट्ं था द्वारा वक्षृ ों का प्रत्यारोपण / कटाई िरूु करन ेस ेपिल ेपरू ी की िान ेवाली आवश्यक ितें:- a. दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 की धारा 12 के अनुपालन म ें उपभोगी सस्ट्ं था द्वारा संिंजधत वृक्ष अजधकारी / उप- वन संरक्षक को जवस्ट्तृत वृक्षारोपण कायाक्रम प्रस्ट्तुत दकया िाएगा । b. उपभोगी संस्ट्था द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा । c. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई / प्रत्यारोपण स े पूवा कोई लंजित मुकिमा या स्ट्थगन आिेि दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो । d. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का काया सभी वैधाजनक मंिूररयों को लेने के िाि िी िुरू दकया िाएगा। e. उपभोगी संस्ट्था के द्वारा वनमिं ूरी म ें और अन्य मंिूरी म ें उजल्लजित सभी ितों, यदि कोई िो, का जनष्ठापूवाक पालन दकया िाएगा । f. ररि मैनेिमेंट िोडा (आरएमिी) द्वारा स्ट्वीकृत और माननीय सवोच्च न्यायालय द्वारा अनुमोदित पररयोिना के जलए जनधााररत पररयोिना लागत का 5% ररि मनै ेिमेंट िोडा म ें उपभोगी संस्ट्था द्वारा िमा दकया िायेगा और इसे संिंजधत वृक्ष अजधकारी / उप- वन संरक्षक को अवगत कराया िायेगा । g. यदि पररयोिना लागत सिं ोजधत िो िाती ि,ै तो अजतररि सुरक्षा राजि िारी करने के अनुरोध से पिल े उपभोगी संस्ट्था के द्वारा आरएमिी के पास िमा कर िी िाए ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 3. वक्षृ ों के प्रत्यारोपण / कटाई के िौरान परू ी की िान ेवाली आवश्यक ितें:- a. क्र.स.ं 2 म ें ितों के अनुपालन िोने के तुरंत िाि उपभोगी संस्ट्था द्वारा वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ:मिीन े के अंतराल में पूणा दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का िाि एक सम्पूण ा ररपोटा सम्िंजधत वृक्ष अजधकारी / उप- वन सरं क्षक को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (लिंि ुसे लिंि)ु से कम निीं िोनी चाजिए । b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत, 2020 में उजल्लजित सभी ितों का पालन दकया िाएगा । c. उपभोगी संस्ट्था प्रजतरोजपत वक्षृ ों का न्यनू तम तीन वषों तक उसी प्रत्यारोपण एिेंसी के माध्यम से अनरु क्षण करेगी जिन के द्वारा प्रत्यारोपण दकया गया था । d. उपभोगी संस्ट्था द्वारा 210 वृक्षो को काटने से पूव ा प्रत्यारोपण दकया िाएगा । 210 वृक्षो की अनुमजत 111 वृक्षो के सफल प्रत्यारोपण और सम्िंजधत वृक्ष अजधकारी / उप- वन संरक्षक को अनपु ालन प्रमाण पत्र प्रस्ट्तुत करने के िाि िी िायेगी । e. उपभोगी संस्ट्था द्वारा प्रत्यारोपण / काटे िाने वाले वृक्षों की प्रगजत ररपोटा संिंजधत वृक्ष अजधकारी / उप- वन संरक्षक को वृक्षों के पूण ा जववरण के साथ प्रस्ट्ततु की िाएगी । f. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ै तो उसे ति तक निीं काटा/ प्रत्यारोपण दकया िाएगा िि तक दक पक्षी उसे स्ट्वतः छोड़ न ि ें । g. उपभोगी संस्ट्था द्वारा 321 वक्षृ ो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 के अन्तगता एक अपराध िोगा । h. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के िाते म ेरािस्ट्व के रूप में िमा की िाएगी । i. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िािाओं को काटे िान े के उपरान्त प्राप्त लकजड़यों को मुफ्त में जनकटतम सावािजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना सम्िंजधत वृक्ष अजधकारी / उप- वन संरक्षक को भी िी िाएगी । j. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के स्ट्थल से लकजड़यों को को ले िाने से पूव ा सम्िंजधत वृक्ष अजधकारी / उप- वन संरक्षक स ेढुलाई अनुमजत प्राप्त करनी िोगी । k. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण / कटाई और उसमें पैिा िोन े वाली वन उपि को सावािजनक श्मिान म े90 दिनों के अंिर परू ा दकया िाएगा । l. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा । m. उपभोगी संस्ट्था के द्वारा वन मिं ूरी में और अन्य मंिूरी म ें उजल्लजित सभी ितों, यदि कोई िो, का जनष्ठापूवाक पालन दकया िाएगा । n. उपभोगी संस्ट्था के द्वारा अनुमोदित वृक्ष संरक्षण योिना के अतं गात प्रस्ट्ततु सभी गजतजवजधयों का जनष्ठापूवाक पालन दकया िाएगा । o. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-िी) के अंतगता सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया ि ै और इसका सम्िंजधत वृक्ष अजधकारी / उप- वन संरक्षक को प्रस्ट्तुत दकया िाएगा । p. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट ऊंचाई और कम से कम 6 इंच व्यास वाले स्ट्विेिी वृक्ष प्रिाजतयों म ें िीजवत निीं रि पाते ि,ैं तो उन्ि ें1:5 के अनुपात में लगाया िाएगा । आवश्यक अजतररि भूजम उपभोगी संस्ट्था द्वारा प्रिान की िाएगी और वृक्षारोपण स्ट्वय ं की लागत पर दकया िाएगा ।4 DELHI GAZETTE : EXTRAORDINARY PART IV] 4. वक्षृ अजधकारी / उप-वन सरं क्षक द्वारा सफलतापवू का वक्षृ ारोपण और सरु क्षा िमा राजि िारी करन े पर जवचार करन ेके जलए आवश्यक ित:ें- a. उपरोि ताजलका 1 (क) और (ि) के अनुसार, िेिी प्रिाजतयों के 3210 पौधो का 100% प्रजतपूरक वृक्षारोपण और उनका सात वषो तक रिरिाव उपभोगी संस्ट्था द्वारा दकया िायेगा । इस वृक्षारोपण के सफलता पूवाक स्ट्थापना के िाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी । b. 321 वृक्षो के प्रत्यारोपण / काटे िान े के ििल े म े 1:10 के अनुपात म े स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 3210 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीन े के अंिर जनधााररत की गई भूजम पर अजतररि उपायों के साथ वक्षृ ारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वषों के जलए रिरिाव तथा उसके िाि उनका रिरिाव उपभोगी संस्ट्था द्वाराअपनी स्ट्वयं की लागत पर दकया िाएगा । c. यदि उपभोगी संस्ट्था सफलतापूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्थाद्वारा अजतररि साइट सुधार िचों को िमा दकया िाएगा िो दक सम्िंजधत वृक्ष अजधकारी / उप- वन संरक्षक द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुि िनाने के जलए आवश्यक िो सकती ि ै। d. िो भूजम प्रजतपूरक वृक्षारोपण / वृक्ष प्रत्यारोपण के जलए आवंरटत िै, उसका उपयोग दकसी अन्य कायो के जलए सक्षम प्राजधकारी की स्ट्वीकृजत के जिना निीं दकया िाएगा। e. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार को जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वषा के अंत में सम्िंजधत वृक्ष अजधकारी / उप- वन संरक्षक को प्रस्ट्तुत की िाएगी । प्रारूप की प्रजत https://dpta.eforest.delhi.gov.in पर उपलब्ध ि।ै f. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपरू क वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो। g. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा । h. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा । i. उपभोगी संस्ट्था पांच वषा की अवजध के जलए वृक्षारोपण की प्रगजत ररपोटा करते हुए िर छि मिीने में सीईसी (CEC)को एक प्रस्ट्तुत की िाएगी। 5. यदि उपरोि में से कोई भी ित ा उपभोगी संस्ट्था द्वारा परू ी निीं की िाती िै, तो संिंजधत वृक्ष अजधकारी / उप- वन संरक्षक द्वारा दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 की धारा 12 के अनुसार कारावाई की िाएगी । 6. उि अजधजनयम की धारा 9 की उपधारा (3) के प्रावधान से क्षेत्र को छूट िेन े के जलए दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 की धारा 29 के तित अजधसूचना िारी की िाती ि।ै िालााँदक, 321 वक्षृ ो को प्रत्यारोपण / कटाई के जलए अनुमजत दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 के प्रावधान के अंतगात वृक्ष अजधकारी द्वारा अलग से उपभोगी संस्ट्था को उनके स्ट्वयं conferred by section 29 of the Delhi reservation of Trees Act (DPTA), 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territory of Delhi, hereby, in public interest exempts an area of 5.6 ha for construction of Oncology Centre Building (200 Bedded) at Army Hospital (R&R), Delhi Cantt., New Delhi, from the provision of sub-section (3) of section 9 of the said Act. (b) Transplantation of 111 numbers of trees which are standing on site shall be done by User Agency with their own funds at CVD, Delhi Cantt., New Delhi area over an area of 1776 sqm area. TERMS & CONDITIONS 1. Army R&R Hospital herein referred to as User Agency, shall make an advance deposit of an amount of Rs 1,82,97,000/- (Rs. One Crore Eighty Two Lakh Ninety Seven Thousand Only) (Refundable amount- Rs. 1,59,10,365/- Rupees (One Crore Fifty Nine Lakh Ten Thousand Three Hundred Sixty Five Only) and Administrative charges and contingencies- Rs. 23,86,635/-Rupees (Twenty Three Lakh Eighty Six Thousand Six Hundred Thirty Five Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency. 2. The conditions required to be fulfilled before starting transplantation / felling of trees by User Agency:- a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer / Deputy Conservator of Forests in compliance with Section-12 of DPTA, 1994. b. User Agency shall submit a detailed plan for site preparation and plantation. c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees.6 DELHI GAZETTE : EXTRAORDINARY PART IV] d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be obtained by the User Agency. e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other clearances, if any obtained, shall be followed scrupulously. f. 5% of the project cost as prescribed for project cleared by Ridge Management Board (RMB) and approved by Hon’ble Supreme Court of India should be deposited with Ridge management Board and the same is conveyed to Tree Officer / Deputy Conservator of Forests (West). g. If project costs get revised, the additional amount should be deposited with Ridge Management Board before requesting for release of security deposit. 3. The conditions required to be fulfilled during the transplantation / felling of trees:- a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and should be completed not later than six (06) months of such date, after which a completion report has to be submitted to the concerned Tree Officer / Deputy Conservator of Forests. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by User Agency. c. User Agency shall maintain the transplanted trees for minimum three years by engaging the same transplantation agency which has carried out the transplantation. d. The transplantation shall be carried out prior to felling of 210 number of trees permitted herein. The 210 trees shall be removed / felled after successful transplantation of 111 trees and submission of compliance certificate to concerned Tree Officer / Deputy Conservator of Forests e. The progress report of transplantation / felling shall be submitted to concerned Tree Officer / Deputy Conservator of Forests along with complete details of trees by the User Agency. f. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by the birds. g. Transplantation / felling of any tree apart from 321 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994. h. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. i. The lops & tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same should be reported to concerned Tree Officer / Deputy Conservator of Forests by User Agency. j. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the concerned Tree Officer / Deputy Conservator of Forests by User Agency. k. Transplantation / felling of trees and transportation of forest produce arising there from to the public crematorium shall be completed within 90 days. l. The User Agency shall ensure that the plan of this proposal shall not be changed. m. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other clearances, if any obtained, shall be followed scrupulously. n. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously. o. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have been followed and details of the same should be submitted to the Tree Officer / Deputy Conservator of Forests concerned. p. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by User Agency & plantation has to be done at own cost. 4. The conditions required to be fulfilled for considering successful plantation & release of Security Deposit by the Tree Officer / Deputy Conservator of Forests :- a. 100% Compensatory Plantation of 3210 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as mentioned on table above.[PART IV DELHI GAZETTE : EXTRAORDINARY 7 b. 3210 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of transplantation / felling 321 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer / Deputy Conservator of Forests concerned (as deposits). d. The land over which compensatory plantation / Tree transplantation raised shall not be utilized for other purpose without the approval of the Competent Authority. e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Government of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer / Deputy Conservator of Forests at the end of every financial year. A copy of format is available in https://dpta.eforest.delhi.gov.in. f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation/ transplantation. g. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site. h. The User Agency shall ensure that the plan of this proposal shall not be changed. i. The User Agency file a report to CEC every six months reporting progress of plantation for a period of five years. 5. If any of the above condition is not fulfilled by the User Agency, concerned Tree Officer/ / Deputy Conservator of Forests shall initiate action as per Section 12 of Delhi Preservation of Trees Act, 1994. 6. The notification is issued under section 29 of DPTA, 1994 to exempt the area from the provision of sub- section (3) of section 9 of the said act. However, permission for transplantation / felling of 321 numbers of tress shall be granted separately by the Tree Officer under the provision of DPTA, 1994 to the User Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or the trees.
