2. उपरोि 1 (क) और (ख) के अनुसार, ििे ी प्रिाजतयों के 1440 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात वर्ो
तक रखरखाव उपभोगी संस्ट्र्ा, दिल्ली जवकास प्राजधकरण के माध्यम से दकया िायेगाA इस वृक्षारोपण के सफलतापूवथक
स्ट्र्ापना के बाि उपभोगी संस्ट्र्ा द्वारा जनगरानी की िाएगी । िालांदक, प्रजतपूरक वृक्षारोपण की जिम्मेिारी उपभोगी संस्ट्र्ा
राष्ट्रीय रािधानी क्षेत्र पररविन जनगम की िोगी ।
3. 144 वृक्षो को काटे/ प्रत्यारोपण दकए िाने के बिले मे 1:10 के अनुपात मे स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले
1440 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के छः मिीने के
अंिर जनधाथररत की गई भूजम पर अजतररि उपायों के सार् वृक्षारोपण स्ट्र्ल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा
दकया िाएगा और उसका रखरखाव उपभोगी संस्ट्र्ा द्वारा अपने स्ट्वयं की लागत पर दकया िाएगा ।
4. यदि उपभोगी संस्ट्र्ा सफलतापूवथक प्रजतपूरक वृक्षारोपण करने में जवफल रिती िै। उपभोगी संस्ट्र्ा द्वारा अजतररि साइट सुधार
खचों को िमा दकया िाएगा िो दक वृक्ष अजधकारी (िजक्षण) द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुि बनाने के जलए
आवश्यक िो सकती िै ।
5. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोपण उपभोगी संस्ट्र्ा द्वारा िुरू दकया िाएगा और इसे छःमिीने के अंतराल में
पूणथ दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणथ िोने का बाि एक सम्पूणथ ररपोटथ संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की
िायेगी । प्रत्यारोपण स्ट्र्ल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (लबंि ुसे लबंि)ु से कम निीं िोनी चाजिए ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3
6. उपभोगी संस्ट्र्ा के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
7. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के
जबना निीं दकया िाएगा।
8. उपभोगी संस्ट्र्ा द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 की धारा 12 के अनुपालन में वृक्ष
अजधकारी (िजक्षण) को प्रस्ट्तुत दकया िाएगा ।
9. उपभोगी संस्ट्र्ा द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधाथररत
करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्थ के अंत में वृक्ष अजधकारी (िजक्षण) को प्रस्ट्तुत की िाएगी ।
10. उपभोगी संस्ट्र्ा द्वारा 24 वृक्षो को काटने से पूवथ प्रत्यारोपण दकया िाएगा । 24 वृक्षो की अनुमजत 120 वृक्षो के सफल
प्रत्यारोपण और उप-वन संरक्षक (िजक्षण) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी ।
11. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो ।
12. उपभोगी संस्ट्र्ा द्वारा वृक्षो को काटने/ प्रत्यारोपण का कायथ िुरू करने से पूवथ साइट की तैयारी और वृक्षारोपण के जलए एक
जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा ।
13. उपभोगी संस्ट्र्ा द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्र्ल में मृिा नमी संरक्षण कायथ की गजतजवजधयों को दकया िाएगा ।
14. 144 वृक्षो को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजि के िावे के पक्षपात के
जबना, िो वृक्षो और भूजम पर सिी िो सकती िै, िी िा रिी ि ै।
15. उपभोगी संस्ट्र्ा के द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई/ प्रत्यारोपण से पूवथ कोई लंजबत मुकिमेबािी या स्ट्र्गन
आििे दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो ।
16. उपभोगी संस्ट्र्ा द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायथ सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा ।
17. उपभोगी संस्ट्र्ा द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटथ संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को
प्रस्ट्तुत की िाएगी ।
18. उपभोगी संस्ट्र्ा के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तथत निीं दकया िाएगा ।
19. उपभोगी संस्ट्र्ा द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजियों की नीलामी की िाएगी और उससे प्राप्त धनराजि को
सरकार के खाते मे रािस्ट्व के रूप में िमा की िाएगी ।
20. उपभोगी संस्ट्र्ा द्वारा वृक्षों के ऊपरी िाखाओं को काटे िाने के उपरान्त प्राप्त लकजियों को मुफ्त में जनकटतम सावथिजनक
भाविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (िजक्षण) को भी िी िाएगी ।
21. उपभोगी संस्ट्र्ा द्वारा वृक्षो को िटाए िाने के स्ट्र्ल से लकजियों को ले िाने से पूवथ वृक्ष अजधकारी (िजक्षण) से बलाई अनुमजत
प्राप्त करनी िोगी ।
22. उपभोगी संस्ट्र्ा द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावथिजनक श्मिान मे 90 दिनों के
अंिर पूरा दकया िाएगा ।
23. उपभोगी संस्ट्र्ा द्वारा 144 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष laj{k.k अजधजनयम, 1994 के
अन्तगथत एक अपराध िोगा ।
24. इस प्रस्ट्ताव पर उन ितथ के अधीन जवचार दकया िाएगा िो प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण भूजम दकसी अन्य संगठन के और
दकसी भी अन्य िावे से मुि िोगी ।
25. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ैतो उस वृक्ष को घोंसला स्ट्र्ानांतररत करने के पिात िी काटा िाएगा ।
26. उपभोगी संस्ट्र्ा के द्वारा पयाथवरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िायेगा ।
यि माननीय पयाथवरण एवं वन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के पूवथ अनुमोिन से िारी दकया िाता ि ै ।

Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 1.8475 ha. approx. as detailed below for construction of RRTS Stabling
Yard Alignment from Sarai Kale Khan at Chainage 950 to Chainage 1650 near Siddharth Extension and Sarai Kale
Khan Station Yard at Chainage 0 to 200, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. National Capital Region Transport Corporation (NCRTC), herein referred to as User Agency, shall make an
advance deposit of an amount of Rs. 82,08,000 /- (Rs. Eighty Two Lakh Eight Thousand Only) towards security deposit
for creation and maintenance of compensatory plantation for a period of Seven years as follows,

(b) Transplantation of 120 no. of trees which are standing on site shall be done by User Agency at Land adjoining
DND Flyway on Western Bank of River Yamuna Land 1.76 ha. approx, for NCRTC New Delhi.
2. 100% Compensatory Plantation of 1440 saplings of native species shall be raised and maintained by User Agency
through DDA at the project site for Seven years and monitored till its successful establishment as indicated at 1 (a)
& (b) above. However, responsibilities for Compensatory Plantation shall be of User Agency i.e NCRTC.
3. 1440 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of
1:10 on non-forest land in lieu of removal of 144 no. of trees. The plantation shall be done by following site
specific plantation techniques with additional measures on identified land within six months of issue of tree
removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with

4. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra
site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree
Officer concerned (as deposits).
5. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later
than six months, after which a completion report has to be submitted to the Tree Officer. The spacing of the
transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
6. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency.
7. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of
State Government.
8. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of DPTA,
1994 before initiating felling/ transplantation.
9. User Agency shall be responsible to arrange to maintain plantation journals as prescribed by Department of
Forests and Wildlife, Govt. of NCT of Delhi and submit a copy of same at end of each financial year.
10. The transplantation shall be carried out prior to felling of 24 nos. of trees permitted herein. The 24 trees shall be
removed/ felled after successful transplantation of 120 trees and submission of compliance certificate to DCF
(South).
11. Land Owning agency shall ensue that there is no encroachment in area proposed for compensatory plantation.
12. User Agency shall submit a detailed plan for site preparation and plantation before initiating transplantation/
felling.
13. The User agency shall implement the improved soil moisture conservation activities on compensatory plantation/
transplantation site.
14. Permission for transplantation/ felling of 144 tress is being granted at their own risk and without prejudice to the
claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
15. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other
authority before undertaking felling/ transplantation of trees.
16. Before removal of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained
by the User Agency.
17. The progress report of transplantation shall be submitted through inspection officer concerned along with complete
details of trees.
18. The User Agency shall ensure that the plan of this proposal shall not be changed.
19. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the
Government account by the User Agency.
20. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should
be reported to DCF (South) by User Agency.
21. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall
be obtained from the DCF (South) by User Agency.
22. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public crematorium
shall be completed within 90 days.
23. Transplantation/ felling of any tree apart from 144 trees by User Agency shall constitute an offence under DPTA,
1994.
24. The proposal shall be considered subject to condition that Compensatory Plantation/ Transplantation land shall be
free from any claims by any other organization.
25. If any tree is found to have nest of birds it should not be felled/ transplant till the same is abandoned by the birds.
26. It should be ensured by the user agency that all the conditions mentioned in environmental clearance and other
clearances, if any obtained, shall be followed scrupulously.
