2. उपरोक्त 1 (क) और (ख) के अनुसार, देिी प्रजाजतयों के 270 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका
सात वषो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया जायगे ाA इस वृक्षारोपण के सफलतापूवधक स्ट्थापना के बाद
उपभोगी संस्ट्था द्वारा जनगरानी की जाएगी A
3. 05 वृक्षो को काटे और 22 वृक्षो के प्रत्यारोपण दकए जाने के बदले मे 1:10 के अनुपात मे स्ट्वदेिी प्रजाजतयों के 6-8
फीट की ऊाँचाई वाले 270 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया जाएगा । वृक्षारोपण की अनुमजत
के जारी होने के तीन महीने के अंदर जनधाधररत की गई भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के
अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया जाएगा और अजिम सात (7) वषों के जलए रखरखाव उसके
बाद उनका रखरखाव उपभोगी संस्ट्था द्वारा अपने स्ट्वयं की लागत पर दकया जाएगा ।
4. यदद उपभोगी संस्ट्था सफलतापवू धक प्रजतपूरक वृक्षारोपण करन े में जवफल रहती ह ै। उपभोगी संस्ट्था द्वारा अजतररक्त
साइट सुधार खचों को जमा दकया जाएगा जो दक वृक्ष अजधकारी ¼उत्तरी½ द्वारा गणना के अनुसार वृक्षारोपण के

5. जो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ह,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की
स्ट्वीकृजत के जबना नहीं दकया जाएगा ।
6. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को ददल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के
अनुपालन म ेंवृक्ष अजधकारी ¼उत्तरी½ को प्रस्ट्तुत दकया जाएगा ।
7. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षत्रे ददल्ली सरकार को
जनधाधररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वषध के अतं में वृक्ष अजधकारी ¼उत्तरी½ को प्रस्ट्तुत की जाएगी ।
8. उपभोगी संस्ट्था द्वारा वृक्षो को काटने/ प्रत्यारोपण का कायध िरूु करन े से पूवध साइट की तैयारी और वृक्षारोपण के
जलए एक जवस्ट्ततृ योजना प्रस्ट्ततु दकया जाएगा ।
9. उपभोगी संस्ट्था द्वारा प्रजतपरू क वृक्षारोपण/ प्रत्यारोपण स्ट्थल म ें मृदा नमी संरक्षण कायध की गजतजवजधयों को दकया
जाएगा ।
10. अनुमजत जारी होन े के तुरंत बाद वृक्षो का प्रत्यारोपण उपभोगी संस्ट्था द्वारा िुरू दकया जाएगा और इसे तीन महीन े
के अतं राल म ें पूण ध दकया जाएगा । प्रत्यारोपण प्रदक्रया के पणू ध होन े का बाद एक सम्पूण ध ररपोटध संबजन्धत वृक्ष
अजधकारी को प्रस्ट्ततु की जायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की दरू ी 4 मीटर (बबद ु से बबद)ु से कम
नहीं होनी चाजहए ।
11. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया जाएगा ।
12. 27 वृक्षो को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्वयं के जोजखम पर और दकसी भी अन्य व्यजक्त के दावे के
पक्षपात के जबना, जो वृक्षो और भूजम पर सही हो सकती ह,ै दी जा रही ह ै ।
13. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया जायगे ा दक वृक्षो की कटाई/ प्रत्यारोपण स े पूवध कोई लंजबत
मुकदमेबाजी या स्ट्थगन आदेि दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ हो ।
14. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायध सभी वैधाजनक मंजूररयों को लेने के बाद ही िुरू दकया
जाएगा ।
15. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया जायगे ा दक इस प्रस्ट्ताव की योजना को पररवर्भतत नहीं दकया
जाएगा ।
16. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोट ध संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष
अजधकारी को प्रस्ट्तुत की जाएगी ।
17. उपभोगी संस्ट्था द्वारा वृक्षो को हटाए जाने के उपरान्त प्राप्त लकजियों की नीलामी की जाएगी और उससे प्राप्त
धनराजि को सरकार के खाते मे राजस्ट्व के रूप में जमा की जाएगीA
18. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds उपरान्त izkIr लकजियों को मुफ्त म ें जनकटतम

20. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैदा होन े वाली वन उपज को सावधजजनक श्मिान म े
90 ददनों के अंदर परू ा दकया जाएगा ।
21. उपभोगी संस्ट्था द्वारा 05 वृक्षो को काटने से पूवध प्रत्यारोपण दकया जाएगा । 05 वृक्षो की अनमु जत 22 वृक्षो के सफल
प्रत्यारोपण और mi& ou laj{kd (उत्तरी) को अनपु ालन प्रमाण पत्र प्रस्ट्तुत करन े के बाद दी जायेगी ।
22. भूजम स्ट्वाजमत्व एजेंसी यह सुजनजित करेगी दक प्रजतपूरक वक्षृ ारोपण के जलए प्रस्ट्ताजवत क्षत्रे म ें कोई अजतक्रमण
न हो ।
23. उपभोगी संस्ट्था द्वारा 27 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण ददल्ली वक्षृ lja {k.k अजधजनयम,

24. यदद दकसी वृक्ष म ें पजक्षयों का घोंसला पाया जाता ह ै तो उसे तब तक नहीं काटा जाएगा जब तक दक पक्षी उस े छोि
न दें।
25. अनुमजत तभी दी जाएगी जब उप-वन संरक्षक (उत्तरी) द्वारा जारी दकए गए पत्र ददनांक 16.11.2021 के अनुसार
उपभोगी संस्ट्था द्वारा वृक्ष अजधकारी (उत्तरी) को प्रजतपरू क वृक्षारोपण करने के जलए प्रजतपूरक वृक्षारोपण भूजम के
माजलक से अजतक्रमण रजहत प्रजतपूरक वृक्षारोपण स्ट्थल/ अनापजत्त प्रमाण पत्र प्रस्ट्तुत दकया जाएगा ।
26. उपभोगी संस्ट्था के द्वारा पयाधवरण मंजूरी म ें और अन्य मंजूरी म ें उजल्लजखत सभी ितों ितों, यदद कोई हो, का
जनष्ठापूवधक पालन दकया जाएगा ।
यह माननीय पयाधवरण एव ंवन मंत्री राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार के पूवध अनुमोदन से जारी दकया जाता ह ै ।

F. No. 100/WFD/COT/21-22/ 8894-8902.—In exercise of the powers conferred by section 29 of the
Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory
of Delhi, hereby, in public interest exempts an area of 1.00 ha. approx. as detailed below for construction of
Semi-Permanent/ Temporary ICU Hospital at Sultanpuri, New Delhi from the provision of sub-section (3) of
section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. Public Works Department (PWD), herein referred to as User Agency, shall make an advance deposit
of an amount of Rs.15,39,000 /- (Rs. Fifteen Lakh Thirty Nine Thousand Only) towards security
deposit for creation and maintenance of compensatory plantation for a period of Seven years as
follows,

(b) Transplantation of 22 no. of trees which are standing on site shall be done by User Agency at same project
site with their own funds.
2. 100% Compensatory Plantation of 270 saplings of native species shall be raised and maintained by
User Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) &
(b) above.
3. 270 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in
ratio of 1:10 on non-forest land in lieu of felling of 05 no. of trees and transplantation of 22 no. of
trees. The plantation shall be done by following site specific plantation techniques with additional
measures on identified land within three months of issue of tree removal permission and
maintenance for next Seven (7) years shall be carried out there after by User Agency with their own
funds.
4. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also
deposit extra site improvement expenses which may be required to make the site suitable for
plantation as calculated by Tree Officer concerned (as deposits).
5. The land over which compensatory plantation raised shall not be utilized for other purpose without
the approval of the State Government.
6. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section
12 of Delhi Preservation of Trees Act, 1994 before initiating felling/ transplantation.
7. User Agency shall be responsible to arrange to maintain plantation journals as prescribed by
Department of Forests and Wildlife, Govt. of NCT of Delhi and a copy of the same shall be
submitted to the Tree Officer (North) at the end of every financial year.
8. User Agency shall submit a detailed plan for site preparation and plantation before initiating
transplantation/ felling.
9. The User agency shall implement the improved soil moisture conservation activities on
compensatory plantation/ transplantation site.
10. Transplantation of trees shall be initiated immediately after permission is issued and should be
completed not later than three (03) months, after which a completion report has to be submitted to
the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to
point) at transplantation site.
11. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by
User Agency.
12. Permission for transplantation/ felling of 27 tress is being granted at their own risk and without
prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the
trees.
13. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of
law/ other authority before undertaking felling/ transplantation of trees.
14. Before removal of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
15. The User Agency shall ensure that the plan of this proposal shall not be changed.
16. The progress report of transplantation shall be submitted through inspection officer concerned along

17. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as
revenue to the Government account by the User Agency.
18. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the
same should be reported to DCF (North) by User Agency.
19. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the
said wood shall be obtained from the DCF (North) by User Agency.
20. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public
crematorium shall be completed within 90 days.
21. The transplantation shall be carried out prior to felling of 05 nos. of trees permitted herein. The 05
trees shall be removed/ felled after successful transplantation of 22 trees and submission of
compliance certificate to DCF (North).
22. Land Owning agency shall ensue that there is no encroachment in area proposed for compensatory
plantation.
23. Transplantation/ felling of any tree apart from 27 trees by User Agency shall constitute an offence
under Delhi Preservation of Trees Act, 1994.
24. If any tree is found to have nest of birds it should not be felled/ transplant till the same is abandoned
by the birds.
25. The permission shall be granted only if encumbrance free Compensatory Plantation site/NOC from
Owner of Compensatory Plantation land for carrying out Compensatory Plantation submitted to the
Tree Officer (North) by the User Agency as per letter dated 16.11.2021 issued by DCF (North)/ Tree
Officer.
26. It should be ensured by the user agency that all the conditions mentioned in environmental clearance
and other clearances, if any obtained, shall be followed scrupulously.
