## Policy Analysis Report: Exemption under the Delhi Preservation of Trees Act, 1994 for Highway Construction
**1. Executive Summary:**
This report analyzes a notification issued by the Government of National Capital Territory of Delhi regarding an exemption under Section 29 of the Delhi Preservation of Trees Act, 1994. The notification permits the felling and transplantation of trees for the construction of a 6-lane access-controlled highway from DND Maharani Bagh to Junction with Jaitpur Pushta Road. The core purpose is to facilitate infrastructure development while mandating compensatory afforestation and transplantation to mitigate environmental impact. Key findings include specific conditions related to financial deposits, species selection, plantation maintenance, and adherence to existing transplantation policies.
**2. Introduction:**
This report provides an informative analysis of a notification issued by the Government of National Capital Territory of Delhi (GNCTD) regarding an exemption under the Delhi Preservation of Trees Act, 1994. This analysis is based solely on the provided policy text. The purpose is to elucidate the key provisions, implications, and implementation aspects of this exemption.
**3. Policy Overview:**
This document is not an amendment, but a specific exemption granted under the existing Delhi Preservation of Trees Act, 1994. The core objective, as inferred from the text, is to balance infrastructure development (specifically the construction of a highway) with environmental preservation through compensatory afforestation and regulated tree felling/transplantation.
**4. Background and Rationale:**
This is a specific exemption under an existing act. The policy addresses the inevitable impact on trees due to infrastructure projects. In this case, the construction of a new highway necessitates the removal and/or relocation of trees. The exemption allows this to proceed, but only under strict conditions designed to mitigate the ecological damage. The project falls under the Bharatmala Pariyojana, indicating its importance to national infrastructure development.
**5. Key Provisions / Changes:**
This document details the exemption from subsection 3 of section 9 of the Delhi Preservation of Trees Act, 1994, for a specific area (11.4 ha approx.) to allow the construction of a 6-lane access controlled highway. The key provisions mandated by the text are:
* **Tree Removal and Transplantation:** Authorizes the felling of 190 trees and transplantation of 109 trees. A total of 299 trees are mentioned in reference to the project.
* **Compensatory Afforestation:** Requires the user agency (National Highway Authority of India - NHAI) to undertake compensatory plantation of 2990 saplings.
* **Financial Deposit:** Mandates NHAI to deposit Rs. 1,70,43,000 (One Crore Seventy Lakh Forty Three Thousand Only) as a security deposit for the creation and maintenance of compensatory plantation for seven years.
* **Species Selection:** Specifies that the compensatory plantation should include native species such as Neem, Amaltas, Peepal, Pilkhan, Gular, Bargad, Goolar, Mango, Sheesham and other native species.
* **Location of Plantation:** Specifies that compensatory plantations are to be carried out at EcoPark, NTPC Land Badarpur, New Delhi. Transplantation of trees is also to occur at this location.
* **Plantation Maintenance:** NHAI is responsible for raising and maintaining the compensatory plantation for seven years.
* **Adherence to Regulations:** The user agency must follow the guidelines of the Delhi Preservation of Trees Act, 1994, and the Tree Transplantation Policy 2020.
* **Timber Disposal:** Timber from removed trees must be auctioned, with proceeds deposited into the government account. Lops and tops of trees are to be provided to the nearest crematorium free of cost.
* **Timelines:** Transplantation must begin immediately after permission is issued and completed within three months. Felling can only occur after successful transplantation and submission of a compliance certificate.
* **Reporting:** Requires the user agency to submit detailed plans, maintain a plantation journal, and provide progress reports.
**6. Target Audience and Stakeholders:**
Based on the provided text, the target audience and stakeholders directly affected by this exemption include:
* **National Highway Authority of India (NHAI):** As the user agency, they are responsible for fulfilling the conditions outlined in the notification.
* **Department of Environment, Forests and Wildlife, Govt. of NCT of Delhi:** The regulating authority responsible for overseeing the implementation and ensuring compliance.
* **Tree Officer:** Responsible for calculating site improvement expenses and managing deposits.
* **Deputy Conservator of Forests (DCF South):** Involved in timber disposal and compliance verification.
* **Local Communities:** Potentially affected by the highway construction and the associated environmental changes.
* **Contractors and Laborers involved in the highway project:** They will be directly involved in tree felling, transplantation, and plantation activities.
* **Citizens and commuters of Delhi:** Impacted by the new highway and the environmental consequences (both positive and negative) of the tree removal and compensatory afforestation.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The National Highway Authority of India (NHAI) is primarily responsible for implementing the provisions of this exemption. The Department of Environment, Forests and Wildlife, Govt. of NCT of Delhi, and specifically the Tree Officer and DCF South, will oversee and monitor the implementation.
* **Timelines/Procedures:**
* NHAI must deposit the required funds in advance.
* A detailed plantation schedule must be submitted before initiating felling/transplantation.
* Transplantation must begin immediately and be completed within three months of permission.
* Felling of the 190 trees can only commence after successful transplantation of the 109 trees and submission of a compliance certificate.
* Felling transplantation of trees and transportation of forest produce shall be completed within 90 days.
* This implementation is tied to a specific project and location. The text offers little flexibility, so it must be followed closely.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome of this exemption is to enable the construction of a vital infrastructure project (the 6-lane highway) while mitigating environmental damage through:
* **Compensatory Afforestation:** Planting 2990 saplings to offset the loss of existing trees.
* **Tree Transplantation:** Relocating 109 trees to preserve them.
* **Environmental Preservation:** Promoting the growth of native tree species.
The potential impact includes improved transportation infrastructure, but also the environmental consequences of tree removal, which are intended to be offset by the compensatory measures. The success of this initiative depends heavily on NHAI's diligent implementation of the conditions outlined in the notification.
**9. Conclusion:**
The notification represents a specific exemption under the Delhi Preservation of Trees Act, 1994, to facilitate highway construction. It is significant because it illustrates the government's attempt to balance developmental needs with environmental concerns. The success of this approach hinges on the effective implementation of the stipulated conditions, particularly the compensatory afforestation and transplantation efforts undertaken by NHAI. The policy highlights the importance of rigorous monitoring and adherence to established guidelines to ensure a sustainable outcome.
