2. उपभोगी सस्ट्ं था द्वारा वक्षृ ों की कटाई/ प्रत्यारोपण िरूु करन ेस ेपिल ेजनम्नजलजखत ितों को पूरा दकया िाएगा:-
a. दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में उपभोगी संस्ट्था द्वारा संबंजधत वृक्ष अजधकारी को जवस्ट्तृत
वृक्षारोपण कायवक्रम प्रस्ट्तुत प्रस्ट्तुत दकया िाएगा ।
b. उपभोगी संस्ट्था द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा ।
c. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई/ प्रत्यारोपण से पूवव कोई लंजबत मुकिमेबािी या स्ट्थगन
आिेि दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो ।
d. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायव सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा ।
e. उपभोगी संस्ट्था के द्वारा वन मंिूरी में और अन्य मंिूरी में उजल्लजखत सभी ितों ितों, यदि कोई िो, का जनष्ठापूववक पालन दकया
िाएगा ।
3. वक्षृ ों की कटाई के िौरान जनम्नजलजखत ितों को पूरा दकया िाएगा:-
a. क्र.स.ं 2 में ितों के संतुष्ट िोने के तुरंत बाि उपभोगी संस्ट्था द्वारा वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ: मिीने के
अंतराल में पूणव दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणव िोने का बाि एक सम्पूणव ररपोटव संबजन्धत वृक्ष अजधकारी को प्रस्ट्ततु
की िायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम निीं िोनी चाजिए ।
b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।4 DELHI GAZETTE : EXTRAORDINARY PART IV]
c. उपभोगी संस्ट्था द्वारा 56 वृक्षो को काटने से पूवव प्रत्यारोपण दकया िाएगा । 56 वृक्षो की अनुमजत 637 वृक्षो के सफल प्रत्यारोपण
और mi& ou laj{kd (पजिम) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी ।
d. उपभोगी संस्ट्था द्वारा प्रजतरोपण/ कटाई की प्रगजत ररपोटव संबंजधत वृक्ष अजधकारी को वृक्षों के पूणव जववरण के साथ प्रस्ट्तुत की
िाएगी ।
e. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ै तो उसे तब तक निीं काटा / प्रत्यारोपण दकया िाएगा िब तक दक
पक्षी उसे छोड़ न िें ।
f. उपभोगी संस्ट्था द्वारा 693 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 के
अन्तगतव एक अपराध िोगा A
g. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िान े के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को
सरकार के खाते मे रािस्ट्व के रूप में िमा की िाएगीA
h. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds उपरान्त izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud
“konkgks a es a iz;ksx gsrq सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (पजिम) को भी िी िाएगी ।
i. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के स्ट्थल से लकजड़यों को ys tkus ls iwo Z o`{k vf/kdkjh ¼पजिम½ ls <yq kbZ vueq fr

j. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावविजनक श्मिान मे 90 दिनों
के अंिर पूरा दकया िाएगा ।
k. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तवत निीं दकया िाएगा ।
l. उपभोगी संस्ट्था के द्वारा वन मंिूरी में और अन्य मंिूरी में उजल्लजखत सभी ितों ितों, यदि कोई िो, का जनष्ठापूववक पालन दकया
िाएगा ।
m. उपभोगी संस्ट्था के द्वारा अनुमोदित वृक्ष संरक्षण योिना के अंतगवत प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठापूववक पालन दकया िाएगा ।
n. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के अंतगवत सभी प्रावधानों
का जनष्ठापूववक पालन दकया गया ि ैऔर इसका जववरण संबंजधत वृक्ष अजधकारी को प्रस्ट्तुत दकया िाएगा ।
o. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट ऊंचाई और कम से कम 6 इंच
व्यास वाले स्ट्विेिी वृक्ष प्रिाजतयों में िीजवत निीं रि पाते ि,ैं तो उन्ि ें1:5 के अनुपात में लगाया िाएगा । आवश्यक अजतररक्त

4. वक्षृ अजधकारी द्वारा सफल वक्षृ ारोपण और िमानत राजि िारी करन ेपर जवचार करन ेके जलए जनम्नजलजखत ितों को पूरा दकया िाएगा:
a. उपरोक्त ताजलका 1 (क) और (ख) के अनुसार, िेिी प्रिाजतयों के 6930 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात
वर्षो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगाA इस वृक्षारोपण के सफलतापूववक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा
जनगरानी की िाएगी A
b. 693 वृक्षो के प्रत्यारोपण/ काटे दकए िाने के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाल े
6930 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीने
के अंिर जनधावररत की गई भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के
द्वारा दकया िाएगा और अजग्रम सात (7) वर्षों के जलए रखरखाव तथा उसके बाि उनका रखरखाव उपभोगी संस्ट्था द्वारा
अपनी स्ट्वयं की लागत पर दकया िाएगा ।
c. यदि उपभोगी संस्ट्था सफलतापूववक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि ै । उपभोगी संस्ट्था द्वारा अजतररक्त साइट
सुधार खचों को िमा दकया िाएगा िो दक सम्बंजधत वृक्ष अजधकारी द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुक्त
बनाने के जलए आवश्यक िो सकती ि ै ।
d. िो भूजम प्रजतपूरक वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य

e. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्य िीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधावररत
करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षव के अंत में वृक्ष अजधकारी ¼पजिम½ को प्रस्ट्तुत की िाएगी ।
f. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो ।
g. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण कायव की गजतजवजधयों को दकया िाएगा।
h. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तवत निीं दकया िाएगा ।
5. 693 वृक्षो को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजक्त के िावे के पक्षपात के जबना, िो
वृक्षो और भूजम पर सिी िो सकती ि,ै िी िा रिी ि ै।

F. No. 59/WFD/COT/20-21/2316-23.—In exercise of the powers conferred by section 29 of the Delhi
Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby,
in public interest exempts an area of 4.33 ha. approx. as detailed below for construction of storm water drain at Sector-
08, Dwarka to Cater discharge of Airport under Nazul Account-II, New Delhi from the provision of sub-section (3) of
section 9 of the said Act.

TERMS & CONDITIONS
1. Delhi Development Authority (DDA), herein referred to as User Agency, shall make an advance deposit of
an amount of Rs. 3,95,01,000 /- (Rs. Three Crore Ninety Five Lakh One Thousand Only) towards security
deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same
shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3
& 4 are not followed by User Agency. However ensuring Compensatory Plantation and transplantation shall be
responsibility of DDA. For any deviation from these conditions DDA shall be responsible. Photographic/
videographic evidence in due course shall be submitted to Tree Officer concerned by User Agency.

2. The following conditions shall be fulfilled before starting felling/ transplantation of trees by User
Agency:
a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer in
compliance with Section 12 of Delhi Preservation of Trees Act, 1994.
b. User Agency shall submit a detailed plan for site preparation and plantation.
c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily
be obtained by the User Agency.
e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
3. The following conditions shall be fulfilled during the felling of trees:
a. Transplantation of trees shall be initiated immediately after conditions in SN 2 is satisfied and should be
completed not later than six (06) months of such date, after which a completion report has to be submitted
to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to
point) at transplantation site.
b. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
c. The transplantation shall be carried out prior to felling of 56 nos. of trees permitted herein. The 56 trees
shall be removed/ felled after successful transplantation of 637 trees and submission of compliance
certificate to DCF (West).
d. The progress report of transplantation/ felling shall be submitted by User Agency to concern Tree Officer
along with complete details of trees.
e. If any tree is found to have nest of birds it should not be felled/ transplanted till the same is abandoned by
the birds.
f. Transplantation/ felling of any tree apart from 693 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act (DPTA), 1994.
g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue
to the Government account by the User Agency.
h. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (West) by User Agency.
i. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said
wood shall be obtained from the DCF (West) by User Agency.8 DELHI GAZETTE : EXTRAORDINARY PART IV]
j. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public
crematorium shall be completed within 90 days by User Agency.
k. The User Agency shall ensure that the plan of this proposal shall not be changed.
l. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.
n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy 2020 have been
followed and details of the same should be submitted to Tree Officer concerned.
o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15
feet height and atleast 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided
by User Agency & plantation has to be done at own cost.
4. The following conditions shall be fulfilled for considering successful plantation &release of Security
Deposit by the Tree officer:
a. 100% Compensatory Plantation of 6930 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as mentioned on table SN 1(a) &
(b) above.
b. 6930 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in
ratio of 1:10 on non-forest land in lieu of felling/ transplantation 693 no. of trees. The plantation shall be
done by following site specific plantation techniques with additional measures on identified land within
three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried
out there after by User Agency with their own funds.
c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit
extra site improvement expenses which may be required to make the site suitable for plantation as
calculated by Tree Officer concerned (as deposits).
d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other
purpose without the approval of the State Government.
e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,
Govt. of NCT of Delhi and a copy of the same shall be submitted to the Tree Officer (West) at the end of
every financial year.
f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory
plantation/ transplantation.
g. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation site.
h. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. Permission for transplantation/ felling of 693 tress is being granted at their own risk and without prejudice to
the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
This issues with prior approval of Hon’ble Minister (Environment & Forests), Govt. of NCT of Delhi.
