जनयम और ित ें
1. दिल्ली मरे ो रेल कॉपोरेिन, िो दक उपभोगी संस्ट्था के रूप में संिर्भात िै, को सात वर्षों की अवजध के जलए पौधों
के सम्पूणा जवकास एवं रिरिाव िते ु उपरोिानुसार 1,80,12,000/- रुपय े (एक करोड़ अस्ट्सी लाि बारि ििार
@ रु. 57000/- प्रजत वृक्ष) की राजि अजिम रूप से िमा करवानी िोगी और यदि उपभोगी संस्ट्था द्वारा 2, 3 और
4 में उजल्लजित जनयमों और ितों का पालन निीं दकया िाता िै, तो इस राजि को िब्त कर जलया िाएगा और
इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए उपयोग दकया िाएगा ।
2. उपभोगी सस्ट्ं था द्वारा वक्षृ ों का प्रत्यारोपण/कटाई िरूु करन ेस ेपिल ेपरू ी की िान ेवाली आवश्यक ितें:-
a. दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 की धारा 12 के अनपु ालन में उपभोगी संस्ट्था द्वारा संबंजधत वृक्ष
अजधकारी/उप-वन संरक्षक को जवस्ट्तृत वृक्षारोपण कायाक्रम प्रस्ट्ततु दकया िाएगा ।
b. उपभोगी संस्ट्था द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा ।
c. उपभोगी संस्ट्था केद्वारा यि सुजनजित दकया िायेगा दक वृक्षों की कटाई/ प्रत्यारोपण से पूवा कोई लंजबत
मुकिमा या स्ट्थगन आिेि दकसी भी न्यायालय/अन्य प्राजधकरण द्वारा पाररत न हुआ िो।
d. उपभोगी संस्ट्था द्वारा वृक्षों को िटाने का काया सभी वैधाजनक मंिूररयों को लेन े के बाि िी िुरू दकया
िाएगा।
e. उपभोगी संस्ट्था के द्वारा वनमंिूरी में और अन्य मंिूरी म ें उजल्लजित सभी ितों, यदि कोई िो, का
जनष्ठापूवाक पालन दकया िाएगा ।
f. यि उस पररयोिना का जिस्ट्सा ि ैजिसमें वन (संरक्षण) अजधजनयम के तित वन भूजम का व्यपवतान
(diversion) िाजमल ि।ै इसजलए, उपभोगी संस्ट्था

g. ररि मैनेिमेंट बोडा द्वारा स्ट्वीकृत और माननीय सवोच्च न्यायालय द्वारा अनुमोदित पररयोिना के जलए
जनधााररत पररयोिना लागत का 5% ररि मैनेिमेंट बोड ा के पास उपभोगी संस्ट्था द्वारा िमा दकया िायेगा
और इसे संबंजधत वृक्ष अजधकारी/उप-वन सरं क्षक को अवगत कराया िाये।
3. वक्षृ ों के कटाई के िौरान परू ी की िान ेवाली आवश्यक ित:ें -
a. क्र.स.ं 2 में ितों के अनुपालन िोने के तुरंत बाि उपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण िरूु दकया
िाएगा और इसे छ:मिीने के अंतराल में पणू ा दकया िाएगा। प्रत्यारोपण प्रदक्रया के पणू ा िोने का बाि एक
सम्पूणा ररपोटा संबंजधत वृक्ष अजधकारी/उप-वन सरं क्षक को प्रस्ट्तुत की िायेगी। प्रत्यारोपण स्ट्थल म ें
प्रत्यारोजपत वृक्षों की िरू ी 4 मीटर (बबंि ुसे बबंि)ु स ेकम निीं िोनी चाजिए।
b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 म ेंउजल्लजित सभी ितों का पालन दकया िाएगा।
c. उपभोगी संस्ट्था द्वारा 131 वृक्षों को काटन े से पूवा प्रत्यारोपण दकया िाएगा। 131 वृक्षो की अनुमजत 185
वृक्षों के सफल प्रत्यारोपण और संबंजधत वृक्ष अजधकारी/उप-वन संरक्षक को अनुपालन प्रमाण पत्र प्रस्ट्तुत
करने के बाि िी िायेगी।
d. उपभोगी संस्ट्था द्वारा प्रत्यारोपण/काटे िाने वाले वृक्षों की प्रगजत ररपोटा संबंजधत वृक्ष अजधकारी/उप-वन
संरक्षक को वृक्षों के पूण ा जववरण के साथ प्रस्ट्ततु की िाएगी।
e. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ै तो उसे तब तक निीं काटा/प्रत्यारोपण दकया िाएगा
िब तक दक पक्षी उसे स्ट्वतः छोड़ न िें।
f. उपभोगी संस्ट्था द्वारा 316 वक्षृ ों के अलावा दकसी भी वृक्ष की कटाई/प्रत्यारोपण दिल्ली वृक्ष संरक्षण
अजधजनयम, 1994 के अन्तगता एक अपराध िोगा।
g. उपभोगी संस्ट्था द्वारा वृक्षों को िटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उसस े
प्राप्त धनराजि को सरकार के िाते मे रािस्ट्व के रूप म ेंिमा की िाएगी।
h. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िािाओं को काटे िाने के उपरान्त प्राप्त लकजड़यों को मुफ्त म ें
जनकटतम सावािजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना संबंजधत वृक्ष अजधकारी/उप-
वन संरक्षक को भी िी िाएगी।
i. उपभोगी संस्ट्था द्वारा वृक्षों को िटाए िान े के स्ट्थल स े लकजड़यों को को ल े िान े स े पूव ा संबंजधत वृक्ष
अजधकारी/उप-वन संरक्षक से ढुलाई अनुमजत प्राप्त करनी िोगी।
j. उपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण और उसम ें पैिा िोने वाली वन उपि को सावािजनक श्मिान म े
90 दिनों के अंिर परू ा दकया िाएगा।
k. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया
िाएगा।
l. उपभोगी संस्ट्था के द्वारा वनमंिूरी में और अन्य मंिूरी म ें उजल्लजित सभी ितों, यदि कोई िो, का
जनष्ठापूवाक पालन दकया िाएगा।
m. उपभोगी संस्ट्था के द्वारा अनुमोदित वृक्ष संरक्षण योिना के अंतगात प्रस्ट्ततु सभी गजतजवजधयों का जनष्ठापूवाक
पालन दकया िाएगा।
n. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के
अंतगता सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया ि ै और इसका जववरण सम्बंजधत वृक्ष अजधकारी/
उप-वन संरक्षक को प्रस्ट्तुत दकया िाएगा।
o. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट ऊंचाई
और कम से कम 6 इंच व्यास वाले स्ट्विेिी वृक्ष प्रिाजतयों में िीजवत निीं रिपाते िैं, तो उन्ि ें 1:5 के
अनुपात में लगाया िाएगा। आवश्यक अजतररि भूजम उपभोगी संस्ट्था द्वारा प्रिान की िाएगी और
वृक्षारोपण स्ट्वय ंकी लागत पर दकया िाएगा।4 DELHI GAZETTE : EXTRAORDINARY PART IV]
4. वक्षृ अजधकारी /उप वन सरं क्षक द्वारा सफल वक्षृ ारोपण और सरु क्षा िमा राजि िारी करन े पर जवचार करन े के
जलए आवश्यक ित ें:-
a. उपरोि ताजलका 1 (क) और (ि) के अनुसार, िेिी प्रिाजतयों के 3160 पौधों का 100% प्रजतपरू क
वृक्षारोपण और उनका सात वर्षों तक रिरिाव उपभोगी सस्ट्ं था द्वारा दकया िायेगा। इस वृक्षारोपण के
सफलता पूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी।
b. 316 वृक्षों के प्रत्यारोपण/काटे दकए िाने के बिले म े 1:10 के अनुपात म ेस्ट्विेिी प्रिाजतयों के 6-8 फीट की
ऊाँचाई वाल े 3160 पौधों का प्रजतपूरक वृक्षारोपण गरै -वन भूजम पर दकया िाएगा। वृक्षारोपण की अनुमजत
के िारी िोने के तीन मिीने के अंिर जनधााररत की गई भूजम पर अजतररि उपायों के साथ वृक्षारोपण स्ट्थल
के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वर्षों के जलए रिरिाव
तथा उसके बाि उनका रिरिाव उपभोगी संस्ट्था द्वारा अपनी स्ट्वयं की लागत पर दकया िाएगा।
c. यदि उपभोगी संस्ट्था सफलता पूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्था द्वारा
अजतररि साइट सुधार िचों को िमा दकया िाएगािो दक सम्बंजधत वृक्ष अजधकारी/उप-वन संरक्षक द्वारा
गणना के अनुसार वृक्षारोपण के जलए उपयुि बनाने के जलए आवश्यक िो सकती ि।ै
d. िो भूजम प्रजतपरू क वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए आवंरटत िै, उसका उपयोग दकसी अन्य कायों के
जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया िाएगा।
e. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली
सरकार को जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में सम्बंजधत वृक्ष अजधकारी/
उप-वन संरक्षक को प्रस्ट्तुत की िाएगी।
f. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण के जलए प्रस्ट्ताजवत क्षेत्र म ें
कोई अजतक्रमण न िो ।
g. उपभोगी संस्ट्था द्वारा प्रजतपरू क वृक्षारोपण/प्रत्यारोपण स्ट्थल म ें मृिा नमी सरं क्षण काया की गजतजवजधयों को
दकया िाएगा।
h. उपभोगी संस्ट्था के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया
िाएगा।
i. यदि पररयोिना लागत संिोजधत िो िाती िै, तो अजतररि सुरक्षा राजि िारी करन े के अनुरोध से पिल े

F. No. 6575/TO(N)/TC-Felling/Transplantation/22-23/10886-93.—In exercise of the powers conferred by
section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital
Territory of Delhi, hereby, in public interest exempts an area of 2.176ha approx.for construction of Janakpuri to
Derawal Nagar of R.K. Ashram (at Derawal Nagar Cut & Cover) Corridor of Delhi MRTS Project Phase-IV, New
Delhi from the provision of sub-section (3) of section 9 of the said Act.

TERMS AND CONDITIONS
1. Delhi Metro Rail Corporation (DMRC) herein referred to as User Agency, shall make an advance deposit of
an amount of Rs.1,80,12,000/-/- (Rupees One CroreEighty Lakh Twelve Thousand Only @ Rs. 57000/- per tree)
towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7)
years and the same shall be forfeited and utilizedfor plantation by the Forest Department if terms and conditions
mentioned at 2, 3 & 4 are not followed by User Agency.
2. The conditions required to be fulfilled before starting transplantation/ felling of trees by User Agency:-
a. Detailed plantation schedule shall have to be submitted by User Agency to the concerned Tree Officer /
Deputy Conservator of Forests in compliance with Section-12 of Delhi Preservation of Trees Act, 1994.
b. User Agency shall submit a detailed plan for site preparation and plantation.
c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be
obtained by the User Agency.
e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
f. This is part of project in which diversion of forest land under Forest (Conservation) Act, 1980 is involved.
Hence, guidelines as per Handbook of FCA should be followed scrupulously by User Agency

g. 5% of the project cost as prescribed for project cleared by Ridge Management Board and approved by
Hon’ble Supreme Court should be deposited with Ridge Management Board and the same is conveyed to
concerned Tree Officer / Deputy Conservator of Forests.
3. The conditions required to be fulfilled during the felling of trees:-6 DELHI GAZETTE : EXTRAORDINARY PART IV]
a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and should
be completed not later than six (06) months of such date, after which a completion report has to be submitted
to theconcerned Tree Officer / Deputy Conservator of Forests. The spacing of the transplantation of trees
shall not be less than 4 meter (point to point) at transplantation site.
b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by User
Agency.
c. The transplantation shall be carried out prior to felling of 131 numbers of trees permitted herein. The 131
trees shall be removed/felled after successful transplantation of 185 trees and submission of compliance
certificate to concerned Tree Officer / Deputy Conservator of Forests.
d. The progress report of transplantation/ fellingshall be submitted to concerned Tree Officer / Deputy
Conservator of Forests along with complete details of trees by the User Agency.
e. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by
the birds.
f. Transplantation / felling of any tree apart from 316 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act (DPTA), 1994.
g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
h. The lops& tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same
should be reported to concerned Tree Officer / Deputy Conservator of Forests by User Agency.
i. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the # Tree Officer / Deputy Conservator of Forests by User Agency.
j. Transplantation of trees and transportation of forest produce arising there from to the public crematorium
shall be completed within 90 days.
k. The User Agency shall ensure that the plan of this proposal shall not be changed.
l. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.
n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have been
followed and details of the same should be submitted to theTree Officer/Deputy Conservator of Forests
concerned.
o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15
feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by
User Agency & plantation has to be done at own cost.
4. The conditions required to be fulfilled for considering successful plantation & release of Security Deposit
by the Tree Officer/Deputy Conservator of Forests :-
a. 100% Compensatory Plantation of 3160 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as mentioned on table above.
b. 3160 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio
of 1:10 on non-forest land in lieu of felling/ transplantation 316 no. of trees. The plantation shall be done by
following site specific plantation techniques with additional measures on identified land within three months
of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after
by User Agency with their own funds.
c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit
extra site improvement expenses which may be required to make the site suitable for plantation as calculated
by Tree Officer / Deputy Conservator of Forests concerned (as deposits).
d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other
purpose without the approval of the State Government.
e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,
Government of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer /
Deputy Conservator of Forests at the end of every financial year.[PART IV DELHI GAZETTE : EXTRAORDINARY 7
f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory
plantation/ transplantation.
g. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation site.
h. The User Agency shall ensure that the plan of this proposal shall not be changed.
i. If project costs get revised, the additional amount should be deposited with Ridge Management Board before
requesting for release of security deposit.
5. Permission for transplantation/felling of 316 numbers of tress is being granted to the User Agency at their
own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over
the land or the trees.
