L.-33004/99 सी.जी.-डी.एल.-अ.-15072026-274508 CG-DxLx-xEG-I1D5H0x7x2x0 26-274508 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 537] नई दिल्ली, बुधवार, िुलाई 8, 2026/आिाढ 17, 1948 No. 537] NEW DELHI, WEDNESDAY, JULY 8, 2026/ASHADHA 17, 1948 पत्त न पोत पररवहन और िलमाग ग मत्रं ालय अजधसचू ना नई दिल्ली, 8 िुलाई, 2026 सा.का.जन. 595(अ).— केन्‍द रीय सरकार, वाजणज् य पोत पररवहन अजधजनयम, 2005 (2025 का 24) की धारा 143 की उपधारा (1) और (2) के साथ परित धारा 133 की उपधारा (2) और (5), धारा 134 धारा 135 की उपधारा (2) द्वारा प्रित् त िजियों का प्रयोग करते हुए, और वाजणज् य पोत पररवहन (कलुजित प्रणाली का जनयंत्रण) जनयम, 2016 को उन बातों के जसवाय अजधक्ातं करत े हुए, जिन्‍द ह ें ऐसे अजधक्मण से पूवग दकया गया है, या करन े का लोप दकया गया है, जनम्न जलजखत जनयम बनाती ह,ै अथागत:- 1. सजं िप्त िीिकग और प्रारंभ.- (1) इन जनयमों का संजिप्त नाम वाजणज् य पोत पररवहन (कलुजित प्रणाली का जनयंत्रण) जनयम, 2026 ह।ै (2) ये रािपत्र में इनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. लाग ू होना.- िब तक दक अन्‍दय था उपबंजधत न हो, ये जनयम जनम् नजलजखत पर लागू होंगे- (क) भारतीय िलयान और भारत में पंिीकृत प्रत्य ेक अन्‍द य िलयान; 5127 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) ऐसे िलयान िो भारत का ध्व ि फहराने के हकिार नहीं हैं, दकन्‍द त ु भारत के प्राजधकार के अधीन संचाजलत होत े ह;ैं (ग) िलयान िो भारत में या तटीय िल म ें दकसी पत्त न, पोत प्रांगण या अपतटीय टर्मगनल या स्ट् थान में प्रवेि करता ह।ै 3. पररभािाए.ँ – (1) इन जनयमों में, िब तक दक संिभग से अन्‍द यथा अपेजित न हो, - (क) “ अजधजनयम” से वाजणज् य पोत पररवहन अजधजनयम, 2005 (2025 का 24) अजभप्रेत ह;ै (ख) “प्रिासन” से दकसी अन्‍द य राज् य का झंडा फहराने के हकिार दकसी िलयान के संबंध में उस राज् य की सरकार अजभप्रेत है, और तट के समीप समुर तलएवं उसकी उप-मृिा के अन्‍द वेिण और िोहन में लगे जस्ट्थर या तरै त े प्ल ेटफामग के संबंध म,ें जिसके ऊपर तटीय राज् य अपने प्राकृजतक संसाधनों के अन्‍द वेिण और िोहन के प्रयोिनों के जलए संप्रभु अजधकारों का प्रयोग करता ह,ै प्रिासन से संबंजधत तटीय राज् य की सरकार अजभप्रेत ह;ै (ग) “कलुजित प्रणाली” से एक कोटटंग, पेंट, सतह उपचार, सतहया युजि अजभप्रेत ह ैजिसका एपयोग दकसी िलयान पर अवांजित िीवों के लगाव को जनयंजत्रत करन ेया रोकने के जलए दकया िाता ह;ै (घ) “प्रमाणपत्र ” से यथाजस्ट्थजत अंतरागष्‍टर ीय कलुजित प्रणाली प्रमाणपत्र या भारतीय कलुजित प्रणाली प्रमाणपत्र अजभप्रेत ह;ै (ङ) “अजभसमय” से पोतों पर हाजनकारक कलुजित प्रणाली के जनयंत्रण पर अंतरागष्‍टर ीय अजभसमय, 2001 अजभप्रेत ह,ै जिसे समय-समय पर संिोजधत दकया गया ह;ै (च) “अंतरागष्‍टर ीय िलयात्रा” से भारत में दकसी पत् तन या स्ट्थ ान से भारत के बाहर दकसी पत् तन या स्ट्थ ान तक या वहां सं भारत के बाहर दकन्‍द हीं पत्त् नों के बीच की यात्रा अजभप्रते ह;ै (छ) “लंबाई” से अजधजनयम के अधीन लोड लाइन से संबंजधत बनाए गए लाग ूजनयमों में पररभाजित लंबाई अजभप्रेत ह;ै (ि) “संगिन” स े अंतरराष्ट्रीय समुरी संगिन अजभप्रेत ह;ै (झ) “मान्‍दयता प्राप्त संगिन” गेम स ेऐसे संगिन जिसका मूल्यांकन और अनुमोिन महाजनिेिक द्वारा उसकी ओर से आज्ञापक अंतरराष्ट्रीय समुरी संगिन उपकरणों और राष्ट्रीय जवधान के अधीन प्रत्यायोजित कानूनी प्रमाणीकरण और सेवाओं के जनष्‍टपािन के जलए दकया गया ह ै और जिस े संिोजधत रूप म ें अंतरराष्ट्रीय समुरी संगिन संकल्प एमएससी 349 (92) द्वारा अपनाए गए मान्‍दयता प्राप्त संगिन संजहता का अनुपालन करत े हुए पाया गया ह,ै अजभप्रेत ह;ै (ञ) “अनुसूची” से इन जनयमों के साथ संलग्न अनुसूची अजभप्रेत ह।ै (2) िब्िों और पिों के, िो इन जनयमों में प्रयुि हुए ह ैं और पररभाजित नहीं ह ैं ककंतु अजधजनयम म ें पररभाजित ह,ै वही अथ ग होंग े िो उस अजधजनयम में क्मिः उनके ह।ैं 4. कलजु ित प्रणाली जनयत्रं ण .- (1) सूची में बस जवजनर्िगष्ट अपेिाओं के अनुसार जनयम िो के खंड (क) या (ख) म ें जनर्िगष्ट िलयानों पर हाजनकारक कलुजित प्रणाली का उपयोिन, पुन: उपयोिन, संस्ट्थापन या प्रयोग प्रजतजिद्ध ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (2) अनुसूची में जवजनर्िगष्‍ट ट अपेिाओं के अनुसार, जनयम, 2 के खंड (ग) में जनर्िगष्‍ट ट िलयानों पर भारत में दकसी पत् तन, पोत प्रांगण या अपतटीय टर्मगनल में ऐसी प्रणाजलयों का अनुप्रयोग, पुन: अनुप्रयोग, संस्ट्थ ापन या उपयोग प्रजतजिद्ध ह।ै 5. सविे ण और प्रमाणीकरण की प्रदक्या- (1) जनयम िो के खंड (क) में जनर्िगष्ट 400 सकल टन भार और उससे अजधक के सभी िलयान, िो अंतरागष्ट्रीय िलयात्रा ओं में लग े ह ैं या तटीय िल में चलते ह,ैं जस्ट्थर या तरत े हुए फ्लेटफामग, तैरते हुए संग्रह इकाई और तरै ते हुए उत्पािन संग्रह और ऑफलोडडंग यूजनट को िोड़कर, नीच े बताए गए सवेिण के अधीन होंगे, अथागत:् - (क) िलयान को सेवा में लाने से पहले, या यथाजस्ट्थजत अतं रागष्ट्रीय कलुजित प्रणाली प्रमाणपत्र या भारतीय कलुजित प्रणाली प्रमाणपत्र, पहली बार िारी होने स े पहल े एक आरंजभक सवेिण; और (ख) सवेिण, िब कलुजित प्रणाली को बिल दिया गया हो या प्रजतस्ट्थ ाजपत कर दिया गया हो, और ऐसे बिलाव या प्रजतस्ट्थ ापन को यथाजस्ट्थजत अतं रागष्ट्रीय कलुजित प्रणाली प्रमाणपत्र या भारतीय कलुजित प्रणाली प्रमाणपत्र पर पृष्‍ट िांदकत दकया गया हो, (2) उप – जनयम (1) में संिर्भगत सवेिण इस प्रकार दकए िाएंगे, जिसस ेयह सजु नजित हो सके दक िलयान की कलुजित प्रणाली इन जनयमों तथा अजभसमय के उपबंधों के अनुरूप ह ै तथा उनका पूणगत: अनुपालन करती ह।ै (3) उप-जनयम (1) में जनर्िगष्ट पोतों का सवेिण, सवेिकों द्वारा अजधजनयम के अधीन बनाए गए लाग ू जनयमों के अनसु ार दकया िाएगा । (4) िब सवेिक यह तय करता दक िलयान का कलुजित प्रणाली अंतरागष्ट्रीय कलुजित प्रणाली प्रमाणपत्र या भारतीय कलुजित प्रणाली प्रमाणपत्र, या इन जनयमों या अजभसमय के जनयमों के अनुसार नहीं है, तो सवेिक तुरंत यह सुजनजित करेगा दक िलयान को जनयमों के अनुसार से लाने के जलए सुधार के किम उिाए िाएं, और सवेिक ऐसे दकसी भी जनणगय के बारे म ें महाजनिेिक को बताएगा। (5) उपजनयम (4) में जनर्िगष्‍ट ट सुधारात् मक कारगवाई का अनुपालन नहीं दकया िाता है, तो महाजनिेिक को तत् काल जलजखत रूप में सूजचत दकया िाएगा और यथाजस्ट्थजत, अतं रागष्ट्रीय कलुजित प्रणाली प्रमाणपत्र या भारतीय कलुजित प्रणाली प्रमाणपत्र िारी नहीं दकया िाएगा या यदि पहले ही िारी दकया िा चकु ा है, तो संबंजधत प्रमाणपत्र महाजनिेिक द्वारा आिेि द्वारा वापस ले जलया िाएगा। (6) उपजनयम (4) या (5) में जवजनर्िगष्‍ट ट जस्ट्थजत में, यदि िलयान दकसी अन्‍द य राज् य के पत् तन पर ह,ै तो पत् तन राज् य के उपयुक् त प्राजधकाररयों को महाजनिेिक द्वारा तरु ंत जलजखत रूप में सूजचत दकया िाएगा। (7) महाजनिेिक उन िलयानों के जलए उपयुक् त उपाय जनर्िगष्‍ट ट करेंगे िो उप-जनयम (1) के उपबंधों के अधीन नहीं ह ैं तादक यह सुजनजित दकया िा सके दक इन जनयमों का अनुपालन दकया िाए।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 6. अतं राष्ट्रग ीय कलजु ित प्रणाली प्रमाणपत्र या भारतीय कलजु ित प्रणाली प्रमाणपत्र िारी करना या उसका समथनग करना - (1) महाजनिेिक या कोई मान्‍द यता प्राप्त संगिन जनयम 5 के अनुसार सवेिण के सफलतापूवगक पूरा होन े के पश् चात, यह िारी या पृष्‍ट िांदकत करेगा दक वह – (क) जनयम 5 के उप-जनयम (1) में जनर्िगष्‍ट ट िलयानों के जलए भारतीय कलुजित प्रणाली प्रमाणपत्र, िो 400 सकल टनभार और उससे अजधक के ह ैं तथा अंतरागष्‍टर ीय िलयात्रा में लगे ह;ैं या (ख) जनयम 5 के उप-जनयम (1) में जनर्िगष्‍ट ट िलयानों के जलए भारतीय कलुजित प्रणाली प्रमाणपत्र, िो 400 सकल टनभार और उससे अजधक के हो, प्रत् येक प्रकार के िलयान के जलए लागू उजचत ितों के साथ और िो अंतरागष्‍टर ीय यात्रा में िाजमल नहीं ह;ैं या (ग) भारतीय कलुजित प्रणाली प्रमाणपत्र, भारतीय िलयान को िो भारतीय झंडा फहराने का हकिार ह ै और जिसका विन 400 सकल टनभार से कम है, प्रत् येक तरह के िलयान के जलए लागू सही ितों के साथ और िो अंतरागष्‍टर ीय यात्रा में िाजमल नहीं ह।ै (2) प्रमाणपत्र और अजभलेख, यथाजस्ट्थजत, प्ररूप 1 अथवा प्ररूप 2 में होगा। (3) इस जनयम के अधीन िारी प्रमाणपत्रों पर महाजनिेिक द्वारा पृष्‍टि ांदकत होगा और महाजनिेिक प्रमाणपत्र के जलए पूणग जिम् मेिारी लेंगे। (4) अनुसूची के अधीन जनयजं त्रत कलुजित प्रणाली वाल े िलयानों के जलए, िो ऐसी प्रणाली के जलए जनयंत्रण के प्रवृत्त होन े की तारीख स े पहले लागू दकया गया था, महाजनिेिक उस जनयंत्रण के लागू होन े के िो वि ग के भीतर इस जनयम के उपबंधों के अनसु ार एक प्रमाण पत्र िारी करेगा। 7. दकसी िसू रे प्रिासन के अनरु ोध पर महाजनििे क द्वारा अतं राष्‍टग र ीय कलजु ित प्रणाली प्रमाणपत्र िारी करना या उसका पष्‍टृ ि ाकं न करना – (1) दकसी प्रिासन के अनुरोध पर, जिस पर अजभसमय लागू होता है, महाजनिेिक संबंजधत प्रिासन के दकसी िलयान का सवेिण करवा सकता ह ै और सतं ुष्‍टट होने पर, िलयान को अंतरागष्ट्रीय कलुजित प्रणाली प्रमाणपत्र िारी करेगा या िारी करने के जलए अजधकृत करेगा और िहां सही होगा, अजभसमय के अनुसार िलयान के जलए अंतरागष्‍टर ीय कलुजित प्रणाली प्रमाणपत्र का पृष्‍टि ांकन करेगा या उसके समथगन को अजधकृत करेगा। (2) इस जनयम के उपजनयम (1) का अनुपालन करन े पर प्रमाण-पत्र की एक प्रजत और सवेिण ररपोटग की एक प्रजत यथािीघ्र संबंजधत प्रिासन को प्रेजित की िाएगी। (3) इस प्रकार िारी दकए गए प्रमाणपत्र में यह कथन होगा दक यह संबंजधत प्रिासन के अनुरोध पर िारी दकया गया ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (4) िहा ं सवेिण दकसी भारतीय िलयान के जलए दकया िाना ह ै िो दकसी प्रिासन के अजधकार िेत्र में है, वहा ं महाजनिेिक उस प्रिासन से अजभसमय के जनयमों के अनुसार सविे ण करने और अंतरागष्‍टर ीय कलुजित प्रमाणपत्र िारी करने का अनरु ोध कर सकते हैं, यदि वह प्रिासन ऐसा करने के जलए अजधकृत ह।ै (5) ऐसे िलयान को कोई प्रमाणपत्र िारी नहीं दकया िाएगा िो ऐसे िेि का झंडा फहराने का हकिार ह ै िो अजभसमय का जहस्ट्स ा नहीं ह।ै 8. अतं राष्ट्रग ीय कलजु ित प्रणाली प्रमाणपत्र या भारतीय कलजु ित प्रणाली प्रमाणपत्र की वधै ता.- (1) जनयम 6 के अधीन िारी अंतरागष्ट्रीय कलुजित प्रणाली प्रमाणपत्र या भारतीय कलुजित प्रणाली प्रमाणपत्र, या जनयम 7 के अधीन िारी अंतरागष्ट्रीय कलुजित प्रणाली प्रमाणपत्र जनम् नजलजखत मामलों में वैध नहीं रहगे ा, अथागत: (क) यदि कलुजित प्रणाली को बिला या प्रजतस्ट्थ ाजपत दकया िाता ह ै और प्रमाणपत्र इन जनयमों के अनुसार पृष्‍ट िांदकत नहीं दकया िाता ह;ै और (ख) िलयान को िसू रे राज् य के झडं े में अंतररत करन े पर। (2) महाजनेिेिक द्वारा दकसी िसू रे राज् य से अंतररत दकए गए िलयान को नया प्रमाणपत्र िारी करना, नए सवेिण या उस जपिले राज् य द्वारा िारी वैध प्रमाणपत्र पर आधाररत हो सकता ह ै जिसका झंडा िलयान पर फहराने का हकिार था। (3) िहां दकसी प्रिासन ने, जिसे कोई भारतीय िलयान अंतररत दकया गया है, अंतरण की तारीख से तीन महीने के भीतर अनुरोध दकया िाता है, तो महाजनिेिक, अजतिीघ्र, उस प्रिासन को अंतरण स े पहल े िलयान के पास जवद्यमान प्रमाणपत्र की एक प्रजत और, अगर उपलब् ध हो, तो संबंजधत सवेिण ररपोटग की एक प्रजत भेि सकेगा। 9. कलजु ित प्रणाली पर घोिणा – (1) जनयम 2 के खंड (क) में जनर्िगष्‍ट ट 24 मीटर या उससे अजधक लंबाई वाले, लेदकन 400 सकल टनभार से कम िलयान को, िो अतं रागष्‍टर ीय िलयात्राओं में लगे ह,ै जिसमें जनयत या फ्लोटटंग फ्लेटफामग फ्लोटटंग भंडारण इकाई, फ्लोटटंग उत् पािन भडं ारण और ऑफ-लोडडंग इकाई सजम्मजलत नहीं ह,ैं स्ट्व ामी या स्ट्व ामी के प्राजधकृत अजभकताग का हस्ट्त ािर दकया हुआ एक घोिणा पत्र रखना उपेजित होगा, और ऐसी घोिणा के साथ सही िस्ट्त ावेि (िैसे पेंट की रसीि या संजविाकता ग का बीिक) या समुजचत पृष्‍टि ांदकत होना चाजहए। (2) उपजनयम (1) में जनर्िगष्‍ट ट घोिणा प्ररूप 3 में होगी। 10. अपजिष्‍टट कलजु ित पिाथ ग के जनयत्रं ण की प्रदक्या. - अनसु ूची में जनर्िगष्ट जनयंत्रण वाल े कलुजित प्रणाली के उपयोग हटाने से जनकलने वाल े अपजिष्‍टट को, पाररसंकटमय और अन्‍दय अपजिष्ट (प्रबंध एवं सीमापार संचलन) जनयम, 2016, और अजधजनयम के अधीन बनाए गए लाग ू जनयमों के अनसु ार, मानवीय स्ट्वास्ट््य और पयागवरण की सुरिा के जलए सरु जित और पयागवरण के अनुसार सही रीजत से एकजत्रत, हडैं ल अजभदक्याजन्‍दवत और जनपटान दकया िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 11. िलयानों का जनरीिण और उल्ल ंघनों का पता लगाना.-(1) दकसी िलयान, जिस पर ये जनयम लागू होते ह,ैं का दकसी भी भारतीय पत् तन, पोत प्रांगण या अपतटीय टर्मगनल में सवेिकों द्वारा जनरीिण यह जनधागररत करने के प्रयोिन स े दकया िा सकेगा दक िलयान इन जनयमों का अनुपालन कर रहा ह ै या नहीं और िब तक यह मानने के जलए स्ट् पष्‍टट आधार जवद्यमान न हों दक िलयान इन जनयमों का उल् लंघन कर रहा ह,ै ऐसा कोई भी जनरीिण जनम्न तक सीजमत होगा- (क) यह सत् याजपत करना दक, िहाँ आवश् यक हो, बोडग पर एक वैध अंतरागष्‍टर ीय कलुजित प्रणाली प्रमाणपत्र या भारतीय कलुजित प्रणाली प्रमाणपत्र या कलुजित प्रणाली पर एक घोिणा है; और (ख) िलयान के कलुजित प्रणाली का एक िोटा सा नमूना, िो आवश् यकता के अनुसार संगिन द्वारा बनाए गए दििाजनिेिों को ध् यान में रखते हुए, कलजु ित प्रणाली की समग्रता, सरं चना या प्रचालन पर प्रभाव न डाले। (2) उप-जनयम (1) के खंड (ख) के अधीन ऐसे नमूने के पररणामों को संसाजधत करन े के जलए अपेजित समय को िलयान की आवािाही और प्रस्ट्थ ान को रोकने के आधार के रूप में उपयोग नहीं दकया िाएगा। (3) यदि यह जवश्वास करन े के जलए स्ट्पष्ट आधार हों दक िलयान इन जनयमों का उल्लंघन कर रहा ह,ै तो संगिन द्वारा जवकजसत दििाजनिेिों को ध्यान में रखते हुए तथा अजधजनयम के अधीन पत्तन राष्ट्र जनयंत्रण और ध्वि राष्ट्र कायागन्‍दवयन से संबंजधत बनाए गए लाग ू जनयमों के अनुसार उसका जवस्ट्तृत जनरीिण दकया िा सकेगा। 12. िडं और प्रवतनग .- (1) इन जनयमों का दकसी भी प्रकार का उल् लंघन या इनकी दकसी आवश् यकता का अनुपालन करने में जवफलता अजधजनयम में जनर्िगष्‍ट ट िंड के जलए उत् तरिायी होगा। (2) कोई भी व् यजि िो इन जनयमों के उपबंधों के उललंघन में दकसी भी िलयान का सचं ालन करता है, और जिसके जलए अजधजनयम की धारा 281 की उपधार (2) के अधीन कोई जवजिष्‍टट िाजस्ट्त उपबंजधत नहीं दकया गया है, वहा,ं पचास हिार रुपए तक के िडं का िायी होगा और यदि उल् लंघन जनरंतर िारी रहता है, तो अजतररक् त िाजस्ट्त के साथ िो उल् लंघन िारी रहने वाले पहल े दिन के पश् चात प्रत् येक दिन के जलए पांच हिार रुपए तक बढाया िा सकता ह ै का िायी होगा। (3) इस जनयम के अधीन कोई भी िाजस्ट्त अजधरोजपत करने स े स्ट् वामी या मास्ट्ट र को अननुपालन को िीक करन े की आवश् यकता से िूट नहीं जमलगे ी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 अनसु चू ी [जनयम 4, 6 और 10 िखे ]ें कलजु ित प्रणाली पर जनयत्रं ण सारणी कलजु ित प्रणाली जनयत्रं ण के उपाय आविे न प्रभावी तारीख ऑगने ोरटन कंपाउंड िो िलयान ऐस े यौजगकों को सभी िलयान 1 िनवरी, 2003 कलुजित प्रणाली म ें लागू या िोबारा लाग ू नहीं बायोसाइड के तौर पर काम करेगा करते ह ैं ऑगने ोरटन कंपाउंड िो िलयान, - [फा. स.ं एस.वाई-19014/198/2025-एम.जी(iii)] मुकेि मंगल,अपर सजचव, MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 8th July, 2026 G.S.R. 595(E).— In exercise of the powers conferred by sub-sections (2) and (5) of section 133, section 134, sub-section (2) of section 135 read with sub-sections (1) and (2) of section 143 of the Merchant Shipping Act, 2025 (24 of 2025), and in supersession of the Merchant Shipping (Control of Anti-Fouling System) Rules, 2016, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely: –[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 1. Short title and commencement. − (1) These rules may be called the Merchant Shipping (Control of Anti-fouling System) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application. – Unless otherwise provided, these rules shall apply to- (a) Indian vessel and every other vessel registered in India; (b) vessel not entitled to fly the flag of India but which operate under the authority of India; (c) vessel that enters a port, shipyard or offshore terminal or place in India or within the coastal waters. 3. Definitions. – (1) In these rules, unless the context otherwise requires, - (a) “Act” means the Merchant Shipping Act, 2025 (24 of 2025); (b) “administration” with respect to a vessel entitled to fly a flag of another State means the Government of that State and with respect to fixed or floating platforms engaged in exploration and exploitation of the sea-bed and subsoil thereof adjacent to the coast over which the coastal State exercises sovereign rights for the purposes of exploration and exploitation of their natural resources, the administration means the Government of the coastal State concerned; (c) “anti-fouling system” means a coating, paint, surface treatment, surface, or device that is used on a vessel to control or prevent attachment of unwanted organisms; (d) “certificate" means an International Anti-Fouling System Certificate or Indian Anti-Fouling System Certificate, as the case may be; (e) “convention” means the International Convention on the Control of Harmful Anti- fouling Systems on Ships, 2001, as amended from time to time; (f) “International voyage” means a voyage from or to a port or place in India to or from a port or place outside India or between any ports outside India; (g) “length” means the length as defined in the applicable rules made under the Act dealing with load line; (h) “Organisation” means the International Maritime Organization; (i) “Recognised Organisation” means an organisation that has been assessed and approved by the Director-General to perform, on its behalf, delegated statutory certification and services under mandatory International Maritime Organization instruments and national legislation and found to comply with the Recognized Organization Code adopted by International Maritime Organization Resolution MSC. 349(92), as amended; (j) “Schedule” means the schedule appended to these rules. (2) Words and expressions used in these rules and not defined but defined in the Act shall have meanings respectively assigned to them in the Act. 4. Controls on anti-fouling systems. – (1) In accordance with the requirements specified in the Schedule, the application, re-application, installation, or use of harmful anti-fouling systems on vessels referred to in clause (a) or (b) of rule 2 is prohibited.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) In accordance with the requirements specified in the Schedule, the application, re-application, installation, or use of such systems, whilst in any port, shipyard, or offshore terminal in India, on vessels referred to in clause (c) of rule 2 is prohibited. 5. Procedure for survey and certification. – (1) All vessels of 400 gross tonnage and above referred to in clause (a) of rule 2, engaged in international voyages or plying in coastal waters, excluding fixed or floating platforms, Floating Storage Units and Floating Production Storage and Offloading Units, shall be subject to surveys as specified below, namely: - (a) an initial survey, before the vessel has been put into service, or before the International Anti-Fouling System Certificate or, the Indian Anti-Fouling System Certificate, as the case may be, is issued for the first time; and (b) a survey, when the anti-fouling systems have been changed or replaced, and such change or replacement has been endorsed on the International Anti-Fouling System Certificate or the Indian Anti-Fouling System Certificate, as the case maybe. (2) The surveys referred to in sub-rule (1) shall be such as to ensure that anti-fouling system of the vessel is in accordance with and fully complies with the provisions of these rules and of the convention. (3) The surveys of the vessels referred to in sub-rule (1) shall be carried out by the surveyors in accordance with the applicable rules made under the Act. (4) When the surveyor determines that the anti-fouling system of the vessel does not confirm either to the particulars of the International Anti-Fouling System Certificate, or the Indian Anti-Fouling System Certificate, or to the provisions of these rules or the Convention, the surveyor shall immediately ensure that corrective action is taken to bring the vessel into compliance, and the surveyor shall notify the Director-General of any such determination. (5) If the corrective action referred to in sub-rule (4) is not complied with, the Director-General shall be informed in writing by the forthwith and the International Anti-Fouling System Certificate or the Indian Anti-Fouling System Certificate, as the case may be, shall not be issued or if already issued, the respective certificate shall, by order, be withdrawn by the Director-General. (6) In a situation specified in sub-rule (4) or (5), if the vessel is in the port of another State, the appropriate authorities of the port State shall be informed forthwith in writing by Director- General. (7) The Director-General shall specify the appropriate measures for vessels that are not subject to the provisions of sub-rule (1) in order to ensure that these rules are complied with. 6. Issue or endorsement of an International Anti-Fouling System Certificate or Indian Anti-Fouling System Certificate. – (1) The Director-General or a recognised organisation shall require, after the successful completion of a survey in accordance with rule 5, to issue or endorse – (a) International Anti-Fouling System Certificate to vessels referred to in sub-rule (1) of rule 5, which is of 400 gross tonnage and above and engaged in an international voyage; or[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17 (b) Indian Anti-Fouling System Certificate to vessels referred to in sub-rule (1) of rule 5, which is of 400 gross tonnage and above, with appropriate conditions as applicable for each type of vessel and not engaged in international voyage; or (c) Indian Anti-Fouling System Certificate to an Indian vessel entitled to fly Indian flag which is below 400 gross tonnage, with appropriate conditions as applicable for each type of vessel and not engaged in international voyage. (2) The certificate and record shall be in Form I or in Form II, as the case may be. (3) The certificates issued under this rule shall be endorsed by the Director-General and the Director-General shall assume full responsibility for the certificate. (4) For vessels bearing an anti-fouling system controlled under the Schedule that was applied before the date of entry into force of a control for such a system, the Director-General shall issue a certificate in accordance with the provisions of this rule not later than two years after entry into force of that control. 7. Issue or Endorsement of an International Anti-Fouling System Certificate by Director- General at the request of another administration. – (1) At the request of an administration to which to the convention applies, the Director- General may cause a vessel of the administration concerned to be surveyed and, if satisfied, shall issue or authorise the issue of International Anti-Fouling System Certificate to the vessel and, where appropriate, endorse or authorise the endorsement of the International Anti-Fouling System Certificate for the vessel in accordance with convention. (2) Upon complying with sub rule (1) of this rule, a copy of the certificate and a copy of the survey report shall be transmitted as soon as possible to the administration concerned. (3) The certificate so issued shall contain a statement that it has been issued at the request of the administration concerned. (4) Where the survey is to be carried out for an Indian vessel which is in the jurisdiction of an administration, the Director-General may request that administration to carry out a survey in accordance with the provisions of the convention and issue an International Anti-fouling certificate, if such administration is authorised to do the same. (5) No certificate shall be issued to a vessel which is entitled to fly the flag of a State which is not a party to the convention. 8. Validity of an International Anti-Fouling System Certificate or Indian Anti-Fouling System Certificate. – (1) The International Anti-Fouling System Certificate or the Indian Anti-Fouling System Certificate issued under rule 6, or the International Anti-Fouling System Certificate issued under rule 7, shall cease to be valid in the following cases, namely: (a) if the anti-fouling system is changed or replaced and the certificate is not endorsed in accordance with the provisions of these rules; and (b) upon transfer of the vessel to the flag of another State. (2) The issue by Director-General of a new certificate to a vessel transferred from another State may be based on a new survey or on a valid certificate issued by the previous state whose flag the vessel was entitled to fly. (3) Where a request has been made by the administration to which an Indian vessel was transferred within three months from the date of transfer, the Director-General may, as soon as possible, transmit to that administration a copy of the certificates carried by the vessel prior to the transfer and, if available, a copy of the relevant survey reports. 9. Declaration on anti-fouling system. – (1) A vessel of 24 meters or more in length referred to in clause (a) of rule 2, but less than 400 gross tonnage, engaged in international voyages, excluding fixed or floating platforms, floating storage units, and floating production storage and off-loading units, shall be18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] required to carry a declaration signed by the owner or owner’s authorised agent, and such declaration shall be accompanied by appropriate documentation (such as a paint receipt or a contractor invoice) or contain appropriate endorsement. (2) The declaration referred in sub-rule (1) shall be in Form III. 10. Procedure for control of waste anti-fouling materials. –The waste from the application or removal of anti-fouling system controlled as specified in the Schedule shall be collected, handled, treated and disposed of in a safe and environmentally sound manner to protect human health and the environment, in accordance with Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, and the applicable rules made under the Act. 11. Inspection of vessels and detection of violations. – (1) A vessel to which these rules applies may, in any Indian port, shipyard, or offshore terminal, be inspected by surveyors for the purpose of determining whether the vessel is in compliance with these rules and unless there exists clear grounds for believing that a vessel is in violation of these rules, any such inspection shall be limited to – (a) verifying that, where required, there is onboard a valid International Anti-fouling System Certificate or Indian Anti-Fouling System Certificate or a Declaration on Anti- fouling System; and (b) a brief sampling of the anti-fouling system of the vessel that does not affect the integrity, structure, or operation of the anti-fouling system taking into account guidelines developed by the organisation, as may be required. (2) The time required to process the results of such sampling under clause (b) of sub-rule (1) shall not be used as a basis for preventing the movement and departure of the vessel. (3) If there are clear grounds to believe that the vessel is in violation of these rules, a thorough inspection may be carried out taking into account guidelines developed by the organisation and in accordance with the applicable rules made under the Act dealing with Port State Control and Flag State Implementation. 12. Penalties and enforcement. – (1) Any contravention of these rules or failure to comply with any requirement thereof shall be liable to penalties as specified in the Act. (2) Any person who operates any vessel in contravention of the provisions of these rules, and for which no specific penalty is provided under sub-section (2) of section 281 of the Act, shall be liable to penalty which may extend to fifty thousand rupees, and if the breach is a continuing one, with further penalty which may extend to five thousand rupees for every day after the first day during which the breach continues.
