उ‍त रािपत्र अजधसूचना की प्रजतयां िनसाधारण को तारीख 18 िून, 2024 को उपलब् ध करवाई गई थीं; उ‍त प्रारुप जनयमों के संबंध में िनसाधारण से प्रा‍ त आक्षपे ों और सुझावों पर केंद्रीय सरकार द्वारा सम् यक् रूप स े जवचार दकया गया ह;ै अत:, अब, केन्‍द द्रीय सरकार, अतं िेिीय िलयान अजधजनयम, 2021 (2021 का 24) धारा 3 के खंड (च); धारा 22, धारा 106 की उपधारा (2) के खंड (क), खडं (ण) और खंड (ययक) तथा धारा 108 द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए जनम्न जलजखत जनयम बनाती ह,ै अथागत् :-- 1. संजक्ष‍ त नाम और प्रारंभ.— 7070 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (1) इन जनयमों का संजक्ष‍ त नाम अंतििे ीय िलयान (केंद्रीय डाटाबेस और सहबद्ध मामल)े जनयम, 2024 ह ै। (2) य ेरािपत्र में इनके अंजतम प्रकािन की तारीख को प्रवृत् त होंगे । 2. पररभाषाए.ं- (1) इन जनयमों म,ें िब तक दक संिभग से अन्‍दयथा अपेजक्षत न हो,- (क) “अजधजनयम” स ेअंतिेिीय िलयान अजधजनयम, 2021 (2021 का 24) अजभप्रेत ह;ै (ख) "सक्षम प्राजधकारी" से अजधजनयम की धारा 6 के अधीन गरित प्राजधकारी अजभप्रेत ह;ै (ग) "अजभजहत प्राजधकारी" से अजधजनयम की धारा 5 की उपधारा (3) के अधीन राज्य द्वारा जनयुक्त अजभजहत प्राजधकारी अजभप्रेत ह;ैं (घ) "नोडल कायागलय" से अजधजनयम की धारा 6 के अधीन गरित प्राजधकारी द्वारा अजभजहत कायागलय अजभप्रते ह;ै (ङ) "नोडल अजधकारी" से सक्षम प्राजधकारी द्वारा नोडल कायागलय के प्रिासन के जलए और जनयम 5 के अधीन कतगव्यों के पालन के जलए जनयक्तु कोई अजधकारी अजभप्रेत ह;ै (च) "पोटगल" स ेनोडल अजधकारी और जनयम 5 के उपजनयम (4) के अधीन जनयुक्त अजधकाररयों या व्यजक्तयों द्वारा- (i) िलयानों के सवेक्षण और रजिस्ट्रीकरण से संबंजधत प्रदिया को सुकर बनाने, िलयान की बाबत प्रमाणपत्र िारी करन े और कमीिल की सक्षमता के प्रमाणपत्र िारी करने; (ii) मिीन द्वारा पिनीय, मुद्रणीय, साझा योग्य, सत्यापन योग्य और सुरजक्षत इले‍राजनक अजभलेखों के परररक्षण, प्रजतधारण और पहुचं प्रिान करने; (iii) राज्य में रजिस्ट्रीकृत िलयान से संबंजधत सभी जवजिजष्टयां अंतर्वगष्ट करने वाल े इले‍राजनक अजभलेखों के संग्रह का रखरखाव करन;े (iv) कमीिल के जलए िारी सक्षमता प्रमाणपत्रों के सभी ब्यौरे और डाटा अंतर्वगष्ट करने वाले इले‍राजनक अजभलेखों के सग्रं ह का रखरखाव करने, के जलए स्ट्थाजपत और अनरु जक्षत वैब या इले‍राजनक आधाररत प्रणाली अजभप्रेत ह;ै (2) “तृतीय पक्षकार पहुचं ” स े इन जनयमों के अनुसार िलयान के दकसी स्ट्वामी या िलयान के स्ट्वामी के प्राजधकृत प्रजतजनजधयों या कमीिल या प्रजिक्षण संस्ट्थानों द्वारा केंद्रीय डाटाबेस तक पहुचं ह ै ककंतु इसमें अजधजनयम या जनयमों के अधीन प्रिासजनक या काननू ी प्राजधकारी सजम्मजलत नहीं ह ै । उन िब्िों और पिों के, िो इन जनयमों म ें प्रयक्तु ह ैं और पररभाजषत नहीं ह ैंककंतु अजधजनयम में पररभाजषत ह,ैं वही अथग होंगे, िो उनके इस अजधजनयम में ह ै। 3. केंद्रीय डाटाबेस का प्ररूप.- अजधजनयम की धारा 3 के खंड (च) में जनर्िष्टग केंद्रीय डाटाबसे में जनम्नजलजखत डाटा और ब्यौरे इले‍राजनक प्ररूप म ें अंतर्वगष्ट होंगे- (1) अंतिेिीय िलयान (सवेक्षण और प्रमाणन) जनयम 2022 के प्ररूप 1 से प्ररूप 9 में यथा अंतर्वगष्ट िलयान का सवेक्षण करने के जलए आवेिन, सवेक्षक द्वारा िारी की िाने वाली घोषणा, उपस्ट्कर और िलयान सूचना का जवलेख, सवेक्षण के अनंजतम प्रमाणपत्र के जलए आवेिन, सवेक्षण का अनंजतम प्रमाणपत्र, सवेक्षण का प्रमाणपत्र, िलयान, जिसका पहली बार सवेक्षण दकया िाना ह,ै के सवेक्षण के जलए प्रस्ट्तुत की िान े वाली जवजिजष्टयां, सवेक्षण के प्रमाणपत्र पर िलयान के नाम पररवतगन के जलए आवेिन; (2) अंतििे ीय िलयान (रजिस्ट्रीकरण और अन्‍दय तकनीकी मद्दु े) जनयम 2022 के प्ररूप 1 से प्ररूप 13 में यथा अतं र्वगष्ट अंतिेिीय िलयान के रजिस्ट्रार द्वारा अनुरजक्षत की िान े वाली रजिस्ट्रीकरण बही, िलयान के रजिस्ट्रीकरण के जलए आवेिन, िलयान के स्ट्वाजमत्व की घोषणा, रजिस्ट्रीकरण प्राजधकारी द्वारा अंतिेिीय िलयान के जनरीक्षण की तारीख और समय जनयत दकया िाना, काललंग और मार्किंग रट‍पण, पररवतगन के रजिस्ट्रीकरण के जलए आवेिन, रजिस्ट्री के अतं रण के जलए आवेिन, रजिस्ट्रीकरण प्रमाणपत्र, बंधक सृजित करने वाली जलखत, बंधक का अतं रण सृजित करन े वाली जलखत, बंधक का उन्‍दमोचन सृजित करने वाली जलखत, रजिस्ट्रीकरण के अनंजतम प्रमाणपत्र के जलए आविे न, रजिस्ट्रीकरण का अनंजतम प्रमाणपत्र ; (3) अंतििे ीय िलयान (काम में लगाना) जनयम 2022 के प्ररूप 1 स े प्ररूप 3 म ें यथा अतं र्वगष्ट कमीिल के जलए िारी सक्षमता प्रमाणपत्र, सक्षमता प्रमाणपत्र के जलए परीक्षा में उपजस्ट्थत होने के जलए जचदकत्सा प्रमाणपत्र, सेवा प्रमाणपत्र,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 सक्षम प्रमाणपत्र के जलए परीक्षा में उपजस्ट्थत होने के जलए आविे न; (4) अंतििे ीय िलयान (प्रिषू ण की रोकथाम और संरोधन) जनयम 2022 में यथा अंतर्वगष्ट, अंतिेिीय िलयान (बीमा, िाजयत्व की सीमा और सेवा प्रिाताओं और सेवा प्रयोक्ताओं की बाध्यता) जनयम 2022 के प्ररूप 2 में यथा अतं र्वगष्ट प्रिषू ण के रोकधाम और संरोधन के जलए पालन का प्रमाणपत्र; (5) स्ट्वागत सुजवधाओं के डाटा और ब्यौरे; (6) ऐस ेअन्‍दय प्ररूप, िो जवजनर्िगष्ट दकए िाए ं। 4. जनििे िारी करन े के िजक्त.- सक्षम प्राजधकारी इन जनयमों के प्रयोिनों के जलए नोडल अजधकारी के चयन और जनयुजक्त के जलए अहतग ाओं, मानिंड और ऐसी अन्‍दय जनबंधनों और ितों के संबंध म ेंजनिेि िारी करेगा । 5. नोडल अजधकारी के कतब्ग य.- (1) नोडल अजधकारी केंद्रीय डाटाबेस की मानीटरी, प्रिासन और अनुरक्षण करेगा तथा यह सुजनजित करेगा दक वेब टगल पर अजभजलजखत और उपलब्ध सूचना सुरजक्षत और प्रकायग हो। (2) नोडल अजधकारी, जनयम 9 के अधीन प्रत्येक राज्य के अजभजहत प्राजधकाररयों से डाटा और ब्यौरे एकजत्रत करन े के जलए उत्तरिायी होगा । (3) जनयम 9 के अधीन अजभजहत प्राजधकाररयों से प्राप्त पालन ररपोटग और डाटा, नोडल अजधकारी द्वारा सक्षम प्राजधकारी को जनयजमत अतं रालों पर उपलब्ध कराए िाएंगे, िैसा सक्षम प्राजधकारी द्वारा जनिेि दिया िाए । (4) उपरोक्त उपजनयम (1) में उपबंजधत कतगव्यों का पालन करने के प्रयोिन के जलए सक्षम प्राजधकारी की पूवग अनुज्ञा के अध्यधीन रहते हुए नोडल अजधकारी ऐसे अजधकाररयों या व्यजक्तयों की जनयुजक्त कर सकेगा, िो सूचना प्रौद्योजगकी, डाटा हथालन और संरक्षण तथा साफ्टवेयर या हाडगवेयर जवकास या ऐसे अन्‍दय प्रयोिनों के क्षेत्र म ें जविेषज्ञ हो; और ऐसी जनयुजक्त केंद्रीय सरकार द्वारा समय-समय पर यथा आज्ञाजपत मागगििगक जसद्धांतों, जनबंधनों और ितों के अनुसार होगी । (5) नोडल आदिसर, डाटाबेस के समुजचत उपयोग और उसमें अन्‍दतर्वगष्ट सूचना प्रबंधन सुजनजित करन े के जलए, उसके अधीन जनयक्तु अजधकाररयों या व्यजक्तयों के प्रजिक्षण के जलए व्यवस्ट्था करेगा । नोडल आदिसर, डाटाबेस और सूचना प्रबंधन के संबंध में पिजभजहत प्राजधकरणों के पिाजधकाररयों, अन्‍दय अधीनस्ट्थ अजधकाररयों तथा पणधाररयों के प्रजिक्षण की भी व्यवस्ट्था करेगा । (6) जनयम 5 के उपजनयम (4) के अधीन जनयुक्त नोडल आदिसर और अजधकारी या व्यजक्त जनम्नजलजखत रीजत म ें केंद्रीय डाटाबेस बनाएं रखेंग-े i. डाटा की अखंडता, सुरक्षा, मानक और क्वाजलटी ; ii. सोपनीयता तथा जनष्पािन ईष्टतमीकरण सुजनजित करना ; iii. बैकअप और वसलू ी के जलए पयागप्त तंत्र बनाना ; iv. डाटा की सगं तता सुजनजित करना ; v. प्रलेखीकरण और मेटा डाटा बनाए रखना ; vi. जनष्पािन मानीटरी और ईष्टतमीकरण सुजनजित करना ; vii. िीडीपीआर, पीसीआई डीएसएस, मेटी मागगििगक जसद्धान्‍दत िैस े सुसंगत डाटा संरक्षण का अनुपालन सुजनजित करना ; viii. पररवतगन प्रबंधन और जनयजमत रखरखाव सुजनजित करना ; ix. और ऐसे डाटाबेस रखरखाव के जलए मानक प्रचालन पद्धजतयों और मागिग िी जसद्धांतों का अनुपालन करना, के िो समय-समय पर सक्षम प्राजधकारी द्वारा िारी की िाए ं। 6. केंद्रीय डाटाबेस को बनाए रखने के जलए मानक और पद्धजतयां : (1) जनयम 5 के अधीन रहत े हुए, नोडल आदिसर यह सुजनजित करेगा दक जनम्नजलजखत मानक और पद्धजतयां जनम्नजलजखत रीजत में इन जनयमों के अधीन डाटाबेस को बनाए रखने के जलए कायागजन्‍दवत की िाती हैं :- (i) डाटाबेस का प्रबंध करने के जलए उत्तरिाजयत्व का स्ट्पष्ट पिाजभधान ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) डाटा क्वाजलटी, अखण्डता, और सुरक्षा के जलए उत्तरिायी व्यजष्टयों या टीमों की पहचान । iii. डाटा सृिन, भंडारण, पुनःप्राजप्त और पुरालेखीकरण या जवलोपन के जलए पद्धजतयों को पररभाजषत करना । iv. एडजमन, यूिर, गेस्ट्ट िैसी भूजमकाओं को पररभाजषत करना और प्रत्येक भूजमका के जलए पहुचं अजधकारों को जवजनर्िगष्ट करना । v. सुरजक्षत लॉगइऩ तंत्र का कायागन्‍दवयन और यह अवधारण करना दक कौन दकस डाटा को प्राप्त कर सकता । vi. अनुमागणग ीयता और िवाबिेही के जलए सभी डाटा बेस दियाकलापों की लालगगं सुजनजित करना । vii. अद्यतन िानकारी की गंभीरता और आवृजत्त पर आधाररत जनरन्‍दतर बैकअप का जनष्पािन करना । viii. अनुपालन सुजनजित करन े और भंडारण उपयोग को ईष्टतम बनान े के जलए बैकअप डाटा के जलए प्रजतधारण नीजतयों को पररभाजषत करना । ix. डाटा को अजवकल और सुरजक्षत रखन े के जलए समर्पगत डाटाबेस बनाना । x. अजधजनयम की धारा 3 के खंड (च), धारा 41 या इस अजधजनयम के अधीन बनाए गए ऐसे अन्‍दय जनयमों में अजधदिष्ट ब्यौरों को अजभजलजखत करना ; xi. ऐसी सूचना या डाटा के स्रोत का उपबंध करना जिसे अजभजलजखत दकया गया ह ै और रखा गया है, िो संबद्ध प्राजधकाररयों द्वारा सत्यापन के जलए उपलब्ध ह ै ; xii. प्रिासन और / या तृतीय पक्षकार पहुचं को यूिर मनै ुअल, उपलब्ध कराना, उस तक सुगम्यता के जनबिंधन, पद्धजतयां और जनबंधन तथा ित े ; xiii. लेखाओं का रजिस्ट्रीकरण, यूिर पहचान तथा यूिर इन्‍दटरिेस के जलए पासवडग समनुिेजित करना; xiv. सूचना को अपलोड करन ेके जलए पद्धजतयों का उपबंध करना ; xv. जनिी नीजतयों, िाजयत्वों और प्रजतजल‍याजधकारों का उपबंध करना ; xvi. आवजधक रूप से डाटाबेस को अद्यतन करना ; xvii. छानबीनों के इजतहास को बनाए रखना ; xviii. आवश्यक स्ट्वत्वत्यागों का उपबंध करना ; और xix. ऐसे अन्‍दय जवषय, िो समय-समय पर सक्षम प्राजधकारी द्वारा सजम्मजलत दकए िाऩे के जलए जनिेजित दकए िाएं । xx. डाटाबेस ईष्टमीकरण, पैच प्रबंध, और साफ्टवेयर अपडेट िैसे नैजत्यक रखरखाव कायों को जनयत करना । xxi. डाटाबेस पणधाररयों के बीच प्रभावी संसूचना के जलए सहयोग मंचों का उपयोग करना । xxii. डाटाबेस के जलए िीडबकै और सुझावों का उपबंध करने के जलए उपभोक्ताओं के जलए चैनलों की स्ट्थापना करना । xxiii. उत्पन्न होने वाली आवश्यकताओं तथा प्रौजद्यजगदकयों का समाधान करन े के जलए डाटाबेस मागगििकग जसद्धांतों, नीजतयों और पद्धजतयों का जनयजमत पनु र्वगलोकन करना । xxiv. िीडबैक का आग्रह करके और भूतकाजलक अनुभवों से सीखे गए पािों को समाजवष्ट करके सतत् सधु ार की संस्ट्कृजत को प्रोत्साजहत करना । xxv. केंद्रीय डाटाबेस में जवरासत डाटा को स्ट्कैन करना और उसे अपलोड करना । (2) केंद्रीय डाटाबेस के उपभोक्ता यह सुजनजित करेंग े दक उपभोग या छानबीन पणू गतया इन जनयमों के अधीन उपबंजधत मानकों और पद्धजतयों के अनरूु प ह ै। 7. सुगम्यता: (1) जनयम 5 के उपजनयम (4) के अधीन नोडल आदिसर द्वारा जनयुक्त नोडल आदिसरों द्वारा जनयुक्त नोडल आदिसर और अजधकाररयों तथा व्यजक्तयों की डाटाबेस तक पूण गपहुचं होगी । (2) उपरोक्त उपजनयम (1) में अन्‍दतर्वगष्ट दकसी बात के होते हुए भी, सक्षम प्राजधकारी द्वारा िारी दकए गए जनबंधनों और ितों के अनुपालन में िेनेररक डाटा तक सीजमत तृतीय पक्षकार की पहुचं का उपबंध दकया िा सकेगा ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (3) िलयानों के स्ट्वाजमयों की उसके स्ट्वाजमत्वाधीन िलयानों से संबंजधत िानकारी तक ही पहुचं होगी । (4) कमीिल की उनके प्रोिाइल तक ही सीजमत पहुचं होगी । (5) इस जनयम के प्रयोिन के जलए, सक्षम प्राजधकारी, केंद्रीय सरकरा के पूण ग अनुमोिन से, ततृ ीय पक्षकार पहुचं के जनबंधनों तथा ितों का उपबंध करन े के जलए ऐसे जनिेि या मागगििगक जसद्धांत िारी कर सकेगा । 8. गोपनीयता : (1) केंद्रीय डाटबेस पर छानबीन स े अजभप्राप्त दकसी भी सूचना को गोपनीय समझा िाएगा और सक्षम प्राजधकारी द्वारा यथा अनुज्ञात घोजषत प्रयोिन के जलए प्रकट दकया िाएगा अन्‍दयथा नहीं । (2) इस जनयम के प्रयोिन के जलए, सक्षम अजधकारी जनिेि द्वारा, ऐस े जनबंधनों और ितों का उपबंध कर सकेगा जिनके अधीन रहत ेहुए सूचना को उपयोक्ता द्वारा प्रकट दकया िा सकता ह ै। 9. पिाजभजहत प्राजधकारी का कतगव्य :- (1) प्रत्येक राज्य का पिाजभजहत प्राजधकारी, तीस दिन से अनजधक के जनयजमत अन्‍दतरालों पर इले‍रॉजनक रूप में नोडल आदिसर को जनयम 3 म ें अन्‍दतर्वगष्ट डाटा और ब्यौरों का उपबंध करन े के जलए जिम्मेिार होगा । (2) प्रत्येक राज्य का पिाजभजहत प्राजधकारी, जनयम 3 म ें अन्‍दतर्वगष्ट डाटा और ब्यौरों का वास्ट्तजवक काल में नए इले‍रॉजनक अजभलेखों को सृजित करने के जलए जिम्मेिार होगा । [िा.स. आईडब्ल्यूटी-11011/114/2021-आईडब्ल्यूटी] डॉ. कमला कान्ता नाथ, सलाहकार (साांख्यिकी) MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 29th October 2024 G.S.R. 670(E).—Whereas draft of the Inland Vessels (Central Database and Allied Matters) Rules, 2024 were published, as required under sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), vide notification of the Government of India in the Ministry of Ports, Shipping and Waterways number G.S.R. 333 (E), dated the 18th June, 2024, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 18th June, 2024, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of Gazette containing the said notification were made available to the public; And whereas copies of the said notification were made available to the public on 18th June, 2024; And whereas no objections and suggestions were received from the public in respect of the said draft rules by the Central Government; Now, therefore, in exercise of the powers conferred under clause (f) of section 3, section 22, clauses (a), (o) and (zza) of sub-section (2) of section 106 and section 108 of the Inland Vessels Act, 2021 (24 of 2021), the Central Government hereby makes the following rules, namely. - 1. Short title and commencement. –– (1) These rules may be called the Inland Vessels (Central Database and Allied Matters) Rules, 2024. (2) They shall come into force on the date of their publication in Official Gazette. 2. Definitions. –– (1) In these rules, unless the context otherwise requires, – (a) “Act” means the Inland Vessels Act 2021 (24 of 2021); (b) “nodal office” means office designated by the competent authority; (c) “nodal officer” means any officer appointed by the competent authority to administer the nodal office and to perform duties under rule 5; (d) “portal” means a web or electronic based system set up and maintained by the nodal officer and the officers or persons appointed under sub-rule (4) of rule 5 for,–––6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) facilitating the processes relating to survey and registration of vessels, issuance of certificates in respect of vessels and the issuance of certificates of competency to the crew; (ii) preserving, retaining and granting access to machine readable, printable, shareable, verifiable and secure electronic records; (iii) maintaining a repository of electronic records containing all particulars pertaining to vessels registered; (iv) maintaining a repository of electronic records containing all details and data of the certificates of competency issued to the crew; (v) maintaining a repository of electronic records containing all details and data of reception facilities and (vi) such other data (e) “third party access” means access of central database in accordance with these rules, by any owner of vessel or authorised representatives of the owner of vessel or ship manager or crew or training institutes or ship designer or classification societies or ship builder or service provider or but does not include administrative or statutory authorities under the Act or the rules. (2) Words and expressions used in these rules and not defined, but defined in the Act, shall have the same meanings respectively assigned to them in the Act. 3. Form of central database. - The central database referred to in clause (f) of section 3 of the Act shall contain the following data and details in electronic form, namely– (i) application for conducting survey of vessel; (ii) declaration to be issued by the surveyor; (iii) record of equipment and vessel information; (iv) application for provisional certificate of survey; (v) provisional certificate of survey; (vi) survey certificate of category A, B and C vessel; (vii) particulars to be furnished for survey of new vessel which is to be surveyed for the first time; (viii) official log book for an inland mechanically propelled vessel; (ix) application for change of name of the vessel on certificate of survey, as contained in form 1 to 9 of the Inland Vessels (Survey and Certification) Rules, 2022; (x) Book of registration of vessels and application for registration, declaration of ownership, appointment of date and time of inspection of the inland vessel by the registering authority; (xi) carving and marking note, application regarding registration, application for transfer of registry, instrument creating, transfer or discharge of mortgage, application for issuance of provisional certificate of registration as contained in Forms 1 to 13 of the Inland Vessels (Registration and other technical issues) Rules, 2022; (xii) certificates of competency issued to crew, medical certificate for appearing for certificate of competency, certificate of service, application form for appearing in certificate of competency, as contained in Forms 1 to 3 of the Inland Vessels (Manning) Rules, 2022; (xiii) certificate of compliance for prevention and containment of pollution, as contained in Third Schedule of the Inland Vessels (Prevention and Containment of Pollution) Rules, 2022, certificate of insurance as contained in Form 2 of the Inland Vessels (Insurance, Limitation of Liability and Obligations of Service Providers and Service Users) Rules, 2022; (xiv) data and details of reception facilities: and (xv) such other data as may be directed to be included by the competent authority 4. Powers to issue directions. - The competent authority shall issue directions regarding the qualifications, criteria and other terms and conditions for selection and appointment of nodal officer for the purposes of these rules. 5. Duties of nodal officer. - (1) The nodal officer shall monitor, administer and maintain the central database and shall ensure that the information duly recorded and available in the web portal is secured and functional. (2) The nodal officer shall be responsible for collecting the data and details from the designated authorities of each State under rule 9.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (3) A report of performance and data received from the designated authorities under rule 9 shall be provided by the nodal officer to the competent authority at such regular intervals, as may be directed by the competent authority. (4) The nodal officer after prior permission of the competent authority for the purposes of performing the duties under sub-rule (1), may appoint officers or persons, who are experts in the field of information technology, data handling and protection and software or hardware development. Such appointment shall be made in accordance with the guidelines, terms and conditions as mandated by the Central Government from time to time. (5) The nodal officer shall provide for training of officers or persons appointed under him to ensure appropriate utilisation of the database and the management of information contained therein, and shall also provide training of officials of designated authorities, other sub-ordinate officers and stakeholders on database and management of information. (6) The nodal officer and the officers or persons appointed under sub-rule (4) of rule 5, in order to maintain the central database shall –– (i) ensure the integrity, security, standards and quality of data; (ii) ensure scalability and performance optimisation; (iii) make sufficient mechanisms for backup and recovery; (iv) ensure consistency of data; (v) maintain documentation and metadata; (vi) ensure performance monitoring and optimisation; (vii) ensure compliance with relevant data protection regulations such as General Data Protection Regulation (GDPR), Payment Card Industry Data Security Standard (PCI DSS), Ministry of Electronics and Information Technology (MeitY) Guidelines; (viii) ensure change management and regular maintenance; and (ix) comply with standard operating procedures and guidelines for maintenance of the database, as may be issued by the competent authority from time to time. 6. Standards and procedures for maintaining the central database. - (1) Subject to the provisions of rule 5, the nodal officer shall ensure that the following standards and procedures are implemented for maintaining the database, namely: - (i) managing the database properly; (ii) identification of individuals or teams responsible for data quality, integrity, and security; (iii) defining processes for data creation, storage, retrieval, and archiving or deletion; (iv) defining roles such as admin, user, guest and specify access rights for each role; (v) implementation of secure login mechanisms and determine who can access what data; (vi) ensure logging of all database activities for traceability and accountability; (vii) performing frequent backups and updates; (viii) defining retention policies for backup data to ensure compliance and optimise storage usage; (ix) forming a dedicated database to keep the data intact and secured; (x) recording the details as mandated under clause (f) of section 3, sub-section (3) of section 41 of the Act or rules made thereunder; (xi) providing source of information or data that has been recorded, maintained and available for verification by authorities concerned; (xii) providing user manual, restrictions, procedures and terms and conditions of accessibility to administration or third-party access; (xiii) assigning registration of accounts, user identity and passwords for user interface; (xiv) providing procedures for uploading of information; (xv) providing privacy policies, liabilities and copy rights; (xvi) updating the database periodically; (xvii) maintaining history of searches; (xviii) providing necessary disclaimers; (xix) scheduling routine maintenance tasks such as database optimisation, patch management, and software updates; (xx) utilising collaboration platforms for effective communication among database stakeholders; (xxi) establishing channels for users to provide feedback and suggestions for database improvement;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (xxii) conducting regular reviews of database guidelines, policies, and procedures to address evolving needs and technologies; (xxiii) continuous improvement by soliciting feedback and incorporating lessons learned from past experiences; and (xxiv) scanning of legacy data and uploading in central database. (xxv) such other matters as may be directed to be included by the competent authority from time to time; (2) The users of the central database shall ensure that use or search is fully in conformity with the standards and procedures provided under these rules. 7. Accessibility: - (1) The concerned officials of Central Government, Competent Authority, Designated Authorities, or officials of State Government shall have complete access to the central database; (2) The nodal officer and the officers and persons appointed by the nodal officer under sub-rule (4) of rule 5, shall have complete access to the database. (3) Notwithstanding anything in sub-rule (1) & sub-rule (2), in compliance with terms and conditions issued by the competent authority, limited third party access to generic data may be provided. (4) Owners of vessels shall have access only to the information relating to the vessels owned by them. (5) Crew shall have limited access only to their profiles. (6) Training institutes shall have access to their own institute data. 8. Confidentiality: - (1) Any information obtained from the search on the central database shall be treated as confidential and shall not be disclosed except for a purpose declared as permitted by the competent authority. (2) For the purpose of this rule, competent authority may, by directions, provide for such terms and conditions subject to which information could be disclosed by the user. 9. Duty of the designated authority. – (1) The designated authority of each State shall be responsible for providing the data and details contained in rule 3 to the nodal officer in electronic format at regular intervals of not more than thirty days. (2) The designated authority of each State shall be responsible for creating new electronic records in real time of the data and details contained in rule 3. [F.
