**Executive Summary**
This document notifies the "Delhi Electricity Regulatory Commission (Terms and Conditions for Open Access) (Second Amendment) Regulations, 2026," which amends the Principal Regulations of 2005 regarding additional surcharges for Open Access (OA) and General Network Access (GNA). Published on March 27, 2026, the regulations are effective immediately across the National Capital Territory of Delhi. The primary objective is to implement a four-year linear reduction and eventual elimination of the additional surcharge for consistent users.
**Key Points / Main Content**
**Reduction and Elimination of Additional Surcharge**
* **Linear Reduction:** For persons availing GNA or OA, the additional surcharge will be reduced linearly from the value set in the year access was granted.
* **Four-Year Timeline:** The additional surcharge will be completely eliminated within four years from the date of grant, provided the person continues to avail of the access.
**Refund and Recovery Restrictions**
* **No Retrospective Claims:** Users are not eligible to seek or claim any refund, adjustment, or recovery for additional surcharges already levied or collected under existing regulations.
**Exemptions and Applicability**
* **Contract Demand Exemption:** The additional surcharge does not apply to an OA consumer to the extent that their contract demand is maintained with the distribution licensees.
* **Consumer Status Requirement:** The surcharge is only applicable to OA consumers who are currently or have previously been consumers of the concerned distribution licensee.
**Definitions and Scope**
* **Alignment with Central Regulations:** Terms such as "General Network Access" and "Temporary-GNA" carry the same meaning as defined in the Central Electricity Regulatory Commission Regulations, 2022.
* **Jurisdiction:** These regulations extend to the entire National Capital Territory of Delhi.
**Impact Analysis**
**Open Access Consumers and GNA Users**
**Impact**
These stakeholders will experience a phased reduction in the cost of access over four years, leading to total elimination of the additional surcharge if they maintain continuous access. However, they lose the right to claim refunds for any surcharges paid under previous rules.
**Action Required**
Consumers should track the date of their GNA/OA grant to ensure the linear reduction is correctly applied to their billing and maintain appropriate contract demand levels with distribution licensees to utilize available exemptions.
**Distribution Licensees**
**Impact**
Licensees will see a gradual decrease in revenue from additional surcharges over a four-year period for each eligible consumer. Their ability to levy this surcharge is restricted to current or former consumers and is further limited by the consumer’s maintained contract demand.
**Action Required**
Licensees must update their billing systems to reflect the linear reduction schedule and ensure that surcharges are not applied to the portion of load where contract demand is maintained with the utility.
