द्वारा पररयोिना स्ट्थल से 135 वृक्षों का प्रत्यारोपण उसी पररयोिना स्ट्थल में एवं 261 वृक्षों का प्रत्यारोपण (ि) एन. टी. पी. सी. ईको पाकि, बिरपुर, दिल्ली में स्ट्वयं की लागत पर दकया िाएगा। 2. उपरोि 1 (क) और (ि) के अनुसार, ििे ी प्रिाजतयों के 3960 पौधो का 100% प्रजतपूरक वृक्षारोपण और उनका सात वषो तक रि रिाव उपभोगी संस्ट्था द्वारा दकया िायेगा। इस वृक्षारोपण के सफलतापूविक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी। 3. 3960 वृक्षों के प्रत्यारोपण दकए िाने के बिले मे 1:10 के अनुपात मे स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीने के अंिर जनधािररत की गई भूजम पर अजतररि उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वषों के जलए रिरिाव उसके बाि उनका रिरिाव उपभोगी संस्ट्था द्वारा अपने स्ट्वयं की लागत पर दकया िाएगा । 4. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोपण उपभोगी संस्ट्था द्वारा िुरू दकया िाएगा और इसे छि मिीने के अंतराल में पूणि दकया िाएगा। प्रत्यारोपण प्रदक्रया के पूणि िोने का बाि एक सम्पूणि ररपोटि संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी।प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम निीं िोनी चाजिए। 5. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजित सभी ितों का पालन दकया िाएगा। 6. यदि उपभोगी संस्ट्था सफलतापूविक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्था द्वारा अजतररि साइट सुधार िचों को िमा दकया िाएगा िो दक वृक्ष अजधकारी (पजिम ) द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुि बनाने के जलए आवश्यक िो सकती ि।ै 7. िो भूजम प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण के जलया आवंरटत िै, उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया िाएगा।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 8. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 की धारा 12 के अनुपालन में वृक्ष अजधकारी (पजिम) को प्रस्ट्तुत दकया िाएगा। 9. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधािररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वषि के अंत में वृक्ष अजधकारी (पजिम) को प्रस्ट्तुत की िाएगी। 10. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण का कायि िुरू करने से पूवि साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा। 11. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण कायि की गजतजवजधयों को दकया िाएगा। 12. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण की आवंरटत भूजम पर ज़मीन तैयार करने के भारी उपायों का उपयोग डीसीएफ (पजिम) द्वारा िारी दकये गए पत्र दिनांक 22.10.2021 के अनुसार दकया िायेगा अथाित 1.5 मीटर गिरी जमटटी का भराव दकया िायेगा । 13. वृक्षो को प्रत्यारोपण के जलए अनुमजत उनके स्ट्वयं के िोजिम पर और दकसी भी अन्य व्यजि के िावे के पक्षपात के जबना,िो वृक्षो और भूजम पर सिी िो सकती िै,िी िा रिी िै । 14. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायि सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा। 15. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तित निीं दकया िाएगा। 16. उपभोगी संस्ट्था द्वारा वृक्षो की कटाई/प्रत्यारोपण की प्रगजत ररपोटि सबं ंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की िाएगी। 17. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ैतो उसे तब तक निीं काटा िाएगा िब तक दक पक्षी उसे छोड़ न िें। 18. उपभोगी संस्ट्था द्वारा 396 वृक्षो के अलावा दकसी भी वृक्ष की कटाई/प्रत्यारोपण दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 के अन्तगित एक अपराध िोगा। 19. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के िाते मे रािस्ट्व के रूप में िमा की िाएगी। 20. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िािाओं को काटे िाने के उपरान्त प्राप्त लकजड़यों को मुफ्त में जनकटतम सावििजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी(पजिम) को भी िी िाएगी। 21. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के स्ट्थल से लकजड़यों को ले िाने से पूव ि वृक्ष अजधकारी (पजिम ) से ढुलाई अनुमजत प्राप्त करनी िोगी। 22. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावििजनक श्मिान मे 90 दिनों के अंिर पूरा दकया िाएगा। 23. उपभोगी संस्ट्था के द्वारापयािवरण मंिूरी में और अन्य मंिूरी में उजल्लजित सभी ितोंितों,यदि कोई िो,का जनष्ठापूविक पालन दकया िाएगा। यि माननीय पयािवरण एवं वन मंत्री राष्ट्रीयरािधानी क्षेत्र दिल्ली सरकार के पूवि अनुमोिन से िारी दकया िाता ि।ै संिीव of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 6.6305 ha. approx. as detailed below for development/ redevelopment of Vice President Enclave, Delhi, from the provision of sub-section (3) of section 9 of the said Act.4 DELHI GAZETTE : EXTRAORDINARY PART IV] Location Total Number Central Public Works Department (PWD), herein referred to as User Agency, shall make an advance deposit of an amount of Rs.2,25,72,000 /- (Rs. Two Crore Twenty Five Lakh and Seventy Two Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows, S.N. Location of Compensatory plantation. Number of Total Amount including To be Deposited saplings to other Administrative with Forest be planted expenses and contingency Division. charges (in Rs.). (1) (2) (3) (4) (5) (a) 100% Compensatory Plantation ten times Deputy the number of trees permitted for Conservator of transplantation of 396 nos. of trees i.e Forests (West)/ 3960 number of tree saplings proposed to 3960 2,25,72,000 /- Tree Officer be planted of species Neem, Amaltas, Peepal, Pilkhan, Gular, Bargad, Arjunalong with other native species shall be carried out by User Agency/ CPWD at NTPC Eco park, Badarpur, Delhi (b) Transplantation of 135 no. of trees at same project site and 261 no. of trees at NTPC Eco Park, Badarpur, Delhi shall be done by User Agency with their own funds. 2. 100% Compensatory Plantation of 3960 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above. 3. 3960 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of transplantation of 396 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. 4. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than six (06) months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. 5. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency. 6. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits). 7. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other purpose without the approval of the State Government.[PART IV DELHI GAZETTE : EXTRAORDINARY 5 8. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of Delhi Preservation of Trees Act, 1994 before initiating transplantation. 9. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Govt. of NCT of Delhi and a copy of the same shall be submitted to the Tree Officer (West) at the end of every financial year. 10. User Agency shall submit a detailed plan for site preparation and plantation before initiating transplantation. 11. The User agency shall implement the improved soil moisture conservation activities on compensatory plantation site. 12. The User Agency shall implement heavy ground preparation measures i.e. filling of good earth of depth 1.5 mtr only after these measures are carried out the land shall be considered for raising Compensatory Plantation as communicated vide letter dated 22.10.2021 issued by DCF (West). 13. Permission for transplantation of 396 trees is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees. 14. Before the removal of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency. 15. The User Agency shall ensure that the plan of this proposal shall not be changed. 16. The progress report of transplantation shall be submitted through inspection officer concerned along with complete details of trees. 17. If any tree is found to have nest of birds it should not be felled/ transplant till the same is abandoned by the birds. 18. Transplantation of any tree apart from 396 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994. 19. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. 20. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (West) by User Agency. 21. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (West) by User Agency. 22. Transplantation of trees and transportation of forest produce arising therefrom to the public crematorium shall be completed within 90 days. 23. It should be ensured by the user agency that all the conditions mentioned in environmental clearance and other clearances, if any obtained, shall be followed scrupulously.
